Regarding the waiver request, explain how:
1. There are special circumstances or conditions affecting the land involved such that strict application of the
subdivision regulations will deprive the applicant of the reasonable use of his land.
2. The waiver is necessary for the preservation and enjoyment of a substantial property right of the applicant.
3. The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other
property in the area, or to the City in administering subdivision regulations.
4. The granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in
accordance with the provisions of the Unified Development Ordinance.
Fee in lieu of sidewalk construction is being requested because of the following condition (if applicable):
1. (If~ alternative pedestrian way or multi-use path has been or will be provided outside the right-of-way;
2. r The presence of unique or unusual topographic, vegetative, or other natural conditions exist so that strict
adherence to the sidewalk requirements of the UDO is not physically feasible or is not in keeping with the
purposes and goals of the UDO or the City's comprehensive Plan;
3. r A capital improvement project is imminent that will include construction of the required sidewalk. Imminent shall
mean the project is funded or projected to commence within twelve (12) months;
4. r Existing streets constructed to rural section that are not identified on the Thoroughfare Plan with an estate I
rural context;
5. r When a sidewalk is required along a street where a multi-use path is shown on the Bicycle, Pedestrian, and
Greenways Master Plan;

6. I The proposed development is within an older residential subdivision meeting the criteria in Platting and
Replatting within Older Residential Subdivisions Section of the UDO; or
7. I The proposed development contains frontage on a Freeway I Expressway as designated by Map 6.6,
Thoroughfare Plan -Functional Classification, in the City's Comprehensive Plan.

I received the comments for DMR Acres preliminary plat. I have attached a marked pdf file to address some of
the comments at addressed below.
Planning
.fl. We will add 10' to the ROW dedication and adjust the lot boundary for Lot 2 accordingly to make sure of the
1+ acre size
/2. Please see the notes on the original plat addressing the pipeline easements as indicated on the attached pdf
file -there are no defined easements crossing this tract and no active pipelines on the tract

1. The owner plans to use a shared driveway between Lot 1 and Lot 2 -we will create a "private shared access
easements" to cover this
2. We will show the nearest location of the city limits on the vicinity map with the submittal of revisions

1. Brazos County Subdivision regulations require a 20' easement centered on all interior lot lines and the
boundary of the subdivision. Unless the County will agree to a 10' easement then the 20' will need to
remain.

As long as this property remains in the County, there would not be a requirement for further platting in the future on
the larger tract. If it was annexed, different plat laws would govern such that further platting would be necessary.
I have reviewed the subdivision based on information provided and with the assumption that future platting is not
needed. I can't review it based on "intent" as "intent" may always change. I believe the drainage easements need to be
addressed and I stand by the original comments.

Once I receive initial comments from the City of College Station I will address your comments on the preliminary
plat along with those from the City, but meanwhile I have one question. Since the larger lot {the remainder tract) is not
being developed at this time we hesitate to define specific private drainage easements.
Would it be sufficient to make a notation on the plat something to the effect of "There shall be a 40' private
drainage easement centered on all existing natural drainage flows." The owner has indicated that sometime in the
future they may decide to further divide this area and the drainage issues would be dealt with by an engineer at that
time. This would alleviate the need for having to abandon easements on future replats. Please let me know your
thoughts on this. Thanks!

Our Mr. Will Dierksen, P.E. witnessed a fire hydrant flow test conducted by Wel lborn
Special Utility District personnel, Clendon Adams and Jonathan Provazek. The results of
the testing are shown in the attached report prepared in accordance with NFPA 291.

Dear Stephen:
The current KYPipe model for the Wellborn SUD Main System was used to perform a water
service analysis for a new service for Jeremy Boyd to be located on a one acre tract near the
corner of N Dowling Rd. and Rock Prairie Rd. W, in the extraterritorial jurisdiction of College
Station, Texas.
Our analysis indicates that service is available to this location and that the Wellborn SUD
system is capable of providing the minimum fire flow requirements for the City of College
Station. The City's fire flow requirement for residential service is to provide 1,000 gpm from
a fire hydrant at a minimum operating pressure of 20 psi while supplying the peak demand
of 0.76 gpm per connection to the system.
Mr. Boyd will need to be sure that the structure(s) to be constructed on the property are
within 500' of a fire hydrant. The existing fire hydrants in that area may be used, or a new
hydrant may need to be installed on one of the water lines in that area. Depending on the
orientation of the property and location of the structures, it appears that the property can be
served from existing 8", 12", or 18" lines in that area.
