Dear Ms. Austin:
Thank you for notifying the City regarding damage to the fence behind SourceNet. A city
inspector was sent out to assess the situation and observed the conditions you described.
Our offices subsequently contacted the contractor, C. F. Jordan. Representatives of C.F.
Jordan have indicated that the work that has been done is only a short term fix and they are
working with the design engineer to develop a permanent solution to the problem. It is also
our understanding that the portion of the SourceNet masonry fence that was falling onto the
wooden fence has been moved.
In regard to your question regarding upkeep and safety /liability of the fence, SourceNet is the
owner of the fence and is responsible for any activity related to it. Staff is checking on your
question as to whether additional landscaping will be planted. SourceNet posted a bond with
the City in order to delay installation of the landscaping for up to four months in order to
plant at a time when the plants will have a better chance of survival. The building has not
received a final Certificate of Occupancy. Final C.O. approval is contingent upon SourceNet
notifying the City that all landscaping has been installed. After notification, the City will
inspect the project for compliance with the landscape plan.

I am following up on the subject of landscaping that was to be done by the owners of the
SourceNet building on Quality Circle which adjoins our backyard. Enclosed are copies of
communications from your offices in 2002 that state that buffer landscaping should be
"a minimum of one 5- gallon shrub at a minimum of 3 feet in height per 3 linear feet ".
Some trees have been planted but an addition of shrubs along the fence (that will grow
taller than the fence) are definitely necessary for more protection of the privacy of my
home and the other three yards that border the rear parking lot.
Recently, by chance I tuned into the College Station planning and zoning meeting in
which the change of R1 zoned property to C1 zoning that adjoins Pebble Creek
subdivision was being discussed. I wasn't too shocked when photos of our back yard
were used by one homeowner to show the ill effects of CIzoning when it adjoins
residential property. We do have the worst possible scenario regarding a developer's
zoning blunder.
Please help us to improve our quality of life and that of our neighborhood by enforcing
the completion of the landscaping requirements laid out in the buffer ordinance.

I have received various amounts of email from each of you over the last few weeks, so
I thought I'd reply to everyone who had emailed me so they had an idea where this project
is at from the City's standpoint. Since the informational meeting the City held with the
neighborhood and the subsequent neighborhood sponsored meeting, I've been waiting to meet
with the developer who has been out of town. The site plan initially submitted was
reviewed and staff comments sent to the developer and his architect. The only permit
issued thus far has been for site development.
City staff met yesterday with the developer to review concerns raised to date. The
developer has proposed certain revisions to the site plan and we're waiting for a revised
site plan to be submitted with those changes. I think the neighborhood will like most of
the changes, however, I do not want to mislead anyone and indicate that everything the
neighborhood would like will be provided. The biggest change will be a approx. 45 foot
setback on the rear, screening shrubs around rear parking, and emphasis on as in -direc
lighting as possible that still achieves security. With those site plan revisions, we
anticipate that we will b� issuing a building permit.
City staff is setting up a meeting for next Weds. March 6th with the neighborhood to
go over the revisionsto the site plan. You will be getting a letter in the next few da s

Mindy,
As I mentioned in my Feb. 28th email on to you and other residents in the
neighborhood, City staff has worked closely with the developer to attempt to make some
changes to the site plan layout that would, hopefully, the neighborhood would view as a
good thing. I mentioned in that email that I believed some of these changes would be
things you would like, but that I did not want to misrepresent that you would like all of
them. Some of the things I thought you would like include the developer creating a 45
food rear setback, putting screening shrubs around his parking lot, and working with us to
develop a lighting plan that is as in- direct as possible while achieving security.
However, the developer has the option to place all their on -site parking on their property
if they choose to (as opposed to a shared parking agreement with UCS across the street).
That is what they've chosen to do, although as I mentioned, the developer has agreed to
screen the entire parking lot with red tip photenia (or some other fast growing
shrubbery). Further, it is my understanding that some of the trees you feel will be
removed may be saved with some islands in the parking lot. Finally, regarding the
delivery drive, this office building is going to be a day time operation, the type of
trucks that would make deliveries would be for mail or food for the employee cafeteria.
The building's delivery dock is not sized for large trucks (18 wheelers).

I am appaulded that after over one month of trying to communicate to the
city and the developer that the UCS /Sourcenet Building is an intrusion and
mistake for our community, the parking lot in question has only increased in
size from - 28 to 56 spaces ? ??
I understand that more trees in the 0.77acre "Protected" will be cut
down for the increased size of the parking lot.Are you aware of this? THere
will be an amplification of sound from the parking lot which borders very
closely on four backyards and will be surrounded by a concrete wall. There
needs to be some more research and communication with the owner of USC
before more trees are destroyed. I feel Our neighborhood is being destroyed
as well.You may have noticed from several letters to the editor of the
Eagle and the many inquiries from citizens there is alot of unrest about
what this is doing to our neighborhood.
Please advise me if anything can be done to prevent this hideous occurance.

PLANNING
1. The buffer area and the protected areas need to be delineated separately and the
protected area calculation should not include the buffer area.
2. Show the path or paths between sections of protected area that will allow access for
the building of the fence and for planting in the buffer area.
3. One of the end islands in the rear parking lot does not appear to meet the 360 sf
double row end island requirement.
4. The sidewalk along the southern portion of the property will need to be continued
when that section of the property develops.
5. A public utility easement is required over the water line to the location of the FDC.

LANDSCAPING - (2 separate sets of requirements need to be met.)
The following brief overview is intended to help clarify how to calculate the landscaping
requirements for this site. Please refer to the Zoning Ordinance and the Covenants and
Restrictions for a complete picture of the requirements.
Once the necessary calculations are done then we can address how the proposed and
existing plantings will meet the requirements and how best to reflect this in the plant list.
Zoning Ordinance
Site (Section 11)
A. Total site area of phase one as shown on site plan less the buffer area divided by
1000 = x 30 points = total site area points.
Streetscaping (Section 11)
B. Total linear feet of frontage of phase one less driveways and visual triangles = LF.
C. LF divided by 32 = # of trees required within 50 ft of ROW.
D. LF divided by 50 = x 300 = additional streetscaping points which usually may be
distributed throughout the site.
E. Total site area points + add'I streetscaping points = total landscaping points

Buffer will need to be installed along full length of property.

1. SourceNet site plan
The Board approves the revised submitted site plan, with final project approval
contingent upon the following conditions:
• Submit lighting plan and specifications for Board approval
• Submit landscape plan and specifications for Board approval. Specifications for
trees and bushes in the buffer areas and around parking near residents must be fast
growing species that grow in excess of 6' in height. Red tip photinias or other tall
species must be installed around the perimeter of the far northeast parking lot.
• Buffer areas may not be included in the calculations for required forest preserve (the
buffer does not count toward forest preserve). Request that Development staff
check the calculation. The forest preserve must be temporarily fenced during
construction. Please depict the 25' buffer area with a different cross hatching than
the forest preserve.

residences

I called the office of code enforcement today as I have had no response from the letter I
sent to Mr. Brymer and Ms. Foutz on May 6, 2005. I understand you are reviewing this
information.
I want you to understand that because Source Net did not do what they had agreed to do
back in 2002, three years of growing time have been lost in which a hedge would now be
taller than the concrete fence. Source Net should be required to compensate for this delay
in compliance with the landscaping requirement by putting in larger plants.
I am also disappointed that the city did not enforce this code sooner.
Please let me know that this error is being corrected as soon as possible.

I am following up on the subject of landscaping that was to be done by the owners of the
SourceNet building on Quality Circle which adjoins our backyard. Enclosed are copies of
communications from your offices in 2002 that state that buffer landscaping should be
"a minimum of one 5- -gallon shrub at a minimum of 3 feet in height per 3 linear feet ".
Some trees have been planted but an addition of shrubs along the fence (that will grow
taller than the fence) are definitely necessary for more protection of the privacy of my
home and the other three yards that border the rear parking lot.
Recently, by chance I tuned into the College Station planning and zoning meeting in
which the change of R1 zoned property to Cl zoning that adjoins Pebble Creek
subdivision was being discussed. I wasn't too shocked when photos of our back yard
were used by one homeowner to show the ill effects of C 1 zoning when it adjoins
residential property. We do have the worst possible scenario regarding a developer's
zoning blunder.
Please help us to improve our quality of life and that of our neighborhood by enforcing
the completion of the landscaping requirements laid out in the buffer ordinance.

Subject: SourceNet Update
I have received various amounts of email from each of you over the last few weeks, so
I thought I'd reply to everyone who had emailed me so they had an idea where this project
is at from the City's standpoint. Since the informational meeting the City held with the
neighborhood and the subsequent neighborhood sponsored meeting, I've been waiting to meet
with the developer who has been out of town. The site plan initially submitted was
reviewed and staff comments sent to the developer and his architect. The only permit
issued thus far has been for site development.
City staff met yesterday with the developer to review concerns raised to date. The
developer has proposed certain revisions to the site plan and we're waiting for a revised
site plan to be submitted with those changes. I think the neighborhood will like most of
the changes, however, I do not want to mislead anyone and indicate that everything the
neighborhood would like will be provided. The biggest change will be a approx. 45 foot
setback on the rear, screening shrubs around rear parking, and emphasis on as in- direct
lighting as possible that still achieves security. With those site plan revisions, we
anticipate that we will be issuing a building permit.
City staff is setting up a meeting for next Weds. March 6th with the neighborhood to
go over the revisionsto the site plan. You will be getting a letter in the next few days
advising of the meeting. Again, while we may not achieved everything everyone wanted, I
think we have a project that will be very compatible with adjacent property. Finally, I
did try to call Pebblecreek HOA President Dale Christian today. He was out and I left a
voice mail message for him to call me.

As I mentioned in my Feb. 28th email on to you and other residents in the
neighborhood, City staff has worked closely with the developer to attempt to make some
changes to the site plan layout that would, hopefully, the neighborhood would view as a
good thing. I mentioned in that email that I believed some of these changes would be
things you would like, but that I did not want to misrepresent that you would like all of
them. Some of the things I thought you would like include the developer creating a 45
food rear setback, putting screening shrubs around his parking lot, and working with us to
develop a lighting plan that is as in- direct as possible while achieving security.
However, the developer has the option to place all their on -site parking on their property
if they choose to (as opposed to a shared parking agreement with UCS across the street)
That is what they've chosen to do, although as I mentioned, the developer has agreed to
screen the entire parking lot with red tip photenia (or some other fast growing
shrubbery). Further, it is my understanding that some of the trees you feel will be
removed may be saved with some islands in the parking lot. Finally, regarding the
delivery drive, this office building is going to be a day time operation, the type of
trucks that would make deliveries would be for mail or food for the employee cafeteria.
The building's delivery dock is not sized for large trucks (18 wheelers).

I am appaulded that after over one month of trying to communicate to the
city and the developer that the UCS /Sourcenet Building is an intrusion and
mistake for our community, the parking lot in question has only increased in
size from - 28 to 56 spaces ? ??
I understand that more trees inthe 0.77acre "Protected "'area will be cut
down for the increased size of the parking lot.Are you aware of this? THere
will be an amplification of sound from the parking lot which borders very
closely on four backyards and will be surrounded by a concrete wall. There
needs to be some more research and communication with the owner of USC
before more trees are destroyed. I feel Our neighborhood is being destroyed
as well.You may have noticed from several letters to the editor of the
Eagle and the many inquiries from citizens there is alot of unrest about
what this is doing to our neighborhood.
Please advise me if anything can be done to prevent this hideous occurance.
