A conditional use permit was granted to the property by the Planning and Zoning Commission on October 21, 1999 to erect a 100-ft. wireless telecommunication facility. On December 7, 2000, the Commission granted a conditional use permit for the tower to be heightened to 150 feet for co- location purposes. On the subject property, a second, taller tower was built but the original has not been removed. The Planning and Zoning Commission has never granted the property the ability to have two WTF's. The Zoning Ordinance defines a conditional use as one "which may he permitted or denied in a district, on a case-hy-case basis, subject to meeting certain conditions or procedures set forth in, or imposed under, the Zoning Ordinance." Because a conditional use permit has only been granted for the use of one tower, the site is in violation of Section 8.20 of the College Station Zoning Ordinance. Section 8.20.C. I states "...Major WTF's are allowed in the following zoning districts with a Conditional U.se Permit as discussed in Section D-3: A-0...... At the July 19, 2001 Planning and Zoning Commission meeting you attended, Chairman Karl Mooney explained that the Boriskie Partnership was not granted a conditional use permit for two towers. On August 2, 2001 I discussed the violation with Ms. Headrick of the EDC. She assured me that the second tower would be removed by August 10, 2001. I informed her that the City would move into enforcement on this issue if it was not down before Augsut 13. As of today, the tower has not been removed. This correspondence is to serve you notice of the potential penalties. Failure to remove one of the towers within ten (10) business days of receipt of this notification, shall constitute a violation of Section 8.20 of the Zoning Ordinance. A citation will be issued and can result in fines of up to $2,000 dollars per day per violation. Each day can be a separate violation. Thank you for your cooperation in this matter. Two equipment shelter, 10' x 20' and 10' x 12' are to be located within the tower site. At present, Sprint PCS personnel visit the tower site once a month. With tKe additional services providers going on the tower, it is expected that each of the providers will visiit the tower site once a month. Per prel'ious telephone conversations with your department, we were advised that it world not be necessary to identify collocation alternatives or other existing applicant-owned wireless telecominxunications facilities. Phase 30 SCOPE OF SERVICES The purpose of our services was to perform a general characterization of environmental concerns based on readily available information and site observations. It is our understanding that the subject property is involved in a potential lease transaction between the owner and SprintCom. It is also our understanding that a geotechnical investigation is being conducted by the geotechnical group of LAW. The following services were provided for the assessment: • A qualitative hydrogeologic evaluation of the site and vicinity using both published topographic and geologic maps and area observations to characterize the area drainage. • A review of selected available documents, maps, historical aerial photographs and interviews with available onsite or local personnel to evaluate past and present land uses. • A review of selected environmental lists published by state and federal agencies to determine if the site or nearby properties are listed as having a present or past environmental problem, are under investigation or are regulated by state or federal environmental regulatory agencies. • A site reconnaissance for obvious indications of present or past activities which have or could have impacted the site soils and/or ground water. • Perform an onsite limited polychlorinated biphenyl (PCB) survey. The limited PCB survey consisted of a visual reconnaissance for fluid-containing major electrical devices (transformers and capacitor banks). The PCB status of these devices was determined by the presence or absence of labeling. The general condition of these devices was noted, especially evidence of leakage. The limited PCB survey did not include any sampling or testing of dielectric fluids. • A neighboring site reconnaissance, limited to observation of immediately adjacent property uses. • Preparation of this report presenting our findings, conclusions and recommendations. Phase 30 QUALIFICATIONS The findings and opinions presented are relative to the dates of our site work and should not be relied upon to represent conditions at substantially later dates. The opinions included herein are based on information obtained during the study and our experience. If additional information becomes available which might impact our environmental findings, we request the opportunity to review the information, reassess the potential concerns, and modify our opinions, if warranted. If this assessment included a review of documents prepared by others it must be recognized that LAW has no responsibility for the accuracy of information contained therein. Although this assessment has attempted to identify the potential for environmental impacts to the subject property, potential sources of contamination may have escaped detection due to: (1) the limited scope of this assessment, (2) the inaccuracy of public records, and (3) the presence of undetected or unreported environmental incidents. It was not the purpose of this study to determine the actual presence, degree or extent of contamination, if any, at the site. This could require additional exploratory work, including sampling and laboratory analysis. These types of assessments normally require approximately two to three weeks to complete. Due to the short turnaround schedule requested and the volume number of the sites, we cannot guarantee that all information requested from outside sources was available for our review during the expedited project schedule. Also, regulatory agencies may not have responded to our requests within the project schedule. Therefore, this report presents our findings based on our evaluation of the materials obtained and reviewed within the agreed upon schedule. The gradient and distance information listed in Section 3 - Regulatory Information, are estimates. The distances are reported by the regulatory database suppliers and generated by a geographical information service program operated by the supplier. The gradients are based on the surface topography as defined on the 7.5 minute Topographic Map of the subject area and minor elevation changes may be present between contour lines. Installation of monitoring wells and water level measurements would be required to establish the actual ground-water gradient, which were beyond the scope of services for this project. The American Society for Testing and Materials (ASTM) specification ASTM E 1527-97 lists the mandatory physical setting sources and specifies that the historical review should be conducted using as many sources as are practically reviewable from the initial development of the subject property or back to 1940, whichever is earlier. To comply with the ASTM standard, a reasonable attempt was made to obtain historical data from as many physical setting sources and to review historical records as far in the past as practical.. The reference materials listed in Section 8.0 References are the physical setting and historical sources that were publicly available, obtainable within reasonable time and cost restraints, and practically reviewable as defined in the ASTM standard. In addition, it should be noted that the Phase I ESA reports do not totally comply with the ASTM E 1527-97, Preliminary Environmental Site Assessments specification. Surface Gradient Direction: North/Northeast Gradient: Approximately 50 feet per mile. Soil Survey Reference: The 1958 Soil Survey of Brazos County, Texas. Complex: Lufkin Series - Lufkin Fine Sandy Loam (I to 3 percent slope) Soil Description: Lufkin fine sandy loams consist of moderately fertile, crusty, claypan soils developed from alkaline to weakly calcareous clay and sandy clay. These soils consist of six layers of gray acidic sandy loams to pale brown alkaline clays to a depth of 64 inches having moderately sloped surfaces, and being impervious to water and susceptible to erosion. Permeability: Low Surface Runoff. Moderate Water Capacity: Moderate Internal Drainage: Moderate Geologic Reference: Geologic Atlas of Texas, Austin Sheet, revised 1963. Formation: Yegua Formation Formation Description: The Yegua Formation consists of quartz sandstone, sandy, silty clay and lignite with an approximate thickness between 750 and 1,000 feet. Carter's Creek is located approximately one mile east of the site.
