provided, however, that this conveyance shall grant the rights herein specified only as to that
portion of the above-described property more particularly described on the attached Exhibit "A",
known as the "easement area," as necessary to install and attach equipment, guy wires, and
anchors necessary and incident to the uses of the easement areas to erect, construct, install, and
thereafter use, operate, inspect, repair, maintain, reconstruct, modify and remove the following:
Electric service lines;
Water service lines;
Wastewater service lines;
A residential driveway serving no more than one single family residence.
upon, over, and across the said PROPERTY as described and any ways, streets, roads, or alleys
abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the
easement area, which might interfere with or threaten the operation and maintenance of any utility
services or driveways.

104, Page 3, Deed Records, Brazos County, Texas, and said 1,440-sq. ft. tract being more particularly
described as follows:
Commencing at the easternmost corner of Lot 41, of the above referenced First Subdivision of College
Hills Woodlands, said corner also marking the northernmost corner of Lot 40, of said subdivision, and
furthermore said corner also being the southernmost corner of that portion of Woodland Parkway right of
way released and closed by deed recorded in Volume 920, Page 214, Official Records, Brazos County,

1. This plat can only be considered a "minor plat" if you change the heavy
subdivision boundary to include only the residential lots. If you decide to do
this, also remove all general notes regarding the conservation strip and
change the acreage included in the title block.
2. A volume and page number for the 20' access easement will need to be
added to this plat before it is filed for record.

Subject: Re: Parkway Park
How do you propose to make this effective? A note on the plat? File some document with the effect of a
deed restriction? Have you discussed Jim Baker's "quit claim" with Harvey? Baker's expectation is that
he will pay for the replat but that we will pay for anything related to the park property.

Here is suggested language for the "conservation area":
This site shall be maintained as as natural area for use by the citizens of Coillege Station. No
roads, drives, play equipment, picnic tables, barbeque pits, structures or buildings of any kind
shall be permitted on the site.
This is very similar to the deed restriction wording for Brison Park.

Dear Mr. Baker,
I appreciate your taking the time to meet with Steve, Jim and I to discuss the issues associated with your
property on Ashburn. Most importantly, I appreciate your desire to cooperate and find a solution to this
matter that meets your goals as well as the City's. The following three points represent what we all
agreed could serve as the basis for settlement of the issues:
1. We will work with you to replat the property into the three lots we discussed during our meeting
including the potential to provide access to Lot 40 via the abandoned right-of-way to Marstellar. We will
also have to deal with any setback issues on the new triangular lot on Ashburn/Woodland to
accommodate the potential for the construction of a house on the lot. Jim Callaway will work with you
and/or your engineer on the issues associated with the replat.
2. You will agree to dedicate whatever interest you have in the park/disputed area to the City to be used
as a park with the understanding that it will remain a natural area through establishment of a
conservation easement or other appropriate mechanism. Steve Beachy will work on the necessary
documents to accomplish this part of the agreement.
Jim, once again, I thank you for being willing to work to a viable solution to this matter. You can expect
to hear from Jim and Steve as they move forward with this project.
