If you recall, we spoke the week of 3/17 regarding what the City of College
Station believes is unfinished grading and drainage improvements related to this
project.
The grading in question is currently causing a diversion of flows onto private
residences within the adjacent Pebble Creek Development.
received a message from you this week stating that, to your knowledge, all work
required by the City had been performed.
Upon researching the files, I found that Ed Motley had been informed of the
defective grading in question on 11/12, and was also informed that remediation
would be a condition of the Certificate of Occupancy for the building. I have
attached a copy of this e-mail for your reference.
The Certificate of Occupancy was issued on 12/19 only after receiving a statutory
bond in the amount of $10,000 for this drainage work, which at that time was still
incomplete due to weather related delays. The bond provides for a term of four
months from the issuance of the CO to complete these efforts to release the
bond. The due date for these remediation efforts is therefore April 19, 2003. 1
have also included a copy of the bond for your use.
Based on my site inspection last week, the work is still incomplete, and is still
negatively effecting adjacent homeowners. Therefore we feel it prudent to issue
this reminder that grading will need to be completed prior to the April 19th
deadline to avoid a claim upon the related bond.

accomplished in order to bring the site into compliance with the City Ordinances.

SourceNet Drainage Issue
Mr. Motley,
I spoke with you concerning the drainage problem at the rear, SE corner, of the Sourcenet property. It
appears that fill was placed in this area, probably when the wall was constructed. This fill material was not
permitted. This fill material has cut -off the drainage path for the homes to the north and east. The City
received complaints from citizens after the rainy period we experienced a few weeks ago.
You were very cooperative in our conversation.
I did want to notify you that this item will be added to the City's punch -list for CO approval.

WHEREAS. the Principal is required to Install landscaping on Lot2 &2B , Block 1 ..The Busi
Center at. College Station, Brazos County, Texas, as required by Ordinance No. 1638, Section 11.5,
of the College Station Code of Ordinances and landscaping plan, which ordinance and plan are attached
hereto and made a part hereof as fully'and to the same extent as if copied at length herein; and
WHEREAS, Section 11.6 allows for the Issuance of a Certificate of Occupancy prior to completion of
required landscaping provided that the principal provides a bond in the amount of $5.00 times the
number of landscape points required for the project;
NOW, THEREFORE. THE CONDITION OF THIS OBLIGATION IS SUCH THAT if said principal shall
Install all required landscaping as required by City and detailed in the attached landscape plan and in
accordance with the above - stated ordinance and mcelve the approval for same by the City Planner on or
before four months from the date of issuance of a Certificate of Occupancy for the property, then this
obligation shall be void.
PROVIDED, HOWEVER, that the City having required the said Principal to furnish this bond in order to
comply with Chapter 11 of Ordinance No. 1638, Sections 11.5 and 11.6, and the landscaping plan, all
rights and remedies on this bond shall inure solely to such claimants and shall be determined in
accordance with the provisions, conditions and limitations of said ordinance.
IN WITNESS WHEREOF. the said Principal and Surety have signed and sealed this instrument, this
17th day of December ,2002.
