SUBJECT: Lone Star Pavilion Shopping Center
Late in November Jeff Eubanks of A.I.G.Baker Shopping Centers contacted me
to see if they could put a 30,000 +/- sq. ft. anchor store in the vacant pad on the
Lincoln Street side of their shopping center. I checked the site plan approved,
and the limit of square footage they could add was somewhat less than that.
During the conversation the parking numbers he quoted as having did not match
the site plan which had been approved for the shopping center, so I asked him to
send me a copy of whatever it was that he was using.
He did, and after comparing his to the approved plan, I determined he was
counting the parking in the area just to the north of Red Lobster in his figures,
and on the approved plan Red Lobster and that part of the parking lot were
excluded. He explained that his company has a cross parking agreement with
Red Lobster to allow that restaurant to use the parking in the shopping center,
including that area which his company has purchased (after site plan approval).
I then suggested that he include the square footage of the Red Lobster building
in the total square footage for the shopping center, and submit a revised site
plan which shows that. He did, and based on the square footages he has
furnished today, it appears that the parking provided can meet the requirements
of a 30,050 square foot addition to the center, and still have excess parking
spaces.
Therefore, all he has to do is submit building plans to the Building staff for
review and approval for a building permit

^~. I recieved your fax and original letter re: the above referenced site. I have reviewed the following:
1. your fax dated June 9,1999 re: ramps and water/sewer demands
2. drainage report
3. 24"x36" civil site drawings labeled sheets c-1 through c-5
4. 8-1/2" letter size fax from WLB to Judy Smith re: revision of handicap ramps
The City comments are as follows:
1. In response to your June 9th letter.
a. I am assuming that your 60 gpm water demand is a maximum demand. If so, our water meter
sizing (which is done by the city based on your submitted demands) would size a 1-1/2" meter for this
building. So you will need to change your site civil drawing to show the 1-1/2" size and not the 2" water
meter.
/ b. Yes, we will require that the handicap spaces are 9' regardless of the state criteria so please
modify your site civils accordingly.
c.please fax on your letterhead a simple water and sewer demand legend or table (as opposed to a
y full letter) which states type of the demand and max demand which we will staple to the approved site
plan.
2.the drainage report is approved as submitted. you sent us two copies so both will be stamped approved
and one returned to you for your records.
3.the original site plan that we reviewed was done by the architect on this project. it appears that you
submitted the civil site plan in order to answer several of our technical site related questions. this is fine
however we can only have one official approved site plan. we have had problems on past projects with
the architect and engineers each having a site plan which are approved and they do not match. for this
reason we will ask that the architect site plan sheet be removed from the documents as we will not
approve that plan and will disregard the sheet. your sheet o-3 will constitute the official approved site
plan with c-4 as a supplement. please inform the architect of this.
4. state that the exist parking lot pavement near lincoln that will be removed will be replaced with grass
cover.
5.we request that if you will use bollards on the lincoln side of the building at the exit door that they
match the bollards used in the front. we do have streetscape requirements which looks at accessory
items and assure that they blend with the building or are aesthetically pleasing if they can be viewed
from the street.
6. once all above comments have been addressed please submit 7 copies of your sheets o-1 through c-5
for us to approve.

Dear Mr. Baker:
During your development of the Lone Star Pavilion on BS6-R (Texas Avenue) in College
Station, Texas, we were made aware of your plans to encroach into state highway right-
of-way with parking. At that time, I made Mr. Rich Wingo, of your office, aware by letter
dated May 9, 1997, that all improvements would be removed should the State determine
it owns the land.
This letter is to advise you that the State of Texas claims ownership to the land in
question. Under the policies of the Texas Department of Transportation we offer the
following options to you:
• Option 1 -Remove all encroachments and restore the right-of--way to a
condition similar to an urban roadway.
• Option 2 -Lease, at fair market value, the portion of right of way that has the
encroachment. The lease option requires you to pay for all cost associated
with the leasing.
Please advise me of your choice in these two options.

RE: Lone Star Pavilion Final Plat
1. We are locating utility easements for inclusion on the final plat of Lone Star Pavilion. We
have shown the easements that Tony Michalski identified for electrical service and have
provided the easements that Lone Star Gas requested and identified.
2. We have provided easements for water lines to include the meter vaults and the valves serving
the fire protection lines.
3. In June of this year on the Kona Restaurant site we did not extend fire protection water line
easements beyond the controlling valve because the City did not want to accept maintenance
responsibility for the lines beyond that point.
4. If the policy has changed, please let us know so that we can add these easements before we
submit the plat.

I met w/ S.A.F.E. onsite to look at plans to relocate the existing 6" waterline that is not shown in an
easement on the original plat or the re-plat. They have a fire sprinkler system going in and want to install
45 & 90 degree bends and approx. 75 I.f. of new line to get the line out from under the proposed
dumpster and into the mech room.

Lone Star Gas has the following comments regarding new development for the week
of 3-29-99:
Lone Star Pavillion final plat - As discussed with the developer, Charles
Shears, at the time of construction, we need a PUE shown on the plat which
covers our gas main. I have the as built drawings of this line. If MDG needs
this information they can contact me.
Barker's Heating and Cooling - We request that the gas lines and meter shown on
the site plan. Also, to properly size the gas meter, I need an equipment list
with the max. demand for each piece of equipment for both buildings and the
outlet pressure of gas required from the meter. This information can be
provided directly to me, it does not have to be shown on the site plan.

Developer installs electrical conduit and streetlighting per our design and specs.
Developer pays 20°k of the cost of electrical service.
