Several months ago we met to discuss the construction of a portion of Victoria St. At that time,
we agreed that the City of College Station would construct a portion of Victoria St. as a part of
the Graham Rd. reconstruction project. Contingent to that agreement was the acquisition of right
of way for Victoria from a tract owned by Chet Fry and Lawrence Link. Subsequent to that
meeting you provided us with a copy of a three -way agreement from all of the private parties
involved.
Since that time we have been unable to obtain the right of way for the portion of Victoria that
would cross the Link -Fry property. The unsuccessful efforts to obtain this right of way caused
extensive delays in the Graham Rd. project. The College Station Public Works Department,
unable to sustain further delay in the Graham project, found it necessary to redesign the Graham
improvements to avoid right of way acquisition from Link -Fry and proceed with construction.
The City stands ready to honor that agreement if the Victoria right of way can be obtained in
time to be added to the Graham project. As before, the Public Works Department is prepared to
purchase the necessary right of way at its appraised value and construct Victoria from Graham
Rd. south to the back line of the Link -Fry property (the tract which fronts on Graham Rd.).
Home of Texas A &M University
An alternate option would be the dedication of right of way and construction of this portion of
Victoria by you as developers. An oversize participation request should be submitted for
Council consideration if you chose this option.
Please advise me as to which option you prefer to pursue. If you prefer that the City construct
Victoria across the Link -Fry property, Director of Public Works Mark Smith will order new
appraisals for the Victoria right of way needed from the Link -Fry property.

SUBJECT: Bella Vista Subdivision Proposal
Several meetings have taken place with several different combinations of people regarding the proposed
zoning and Master Plan for the 86 Acres Carroll tract. Each of the meetings brought some progress and
usually some new challenges. The recent predevelopment meeting raised valid concerns over which I have
no control but need help in resolving.
In order to accommodate the extension of Victoria and the improvement of Graham Road we have included
in our Master Plan approximately one -acre that Lawrence Link is to purchase from Carroll. As you may
recall, this acre is necessary for Link to be able to utilize his building after the improvement of both
Graham Road and Victoria. Apparently the City has been working with Link for some time concerning the
right -of -way for both streets. Link's ability to utilize this acre south of his present building is the key for
the success of these street improvements, which in turn are necessary for the development of the lands
along both sides of the Victoria extension.
At the Development Services meeting a concern was raised as to the appropriateness of M -2 zoning
adjacent to our requested R 1 zoning. It was suggested that a stronger application would be for R 1 zoning
with a special use permit for parking. This zone classification would preclude Link from using the property
as it has been used for many years. My concern is that Link is likely to be unwilling to move forward with
anything if he can't use the property as it is now used. Continued usage has been a strong requirement of
his all along.
You are aware, I am sure, of the three -way letter agreement included in our Master Plan application. This is
significant progress for the extension of those two streets and it is important that this rather tenuous
agreement not fall through at the coming Planning & Zoning meeting. I feel that we need to have another
meeting of the concerned parties before the Planning & Zoning meeting so that all consequences of zoning
alternatives are known. If in fact there were a chance of the present plan of action not meeting with success
we would discuss what might be a better approach.
There are several other issues of the Development Services meeting relating to the proposed development
which will be communicated directly to the appropriate department.

Staff reviewed the above - mentioned master development plan as requested. The following
page is a list of staff review comments detailing items that need to be addressed. Please address
the comments and submit the following information by Tuesday, February 6, 10:00 a.m. to be
placed on the next available Planning and Zoning Commission meeting scheduled for February
15, 2001, 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue.
Ten (10) copies of the revised preliminary plat; and
The Mylar original of the revised preliminary plat.

Bella Vista Parkland
Jessica Jimmerson, Staff Planner, will be handling the rezoning of the Bella Vista project. She asked me
to say a few words about the parkland issue.
It is my opinion that the applicant has not provided enough information to determine whether the area
being called parkland will end up or not end up as detention after culvert is installed on Victoria and the
site is developed. On the submitted Development Plan, the area depicting the trees would be considered
as greenway. However, after the fields, which now drain to the creek, are turned into homes and streets,
a large increase in runoff will occur. In addition, there are also plans to provide drainage for the Graham
Road project through Bella Vista increasing runoff further.
In other words, it is my opinion that if the area is accepted as shown, the whole area may be underwater
during rainfall events. A preliminary engineering analysis may be able to determine the limits and depths
of runoff for the area for post - development conditions and various rainfall events.
Ms. Jessica is interested in your reply so that she can prepare for questions from the PSZ.

RE: Proposed Rezoning of Carroll Tract (proposed Bella Vista Subdivision)

Dear Mrs. Jimmerson:
This is to notify you of our disapproval and opposition to the proposed rezoning of the
Carroll Tract, especially as to the proposed Master Plan of Bella Vista Subdivision which
omits entirely the East -West Collector as shown on the City's Current (as of 1999)
Thoroughfare Plan, which is attached hereto for your reference.
The East -West Collector should remain as shown on the north side of boundary line of
Lots 6 & 7 of Bald Prairie Subdivision and continuing westerly along the north side of
the Carroll fence line to intersect with Highway 40. This collector street should be
developed with the development of Bella Vista Subdivision as per the current City's
Development Ordinance.
There has been stated by you that TexDOT is requiring the relocation of the intersection
of the East -West Collector further south by some 500 feet, and therefore there is not a
need to follow the Current Thoroughfare Plan nor to require Bella Vista Subdivision to
develop the East -West Collector. Our engineer has checked the location of the
intersection of the East -West Collector if constructed as shown on the north side of the
fence line on the Carroll Tract and it would place the intersection more than 660 feet
south of the proposed temporary location of the intersection of Highway 40 and Wellborn
Road which currently meets all TexDOT rules and regulations for spacing. There are
several existing intersections in the City with similar or closer distances in spacing and
which do not pose any traffic problems. Our engineers have concluded that this
intersection would meet current TexDOT spacing requirements and that relocation of the
intersection, though possibly desirous, is Not Required under the existing spacing
guidelines of TexDOT.
Furthermore, the developer of Bella Vista would, by its proposed Master Plan and
Rezoning of Bella Vista, by implication change the current Thoroughfare Plan without
having it reviewed and revised by the Planning & Zoning Commission and the City
Council. There currently exists an approved Master Development Plan of Westfield
Addition which shows the location of the East -West Collector as ending at the rear or
north side of Lot 7, Bald Prairie Subdivision. Any changes in the current alignment of
the East -West Collector would first require modification of the Westfield Addition
Master Plan and to be reviewed and ruled upon by the Planning & Zoning Commission
and require modification of the City' Current Thoroughfare Plan by the City Council,
thereby giving proper legal notification to all affected property owners of changes in the
Thoroughfare Plan.
We therefor oppose the proposed relocation of the East -West Collector further south for
the following reasons:
1. Relocation is not required by TexDOT (only a desire or preference) and the
intersection at the Carroll property line meets the current TexDOT spacing
requirements.
2. Relocation cannot take place by implication as by filing of the Bella Vista Master
Plan and omitting the East -West Collector without formal and legal changes in the
following:
a. Revising the Master Plan of Westfield Subdivision, and
b. Revising the City's Current Thoroughfare Plan to show the location further south
and through Bald Prairie Subdivision.
3. The relocation would violate the City's principle and Mission statement of
preserving neighborhood integrity which such Collector street would impact on the
Bald Prairies Subdivision and its rural -like atmosphere. Especially in view of the
fact that the College Station Independent School District has purchased the land
across and south from Renee Lane and Barron Road for a proposed new High
School. The relocation would cause additional traffic from the school to cut through
the neighborhood instead of leaving it on Barron Road and the proposed Victoria
Avenue.
4. The construction of the relocated East West Collector may never happen since Lots
6 & & of Bald Prairie Subdivision are already platted lots owned by Mr. O. J. Beard,
Jr. Mr. Beard has previously stated that he has no intention of replatting the lots nor
constructing such road through his property. Therefore the East -West Collector may
not get built for many many years. This thwarts the intent and purposes of the
Thoroughfare Plan and its implementation and use by the City and its citizens. It
may therefore require the City to condemn the property and incur the cost itself to
accomplish the relocation. This is not the most efficient or desirable way and is not
the manner envisioned by the City's Subdivision Ordinance.
5. The difficulty of relocating the East -West Collector is that no lots can front the
Collector street and relocation causes planning problems for the other property
owners, especially with small strips of land between the proposed relocated collector
location and the property line.
6. The Bella Vista Subdivision would be deprived of the use of the East -West Collector
which would be more beneficial to the subdivision if it was located along the south
fence line instead of unloading traffic on Graham Road and over to Wellborn Road,
creating additional traffic hazards at Graham Road.
The preferred location is along the fence line as shown on the Thoroughfare Plan and
with possible participation from the adjoining land owners. The Bella Vista Master Plan
is not the only configuration that is possible and the developer should go back to the
drawing board and revise its plan taking into consideration the existing Thoroughfare
Plan along the fence line and consideration and coordination with other adjacent
properties. There are many options available in the arrangement and laying out of the
development of the East -West Collector and all affected owners need more time to
develop such other options which can then be reviewed by the Planning & Zoning
Commission. With such further consideration of other options, such process will be
viewed as fair to all concerned, regardless of the final outcome.
The bottom line is that relocation causes (1) platting and layout problems for property
impacted by the relocation, especially for owners Lot 6 & 7 of Bald Prairie which only
encompasses some 7 acres of land versus Bella Vista/Carroll Tract of some 87 Acres and
dealing with small strips of land, and (2) financial burden being shifted by Bella Vista to
others, but where it would be more beneficial for all concerned to enter into some cost
sharing arrangements rather any one party bearing all of the cost.
