1. The following specific adjustment (up to 10%) from the ordinance requirements is requested :
We are requesting a 2. 5 foot encroachment into the front 25FT setback for the construction of a car canopy.
2. This adjustment will not be contrary to the public interest by virtue of the following facts:
Building setbacks are intended to protect areas of green space and increase aesthetic views from streets. With the
heavy vegetation that we have kept on our site the view will not be obstructed due to the addition of a canopy.
3. The granting of the adjustment will not materially or adversely affect adjacent land uses or the physical
character of the uses in the immediate vicinity because of the following:
Concrete paving for parking is allowed to encroach into the front 25FT setback, which is what we have done on our
site plan. All we are asking for is to provide cover parking for the stalls that are already in place.
4. The granting of the adjustment will be consistent with the purpose and intent of the Unified Development Ordinance
because of the following:
Building setbacks are intended to protect areas of green space and increase aesthetic views from streets. Some
districts now have setbacks at 15FT, and others with less to promote the view from the street. With the heavy
vegetation that we have kept on our site the view will not be obstructed due to the addition of a canopy. We will
not be removing any additional vegetation than what has already been removed for the construction of the parking
spaces.

correct, and complete.

RE: Property located at 3202 Earl Rudder Freeway South
Dear Veronica:
This letter is to inform you that the above referenced property has received an administrative
adjustment of 2.5 feet (10% adjustment) to reduce the 25-foot front building setback for the
construction of a carport as required by the Unified Development Ordinance, Section 12-5.4, Non-
Residential Dimensional Standards, for properties zoned 0 Office.
According to the Unified Development Ordinance Section 12-3.17, the Administrator has the authority
to authorize adjustment of up to ten percent (10%) from any numerical zoning standard set forth in
the Unified Development Ordinance. To approve the application for an administrative adjustment, the
Administrator shall make an affirmative finding that specific criteria, as outlined in Section 12-3.17.E
of the Unified Development Ordinance, have been met.
The Administrator has found that:
Granting the adjustment will ensure the same general level of land use compatibility as the
otherwise applicable standards because the reduction of the front building setback does not
significantly alter the intensity of the land use;
Granting the adjustment will not materially or adversely affect adjacent land uses or the physical
character of uses in the immediate vicinity of the proposed development because the front
building setback reduction does not significantly alter the character of the structure or its density;
and
Granting the adjustment will be generally consistent with the purposes and intent of this UDO
owing to the scale of the reduction.
