RE: Your warnings correspondence of July 8, 2002 and July 19, 2002 issued against the
"Amerco Estate Company of Texas, Inc. ", regarding the U -Haul Center site located
ai 519 Texas Avenue South, College Station, TX ( "U -Haul Center").
Dear Ms. Flanery:
My name is Thomas F. Tollison, I am the Marketing Staff Attorney for U -Haul International, Inc.
I am writing this letter on behalf of the Amerco Real Estate Company ( "AMERCO ") and the
U -Haul Company of Texas ( "U- Haul").
I am in receipt of the above - mentioned warnings to AMERCO and Alan Kirkhart (U -Haul
Marketing Company President) and I acknowledge their purpose to attempt to notify us that we
are required to complete certain improvements to our U -Haul Center site as they are part of an
"approved landscape plans ".
Please consider the following with the utmost carefulness and attention:
First and foremost, why are we required to complete any improvements? Your warning letters
discuss approved site and landscape plans and the requirements thereof, but your letters fail to
address what it is about the U -Haul Center site or our corporate presence that requires
improvements. This lack of detail and notice is somewhat disconcerting to U -Haul.
Nevertheless, it is my understanding, based on your representations to local
U -Haul Company of Texas personnel, namely Gary Bouillion and Alan Kirkhart, that the reason
we are subject to these requirements is because U -Haul has made "25% of improvements" to the
U -Haul Center site and therefore, the zoning code requires our compliance to complete certain
improvements per an "approved landscape plan ". Why don't your warning letters discuss this
"25% Improvement" regime? As part of your warning letters, why didn't you provide us with
copies of the code or at least a paraphrased portion of the code detailing this 25% Improvement
regime? What does 25% Improvements mean exactly? Improvements that cause a 25% increase
in the value of the property? What?
It seems to me that if we were required by the City of College Station to comply with a plan or
complete a project with regard to the U -Haul Center site, that you would have at least set forth the
25% Improvement "trigger" of that requirement more thoroughly in your warning letters.

Dear Mr. Mayo
This letter addresses the drainage impacts that will result from the development of the above
referenced site. The impact of the development of this site on the adjacent property and existing
drainage facilities has been reviewed in light of the City of College Station Stormwater
Management Plan. Attachments #1 and #2 show the location of the site and the location of flood
plains in reference to the site, respectively. Proposed improvements consist of the following: 1)
Demolition of the existing ±1,833 SF building adjacent to Texas Avenue; 2) Installation of
concrete pavement; 3) Construction of new 1,500 SF building; 4) Installation of concrete curbs
and brick pavers; and 5) Planting of new trees along south property line. Refer to the attached
Site Plan for additional information regarding improvements.
The existing site is primarily covered with impervious surfaces (i.e. concrete, asphalt, building,
etc.). Very little grade work (i.e. changes to elevations) will be performed on the site. Therefore,
the runoff of the developed site will flow along the existing drainage paths. If an increase in of
runoff occurs, the increase will be insignificant and will have little to no impact on adjacent
property. Most of the flow from the site will discharge on the adjacent streets.
The proposed site improvements will change the drainage characteristics of this site very little.
Therefore, there will be little to no impact to adjacent property owners or existing drainage
facilities.

That based on site they submitted, the driveway on Texas looked like it would have to go to PRC. Elrey
said they they would be officially submitting the site plan once they got the changes incorporated from the
landscape architect. I told him that if there were improvements made such as adding pavement arrows
and signing for one -way, increasing driveway throat length, showing how circulation would occur on -site
etc.driveways throat length, add arrows and signing for one -way, etc. - that it would help his case for the
driveway on Texas. I told him that I agreed with him that w/o this driveway some vehicles would end up
using the entry on University - which is worse that them using the one on Texas.

EXPLANATIONS
1. Island area provided for the two island for this project are less than 180 SF. The
island along Texas Avenue is approximately 144 SF and will consist of enhanced
brick pavers. The island along Poplar Street is approximately 150 SF and will consist
of lawn and existing pecan. This island will also be contiguous with the
lawn /landscaping along Poplar Street. Island were size by registered landscape
architect for appearance and functionality.
2. Land scaping /hardscaping within the reserve area could not be met; therefore, a
registered landscape architect prepared a landscaping plan for the site in accordance
with Ordinance No. 1638, Section 11.10.
3. Landscaping /hardscaping has been prepared by a registered landscape architect in
accordance with Ordinance No. 1638, Section 11.10.

Because you have not, I consider your actions to be in violation of our due process rights afforded
to us by state and federal constitutions.
Moreover, in light of the deficiencies of your warning letters, was it necessary to threaten us? To
threaten Alan Kirkhart? Are your superiors aware of your actions here? How about the City of
College Station Attorney? Ms. Flanery, please be aware that your warnings are under "Color of
Government Authority" and are construed by U -Haul and its personnel to be a clear abuse of the
citizenry of Texas and an unjustifiable exercise of authority to strike intimidation and fear into
our employees, namely Alan Kirkhart. What do you think the opinion of a Federal Judge will be
when I make him or her aware of your actions towards Mr. Kirkhart? If you are not sure, please
consult the City of College Station Attorney immediately.
Ms. Flanery, if U -Haul is in violation of a zoning ordinance due to our lack to perform certain
acts (make improvements), then you and the City of College Station, through the appropriate
service of process, must properly and thoroughly notify U -Haul as to what exactly compromises
those acts and why we have to perform those acts. Until that time, I request that you and the Code
Enforcement Division of the City of College Station, refrain and do not attempt to interfere with
or obstruct, in any manner, U -Haul business or operations and furthermore, I request that you and
the City of College Station, refrain from any further harassing or intimidating actions towards
Alan Kirkhart or other U -Haul Personnel including but not limited to, the issuance of $2,000.00
per day fines.
Ms. Flanery, in light of our serious concerns and requests discussed above, we still think this
matter can be resolved amicably and without any unnecessary "legal wrangling ". Please consider
the following:
At this U -Haul Center site, U -Haul has helped move residents and students to and from College
Station since the mid 1960s (Please note that AMERCO has owned the site since 1975). Our use
at this location is safe, proper and is in fact a valued service to the community, as reflected by our
continued patronage for over thirty-five (35) years. Our use is low traffic and poses no moral
dilemma.. I am sure that you are aware of the XXX adult bookstore on the one side of us and gas
stations on the other two corners?
We have a good relationship with the City of College Station. We have time and again shown_ our
willingness to grow and to improve at this site as well as at our other site at 2813 Texas Avenue.
We want to make this site look visually appealing. In fact, I believe that we have gone above and
beyond the "call of duty" at that location by painting our storage doors "maroon". As an alumnus
of a Texas University, I have been to College Station on "game day ", and in light of the spirit and
camaraderie that I have witnessed there, I have a hard time believing that Texas A &M Students,
Fans or other College Station Residents, disapprove of our efforts to celebrate Texas A &M by
using maroon colored doors on our storage rooms, especially when everyone knows U -Haul by
our trademarked, orange color. In sum, we consider ourselves a valued corporate citizen of
College Station and we will conduct ourselves the same, but we want to be treated, respected and
recognized as such.

With the aforementioned in mind, we, would therefore, request a meeting between Gary
Bouillion, you and other appropriate U -Haul and City of College Station personnel to discuss the
following subjects:
• Foregoing use of specific existing curb cuts to the site.
• Agreeing to specific off site and on site improvements including brick portions of
sidewalk and installing new curbs to permanently delete specific existing curb cuts.
• Agreeing to a footprint and elevation for an add on bay for preparing customer vehicles
to tow U -Haul trailers.
• As U- Haul's business improves and it becomes economically feasible,
U -Haul would permit and construct the agreed upon improvements.
Please note that I will be out of the office on vacation until September 5` and I respectfully ask
that you contact Gary Bouillion directly at (512) 656 -2382, to set up this meeting.

U -Haul Site Improvements - The site plan shows the west side of the enclosure to be only 8 feet, two
inches in depth. This is acceptable for their current service (300 gallon round plastic container) but the
plan shows a metal square dumpster. If that's what they will be wanting over there they'll need to
lengthen that side of the enclosure to 12 feet.

just met with dale brown, engineer drawing up the site redevelopment at university and texas. we
determined the following:
1. dumpster pad size - i have a call in to wally or pete to get back with me to see if they can use a
smaller pad size. dale may have to go talk to one of them to make his arguments that they won't need
the standard 12' X 12'. since this is not an ordinance requirement but rather a sanitation department call,
i will leave it up to them to enforce or not.
2. parking row end islands - they won't need them if they do not voluntarily put in new parking rows. the
parking demand is not increasing for the site - the use is becoming more intense in terms of inventory
storage but the parking requirement is not increasing therefore they do not have to add more parking.
since they don't have to add more parking, they only need to add end islands if they designate parking of
their own accord.
3. setbacks - they can designate university as their front setback, that would make the eastern property
line their internal side, which they could go to 0' on under table a conditions. the property line the city
recognizes there is what is shown on the plat - the "sliver" was created some time later through a metes
and bounds division with was not done by plat. therefore the setback is measured off the plat. so they
don't need a variance - i told dale his money is probably gone but i would see if there is any left to
reimburse him.
4. he anticipates submitting a letter for the prc variance for the driveway by Monday. we told him this
would trigger us setting up that meeting.
5. we also discussed that he would need to submit a pip with all the info required for the poplar
improvements.

Plan Review Committee:
This letter is being submitted to request a variance for the adjacent driveway spacing
requirements as per the "Driveway Access Location and Design Policy." The Policy
requires a minimum adjacent driveway spacing of 275. The above referenced project is
located on the corner of Texas Avenue and University Drive. The project site was
subdivided in such a manner that the frontage along Texas Avenue and University Drive
is only ±165' and ±160', respectively. Therefore, the adjacent driveway spacing can not
be obtained as required by the Policy.
Under current conditions, the site has two driveways located on Texas Avenue and one
near the intersection of Poplar Street and Texas Avenue. Therefore, we propose to close
the most northern driveway along Texas Avenue and the driveway near the intersection
of Poplar Street and Texas Avenue. The signal remaining driveway entrance on Texas
Avenue will be improved as per the construction drawings. Please note that we are
making improvements to an existing driveway and not constructing a new driveway
entrance. The improved driveway will allow entrance onto the site while eliminating exiting
from the site at this location. Onsite traffic will be encouraged to exit the site via University
Drive and Poplar Street. We believe that this flow of traffic will have little impact on the
traffic along Texas Avenue and University Drive. In contrast, if the variance in not granted
for the entrance along Texas Avenue, we are certain that significant traffic problems will
occur along University Drive and Texas Avenue.
Therefore, we respectfully request a variance from the adjacent driveway spacing
requirements of the Policy.

The following addresses the staff review comments for the above referenced project. The
numbered comments below correspond to the staff review comments.
Planning Comments:
1. Please find enclosed a letter addressed to the Plan Review Committee
requesting a variance for the Texas Avenue entrance with regards to the
adjacent driveway spacing requirements as per the "Driveway Access Location
and Design Policy." In addition to the letter to the PRC, I have enclosed three
site plans for the commissioners review.
2. The only easement associated with the property is a blanket easement by the
City of Bryan. Refer to note 8 under Site Notes on page 2 of the construction
drawings.
3. Parking spaces have been removed from the drawing because site
redevelopment is not increasing the demand for parking. Therefore, the site
retains its non - conforming status with regard to parking.
4. 1 have spoke with Wally Urrutia with the Sanitation Department of Public Works
regarding the size of the dumpster enclosures. I have revised the enclosures as
per my discussion with Mr. Urrutia.
5. The legal description of the small sliver east of the proposed building has been
identified on the drawings. Also, University Drive will be taken as the front of the
property and associated setbacks are shown on the "Proposed Site Conditions"
on page 2 of the construction drawings.
6. The scale on page 3 has been revised.
7. The owner will address the permitting and variance request associated with the
proposed signs.
8. A note regarding the enhance paving to match existing paving in R.O.W. was
added. Refer to note 6 on page 3 of the construction drawings.
9. The owner will submit P.I.P. application and associated documents.

10. The attached letter from the landscape architect addresses this comment.
Engineering Comments:
1. Spot elevations are not shown on the construction drawings because all of the
proposed curbs are being placed on top of existing concrete pavement or is
connecting to structures with existing elevations. All proposed concrete
pavement will match existing elevations. I will meet with the contractor on -site to
ensure that the finished improvements will be as per our requirements.
2. The existing and proposed contours for the site will be the same. As stated
previously, all improvements will be tying into existing elements that are at a set
grade; therefore, the proposed contours will be very close to the existing
contours.
Also, please find enclosed two revised sets of construction drawings for this project as requested.

Dear Sabine,
I have read the Staff Review Comments regarding the landscape issues. At
best, this is a very difficult site and there is much to consider here. We all have an
opportunity to take advantage of a "cleaning up" of this site. In business, sometimes
the best solution for all parties concerned is a compromise. What is gained vs. what is
given up? After reading the following paragraphs, please consider approving the
resubmitted plan as it is drawn. I honestly believe that most of the interested parties,
after reviewing the facts, options and alternatives, will agree that the benefits gained
from this potential compromise will far outweigh the losses at this highly visible
intersection in our community.
Like you, I have considered many factors concerning this site. I feel that the best
recommendation for the landscaping on this site is represented on the drawing.
Several influences were considered before I drew the proposed plan. They are as
follows:
1. The Owner: This user has demonstrated at the other Texas Avenue location a
certain ability, or lack thereof, to interpret, participate in and implement the
unspoken / unwritten goals and objectives inherent in landscape zoning
ordinance requirements. As we know, those goals and objectives are to enhance
visual impact and aesthetic values as well as improve the quality of life for the
citizens of our community. Although the business itself provides a necessary
service for those moving in and out of our area, the lack of real appreciation for
the greenscape elements leads me to recommend the use of less, rather than
more, living plant material. Even the use of "bullet proof" plants such as cactus
and other desert - loving materials is such an extreme contrast to the newly
improved Texas Avenue median renovation planting scheme that I hesitate to
recommend the use of these plants so close to Texas Avenue. Sidewalks
adjacent to spiny, prickly plants are also not in the best interest of the
pedestrian.

2. The Site: This is without a doubt one of the most heavily traveled intersections
in our community. The visual impact of this particular intersection has a direct
bearing on the impressions and perceptions of those living in community as well
as those visiting our City. As we both know, those impressions can be either
positive or negative and the difference is to some degree determined by the look
and feel of that one paramount intersection with its proximity to the University.
The site can convey to travelers either an attitude of pride in the community or
can display a sense of neglect merely by its appearance. In my opinion, any
step(s) taken toward cleaning up the site are nothing short of a home run for the
City, its residents and our visitors. I am convinced that the removal of the old
gasoline pump canopy and the demolition of the old building nearest Texas
Avenue will create a new image for the entire intersection, much as wrinkle
cream does for aging skin. I think that the Owner also realizes that the "opening
up and cleaning out" concept is the best for all concerned.
3. The Nature of the Business: Heavy traffic regularly flows through the
intersection on a daily basis as the semesters' inevitable beginning and ending
elevate the numbers of vehicles traveling through the area to a horrendous level.
Also, a huge number of moving trucks park on the site in question during the
busy times of semesters. Since there is less than adequate space on the site to
begin with, it becomes necessary that vehicles park very close together. In
order to provide the requested screening, two green hedges or low masonry
walls would need to be installed (one along Texas Avenue and another along
University Drive). Neither of which do I believe will achieve the intended
screening results. I say this for the following reasons: a) a masonry walls would
be in a crumbled state at all times due to vehicles backing into them (inevitable
because of the space constraints); b) a hedge would be trampled or run over by
people loading and unloading, as well as vehicles backing up and parking. Just
avoiding other vehicles on site would demand the attention of the driver at the
expense of the screening; and c) under best conditions, it is an extremely harsh
environment for any living plant material to be surrounded by a sea of pavement.
Radiated heat from pavement, passing motorists, and wind are less than
desirable. A thriving, vigorous planting would be the exception rather than the
rule. It is my opinion that a site free of broken or damaged masonry walls or
dead plants will be infinitely more appealing than seeing a required screen in a
constant state of unsightly disrepair or suffering from a lack of maintenance
attention. The Owner has acknowledged the existing enhanced paving
streetscape scheme. By continuing on with the implemented scheme, I believe
the intersection will take on a cleaner, fresher, more finished appearance for the
months and years ahead.

My professional recommendation, given with careful consideration for long -range
maintenance and efficiency as well as the intersection's immediate overall appeal is
this: in lieu of a green hedge screen or masonry wall, allow the Owner to substitute the
continuation of the enhanced paving for the required screening along Texas Avenue
and University Drive. I appreciate the opportunity to express my reactions to the Staff

Re: Driveway variance for U -Haul located on University Drive and Texas Ave.
This item is for consideration of a driveway variance request in a C -1 zoning, General
Commercial. This U -Haul is located on the corner of University Drive and Texas Avenue.
Both streets are classified as a major arterial. The `Driveway Access Location and Design
Policy'of the City of College Station requires a minimum spacing of 275' for both adjacent
left and adjacent right driveways and a minimum corner clearance of 200'. The project site
is subdivided in such a manner that the frontage along University Drive and Texas Avenue
is only 160' and 165', respectively. Therefore, the adjacent driveway spacing or the corner
clearance cannot be obtained as required by our `Driveway Access Location and Design
Policy'.
They presently have five driveways. They are eliminating two. The driveway on Texas
Avenue is being restructured to an ingress only driveway.
Although the existing site does not meet the `Driveway Access Location and Design
Policy', staff does support this variance request due to the increased traffic safety of
eliminating two drives and restructuring the drive on Texas Avenue.
The purpose of bringing this case to the PRC is for appropriate due process as necessary
according to the ordinances of the City of College Station.

i've put the file back on your desk, with bob ruth's letter on top
i do not agree that the user should be exempted from landscaping requirements because they have
demonstrated a lack of appreciation of such matters.
however, i am inclined to agree that any screening we may require may quickly serve to detract from
rather than add to the aesthetics of the site. it is the actual use of storage that is objectionable, i think, so
this is really a land use matter, which should be addressed through future zoning changes. during the
interim, however, we probably should not insist on a wall or hedge but rather make sure that the curbing
is in place to discourage the storage of vans in the state right -of -way.
therefore i suggest that for the proposed site changes, we do not require screening, and that we use the
discretion allowed us in section 11 to accept the alternate landscape plan, which includes trees in the city
rights of way and enhances pavers, and which is sealed by a landscape architect, to approve the plan.

plan and drawings for the above reference project would cost the owner significantly more than
expected. In order to reduce the costs, the owner has ask to leave the existing canopy in place.
We realize that leaving the concrete islands around the canopy support columns would impact the
approved traffic lanes. We therefore proposed to remove the concrete islands around the canopy
support columns to address this impact to the traffic lanes. The attached drawing shows the
separation distance between the proposed bollards and sidewalk around the existing building
would be 26-8 ". 1 believe this provides ample separation between the two structures and
generally meets the original traffic flow pattern for this site. We therefore respectfully request the
City's approval on leaving the canopy and removing the concrete islands around the canopy
support columns.
