Item: Public hearing and consideration of a Rezoning for a 7.223 acre tract out
of the Morgan Rector League, located at the southwest corner of the intersection
of Southwest Parkway and Earl Rudder Freeway. (00-202)
Applicant: Parvis Vessali
Staff Recommendations: Staff recommends approval of the rezoning.
Item Summary/Comprehensive Plan Considerations: The applicant is
requesting this zoning change to enable the building of a hotel and retail center,
which may include a convenience store. Adjacent properties are not yet
developed.
The Land Use Plan shows the subject property as Retail Regional, the property
to the west as future Office and the property to the south as Mixed Use. This
proposed zoning change is in compliance with the Land Use Plan and all of the
Development Policies of the City set forth in the Comprehensive Plan.
Item Background: This property was annexed in 1971. And at that time, R-1
was the holding zone that all newly annexed property was brought into the City
under. This property will still need to go through the platting and site planning
processes.
Commission Action Options: The Commission acts as a recommending body
on the question of rezoning, which will be ultimately decided by City Council.
The Commission options are:
1. Recommend approval of rezoning as submitted;
2. Recommend approval with physical conditions that will mitigate negative
impacts;
3. Recommend a less intense zoning classification;
4. Recommend denial;
5. Table indefinitely; or,
6. Defer action to a specified date.

INFRASTRUCTURE AND FACILITIES
Water: This property has adequate service for the potential
development. There is a 12-inch water line across Southwest Parkway
and a 12-inch line along the frontage road.
Sewer: This property has adequate service for the potential
development. There is an 8-inch sewer line adjacent to the southwest
corner of the property.
Streets: This property has more than adequate access with frontage on
the Earl Rudder Freeway frontage road and Southwest Parkway which is
a minor arterial.
Off-site Easements: None anticipated at this time. Will be addressed at
the time of platting and site planning.
Drainage: Will be addressed at the time of platting and site planning.
This property is not in the floodplain.

1. Metes And Bounds Description has a Save and Except parcel of 0.952 acres.
This needs to be shown on the plat graphically and a meets and bounds
description provided for this 0.952 acre parcel.
