Staff reviewed the above-mentioned final plat as requested. The following is a list of items
that need to be addressed:

road is unnamed.
Provide paid tax certificates from City of College Station, Brazos County, and
College Station ISD for the Paquet/Valdez property
Please address the above-mentioned items and submit the following information by Monday,
May 24, 1999 to be placed on the next available Planning & Zoning Commission meeting.
Ten (10) copies of the revised final plat; and
One (1) Mylar original of the revised final plat. (We understand that you will
have to send the mylar out of state for signatures. Once you receive the signed
mylar, please submit to be filed.)
The next available Planning and Zoning Commission meeting is scheduled for Thursday, June

Variance Request for Sinquefield
HISTORY OF THIS REQUEST
This plat was approved at your last p&Z commission meeting. At that time a variance
was requested to the standard etj roadway section which was denied by the p&z. The
applicant has asked if he could bring the variance request back before the Commission as
they were unable to attend the last meeting. They did have their engineer present at the
meeting but he did not speak on their behalf and they would like to do so this evening.
Before we discuss this particular item, I would like to begin by:
First giving the Commission a brief overview of the City of College Stations etj
regulations as well as the counties subdivision regulations.
And Secondly by giving the commission some history on previous variance requests of
this nature.
SUBDIVISION REGULATIONS
CITY
ETJ
Streets: 6" gravel or crushed limestone base and 2 course seal coat
24' width with 10' shoulder on each side within a 70' row
legally we cannot require any offsite improvements unless it can be shown that the
subdivision was of such intense nature that it would warrant those improvements
COUNTY
Streets: similar to our etj standards
In discussions with the County they apply this regulation in the following manner:
In a subdivision all lots must have access.... It can be called anything (private access,
public access, etc.)
1. If it is a new subdivision dedicating a new access within the etj: must meet all stds
2. If it is a replat of an existing subdivision and the access was previously dedicated and
met the requirements when originally platted they consider it grandfathered.
3. If the access is to 3 or fewer lots and to 3 or fewer residences then it may be a shared
access driveway (this has no standard width or cross section)
4. The county also differentiates between within the etj and outside the etj. Outside our
etj the county also considers the roadway surface that the new access will join. They
typically do not require the access to be paved to a standard higher than the adjoining
roadway surface.
HISTORY OF PREVIOUS REQUESTS
The following map shows the Co mission some similar requests that have been received

1. Carter Lake Estates -variance to row/pavement stds. - 2 existing streets (one street
was private the other public)- access to asphalt street (rpr) - P&Z denied/Council
approved
2. Willow Run -row/pavement stds. -new streets -access to gravel road (capstone)-
P&Z denied/applicant complied
3. Timber Forest Estates -row/pavement stds. -existing streets -access to asphalt
street - P&Z denied/applicant withdrew
4. Lincoln Place -property owners asked city to assume maintenance of private alleys
not constructed to public stds. -Council did not approve
CURRENT REQUEST
*not pave the access across the subject tract
*doesn't include the first tract (outside the plat -legally we cannot require that)
*parent tract -some is not their property or that they have previously subdivided
Given that the frontage is only a small part
Leave a piece unimproved between property and peach creek
Current access was previously legally platted and met stds at the time it was done
County recognizes such a subdivision as having a grandfathered status
Staff would recommend approval of the variance.

SECTION 13: SPECIAL CONDITIONS IN AREA OF
EXTRATERRITORIAL JURISDICTION
13-A General
The requirements of this chapter shall apply to subdivisions in the area of extraterritorial
jurisdiction, with the following modifications:
13-B Streets
Streets shall be in conformity with the requirements of Section 8-G, except that the urban-
rural section, as defined in the City engineering standards may be used. This section does
not require curb and gutter, but requires all-weather, gravel or crushed stone base, road
surface with not less than a two (2) course inverted penetration asphalt surface, and shall be
not less than twenty-four feet (24~ in width, with a ten foot (10~ shoulder on each side. If this
section is used, the minimum right-of-way width shall be seventy feet (70~, and if a major
street, as shown on the master plan of streets, crosses or forms a boundary of the
subdivision, the right-of-way width shall be as required in the street section.
13-C Lot Width
If the subdivider constructs streets under the urban rural section, as authorized in 12-B.
above, the minimum lot width shall be one hundred feet (100.
13-D Water Supply
Fire hydrants are not required. The water supply system shall comply with the requirements
of the Texas State Department of Health.
~ 13-E Sanitary Sewers
The sanitary sewer system shall comply with requirements of the Texas State Department of
Health.
13-F Drainage
Drainage may be by surface channels.
13-G Street Lights
Street lights are not required.
13-H Electric Service
Electric service will not be supplied by the City.
13-I City Participation
The City will not participate in the cost of the subdivision or utilities outside the City limits,
including garbage collection and street maintenance.
