AN ORDINANCE AMENDING CHAPTER 12, "ZONING", SECTION I, "ESTABLISHMENT
OF DISTRICTS, PROVISION FOR AN OFFICIAL ZONING MAP", OF THE CODE OF
ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE
ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES AS
DESCRIBED BELOW; DECLARING A PENALTY, AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That Chapter 12, "Zoning", Section I, "Establishment of Districts, Provisions For An
Official Zoning Map", of the Code of Ordinances of the City of College Station,
Texas, be amended as set out in Exhibits "A", "B", "C", and "D" attached hereto and
made a part of this ordinance for all purposes.
PART 2: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000.00). Each day such violation shall continue or be permitted
to continue, shall be deemed a separate offense. Said Ordinance, being a penal
ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.
PASSED, ADOPTED and APPROVED this 11th day of January 2001.

That the Official Zoning Map of the City of College Station, Section I, "Establishment of
Districts, Provisions For An Official Zoning Map", of Chapter 12, "Zoning", is hereby amended as
follows:
The following property is rezoned from A-O Agricultural-Open to PDD-H Planned
Development District-Housing.
6.63 acres being all that certain tract or parcel of land lying and being situated in the
Maria Kegans League, Abstract No. 28, College Station, Brazos County, Texas. Said
tract being a portion of Block 4, Harvey Hillsides, according to an unsigned master
plat of Harvey Hillsides recorded in Volume 264, Page 484 of the Deed Records of
Brazos County, Texas, and being the same tract of land called 6.63 acres as described
by a deed to the Estates of W.M. Sparks recorded in Volume 376, Page 244 of the Deed
Records of Brazos County, Texas and being more particularly described in the attached
Exhibits "B "D', and shown graphically in Exhibit "C
Purpose: This district contains land which is to be used for a unique type of dwelling
which is designed for individual ownership or ownership in group of single
family attached residences constructed on individually platted lots.
R-3 Zoning District requirements shall be applicable except as specifically
modified in the attached Concept Plans, Exhibit D.

Metes and bounds description of all that certain tract or parcel of land lying and being situated in the Maria Kegans League,
Abstract No. 28, College Station, Brazos County, Texas. Said tract being a portion of Block 4, Harvey Hillsides, according to
an unsigned master plat of Harvey Hillsides recorded in Volume 264, Page 484 of the Deed Records of Brazos County, Texas,
and being the same tract of land called 6.63 acres as described by a deed to the Estates of W. M. Sparks recorded in Volume
376, Page 244 of the Deed Records of Brazos County, Texas.
Said tract being more particularly described by metes and bounds as follows:
BEGINNING at a 1/2 inch iron rod found on the southeast line of State Highway No. 30 marking the west corner of said 6.63
acre tract, said iron rod found being on the northeast right-of-way line of Linda Lane (50' R. O. W.);
THENCE: N 45° 03'43" E along the southeast line of State Highway No. 30 for a distance of 568.29 feet to a 1/2 inch iron rod
found marking the north corner of said 6.63 acre tract and the west corner of a called 3.18 acre tract described as first tract,
Exhibit "A", by a partition deed to Gardner Parker recorded in Volume 1245, Page 758 of the Official Public Records of
Brazos County, Texas, (this line was used for bearing orientation honoring the deed call bearing of said 6.63 acre tract);
THENCE: S 44° 56' 17" E along the common line of said 6.63 acre tract and said 3.18 acre tract, at 478.96 feet pass a 5/8 inch
iron rod set for reference, continue on for a total distance of 498.96 feet to a point in a creek, said point being on the northwest
line of Lot 16, Block 2, Harvey Hillsides, according to the plat of Block 2 recorded in Volume 263, Page 487 of the Deed
Records of Brazos County, Texas;
THENCE: S 43° 13' 00" W along the common line of said 6.63 acre tract and Block 2 for a distance of 568.60 feet to a point on
the northeast line of Linda Lane marking the common corner of said 6.63 acre tract and Lot 18, Block 2;
THENCE: N 44° 56' 09" W along the northeast line of Linda Lane, at 20.00 feet pass a 5/8 inch iron rod set for reference,
continue on for a total distance of 517.27 feet to the POINT OF BEGINNING containing 6.63 acres of land as surveyed on the
ground August, 2000. For more descriptive information see plat prepared August, 2000.

AN ORDINANCE REZONING TWO (2) TRACTS OF LAND LYING AND BEING
SITUATED IN THE RICHARD CARTER SURVEY, ABSTRACT NO. 8, COLLEGE
STATION, BRAZOS COUNTY, TEXAS, AND BEING MORE PARTICULARLY
DESCRIBED IN THE BODY OF THIS ORDINANCE FROM R-1 SINGLE FAMILY
RESIDENTIAL TO A-0 AGRICULTURAL OPEN AND C-2 COMMERCIAL
INDUSTRIAL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
WHEREAS, the City Council held a public hearing in the City Hall
at 7:00 P.M. on Thursday, November 9, 1989, on the question of
rezoning certain areas within the City Limits;
AND, WHEREAS, the City Council has determined the following:
To rezone or change the classificeiion of the following two (2)
tracts of land:
Tract No. 1:
A 20.43 acre tract or parcel of land, lying and being situated in
the Richard Carter Survey, Abstract No. 8, College Station,
Brazos County, Texas, and being part of the 34.13 acre tract
described in the Partial Release of Lien executed by Bert
Wheeler, Inc. to Davis & Scarmardo Construction Co., Inc., as
recorded in Volume 1082, Page 337, of the Official Records of
Brazos County, Texas, and said 20.43 acre tract being more
particularly described as follows:
COMMENCING at the 1/2" iron rod marking the west corner the
beforementioned 34.13 acre tract, same being in the northeast or
east right-of-way line of State Highway No. 6, East By-pass;
THENCE N 76°11'24" E along the northwest or north line of the
beforementioned 34.13 acre tract, for a distance of 610.00 feet
to a 1/2" iron rod marking an angle point corner of the 34.13
acre tract at the PLACE OF BEGINNING of this description;
THENCE N 51'27'25" E along the northwest line of the
beforementioned 34.13 acre tract, for a distance of 535.69 feet
to a 1/2" iron rod marking the north corner of the 34.13 acre
tract;
THENCE S 39030'06" E along the northeast line of the
beforementioned 34.13 acre tract, for a distance of 1500.00 feet

THENCE through the interior of the beforementioned 34.13 acre
tract as follows:
N 36'16'43" W 60.00 feet to a 1/2" iron rod set,
N 32'02'48" W 263.49 feet to a 1/2" iron rod set,
N 76°11'24" E 20.00 feet to a 1/2" iron rod set,
N 30022'14" W 278.51 feet to a 1/2" iron rod set, from which
the south corner of an existing bridge bears N 30'41" W 20.00
feet,
N 59°20'00" E parallel with and 20 feet southeast of the
southeast edge of the existing bridge, for a distance of
88.00 feet to a 1/2" iron rod set, from which the east corner
of said bridge bears N 30'13' W 20.00 feet,
N 29'50'01" E for a distance of 135.96 feet to the PLACE OF
BEGINNING, containing 20.43 acres of land, more or less, from
R-1 Single Family Residential to A-0 Agricultural Open.
Tract No. 2:
A 7.80 acre tract or parcel of land, lying and being situated in
the Richard Carter Survey, Abstract No. 8, College Station,
Brazos County, Texas, and being part of the 34.13 acre tract
described in the Partial Release of Lien executed by Bert
Wheeler, Inc. to Davis & Scarmardo Construction Co., Inc., as
recorded in Volume 1082, Page 337, of the Official Records of

westerly south line of the 34.13 acre tract;
THENCE S 76011124" W along the most westerly south line of the
beforementioned 34.13 acre tract, for a distance of 524.37 feet

34.13 acre tract, same being in the northeast right-of-way line
the beforementioned East By-pass;
THENCE along the northeast and east right-of-way line of the
beforementioned East By-pass as follows:
N 36°16'43" W 60.00 feet to a 1/2" iron rod,
N 18'13'02" W for a distance of 643.02 feet to the PLACE OF
BEGINNING, containing 7.80 acres of land, more or less, from
R-1 Single Family Residential to C--2 Commercial Industrial.
And, it is ordained that said changes shall become effective
immediately.
