Development Engin Bring RE: Gateway Phase 1 Water and Sewer On the afternoon of Tuesday, September 14, 1999, Natalie Ruiz and I met with North Bardell, P.E. and Greg Taggart in their office to discuss construction plan requirements for the above listed project. This meeting was in response to a letter dated September 3, 1999 from Jane Kee and myself regarding tree preservation requirements and fire flow demands. The meeting started with Mr. Taggart objecting to using a portion of the parking requirements of the Zoning Ordinance with regard to water line location. Ms. Ruiz stated that per the city's Zoning Ordinance, III trees 4" and greater in diameter must be preserved within the 24-foot landscape reserve. Mr. Mihalopoulos was inforrned in writing by Jim Callaway on July 20, 1999 (See attached letter). Mr. Taggart continued to disagree with this requirement. He stated that he spoke with Ross Albrecht who stated that it would be better to plant new trees. We repeated that the Zoning Ordinance required that the existing trees must be saved and further discussions regarding this issue would need to be with Jane Kee, the City Planner in charge of zoning. We also discussed the issue regarding fire flows. Mr. Taggart stated that he was not sure what type of development was going to occur in the back portion the property. We stated that if we did not know what type of development could occur, that the lines should be sized for the maximum potential development expected for the area based on current zoning. Mr. Taggart stated that they sized the line for "reasonable" development. I re-iterated the need for Mr. Taggart to get the fire flow rates approved by Jon Mies, Fire Marshal. I also stated that if the fire flow analysis showed that a 12" waterline was not needed by this development under University Drive and to the loop system in the development, that I would forward an over-sized participation request for City Council for consideration upon request. Mr. Bardell indicated that the owner requested that the sewer and water plans be approved separately. He did not think it was appropriate, nor would the city approve separated plans. I stated that it was unusual, but we would consider it. There would have to be special notation regarding additional requirements that may be necessary regarding utility conflicts that may result. One major factor was the preservation of existing trees, especially within the first 50' of the University Drive frontage. Since that time, the property was cleared by heavy equipment in direct violation of the Development Permit. Staff chose not to pursue legal action; instead, the remaining trees will only be allowed `~rnproteded tree" points as defined in the City's Zoning Ordinance. After reviewing the tree survey and discussing this issue with the City's Forestry Superintendent, staff has developed the following option for developing the properties along the University Drive frontage: Section 9.2.A.5 requires that there be a 24' landscape reserve setback from the right-of- way. Existing trees of 4 inch caliper or greater must be preserved. Because of previous clearing in this area, these trees will not be allowed protected tree point credit, although they may count toward the street tree requirements under the streetscape requirements. The variation would be related to the classification of the structure under the zonung ordinance, which specifies the parking requirements, which vary from one space per 200 SF. to one space per 250 S.F.. Our water line design for this tract meets the legal requirement of domestic water service and we have calculated pip sizes to satisfy any two adjacent hydrants at 1250 g.p.m. each. If a germit is sought for such a structure on this lot, the design provided fora 12''/8'' line as depicted on the approved preliminary plat, will need to be constructed on the west and north sides of the lotto provide a loop.
