I have also met with you concerning this development. I will not be able to attend the P&Z meeting on Nov. 6, 2000 because I am temporarily in California where my wife was recently hospitalized. Would you please convey my following comments to the P&Z Commission? Dear members of the Planning and Zoning Commission: I do not believe the R1 B development proposed by D. Grein for the property immediately to the northwest of Raintree is in the best interests of the residents of Raintree or the City of College Station. This property is less than 15 acres in total. About one-half of it is in the 100 year flood plain, which contains an important green corridor connecting Wolf Pen Creek southwest of the Route 6 Bypass to Raintree park and then to Carter Creek. According to Mark Smith, the evolving "Greenway Plan" proposes no development of this flood plain. This corridor is important for wildlife habitat and for flood control. I have personally documented over 100 species of birds and 10 species of mammals larger than rats that use this riparian habitat. Flooding is already a problem in Raintree. I have twice seen flood waters within ten feet of my lot at the northwest end of Appomattox Drive; the proposed development will surely increase this danger. Only 7 acres above the flood plain are available for development. According to past comments by Mr. Grein, dense development of this property is required in order to be profitable. This will not provide the buffer space between developments specified in the East Bypass Area Plan now under consideration. Mr. Grein's planned extension of Appomattox Drive will greatly increase traffic in Raintree because residents of the new development will surely exit on Raintree Drive/Southwest Parkway rather than the one-way frontage road whenever they visit the south side of College Station. This property is attractive, especially if the dam for the recently destroyed large pond is restored and the flood plain is preserved. It would be a perfect site for a church, civic building, or light-use offices that would benefit from the attractive surrounds. Mr. Grein's lack of concern for environmental considerations has long been evident, and recently highlighted by his destruction of the pond during a major drought. This was done in anger immediately after the City Council deferred deciding about his last proposal. There is no reason to trust the stewardship of this land to his financially motivated concerns. When I moved to CS in 1991, 1 purchased a townhouse at Longmire & Brothers. I loved that townhouse it met all my needs. I would still be living there today if it weren't for the A&M students who literally drove me out with their noise. I purchased a house (which is something I never wanted to do again) in Raintree because it was a very quiet and afford- able neighborhood. I am on the end of a cul-de- sac with a ranch behind me. To hear the occasional "moo" of a cow or "neigh" of a horse is so country. I truly enoy it. I now have college students living behind me for the last two years. And the parties were there until a $270 ticket was issued a month or so ago. I am very appreciative of the police department that CS has and how quick the officers are to respond. However, I have low tolerance for the inconsideration of many of the students who live in our area. I love young people but I don't want to live by them. I look at developing the area along the by-pass as losing the country atmosphere. It possibly can be done in good taste and be pleasing to look at but I have my "druthers" after looking at all the car dealers now lining the by-pass and gas stations at most every exit. The current entrance into Raintree is an excellent buffer particularly for those homes that back up to the frontage road. The now empty pond was a delight for those who lived in its view. I've been of the opinion that the area surrounding the entrance of Raintree is wetlands absorbs the excess water. Wetlands are there for a purpose and I don't believe they should be filled in for development. I would rather see the city of CS buy out the owner of that property and not develop it rather than build around the entrance area. I would hope that the committee has driven through all these areas that are being targeted for development. When you have communities such as Emerald Forest that sits back blocks away from the by-pass, that's one thing. But a community that backs up to the by-pass should have a buffer zone. I would like to see a PDD-H zoning here on the entire property, so that we, as established Raintree and College Station Residents, can have a better chance of getting a development so close to our own neighborhood that looks and "feels" like what we currently enjoy in Raintree, not something just thrown in the open space to make some money. This is imperative if Mr. Grein intends to extend Appomattox or connect it somehow to the feeder road of the Highway 6 Bypass. In the East Bypass Plan that was adopted as a guide for this area, we wanted neighborhood integrity be preserved and there be buffers between developments ...with a PDD-H zoning, this could be done, but with an R1 B and R1, this would not even be considered by Mr. Grein. Mr. Grein's current request for rezoning is for only the 5 acre portion (currently zoned A-O) to be rezoned R1-13, which leaves the other 9 acres zoned just R1. This leaves the property with at least 2 different zonings and at least 2 different minimums for development of lots and homes. If a PDD-H zoning is not possible for this property, I would like to ask that the City initiate rezoning of the other 9 acres to be R1-B. Ideally, a PDD-H zoning would be in our best interest as an established neighborhood in College Station, but a property zoned differently throughout just lends itself to problems down the road, and doesn't fit in with the guidelines of the East Bypass Plan. As before, there are drainage concerns (if he fills in the flood plain area on that property)- as well as traffic concerns with the extension or connection of Appomattox through to the feeder road. But I realize that drainage and connection issues are not dealt with at this stage, unless you have a PDD-H zoning. Thanks for your consideration of my concerns and opinions! If the City Council wishes to consider to purchase the above property, I would have no objections. I have a contract with the land owners for $1.25 per square foot. I understand that Mr. Herman across the creek has a contract pending for his land close to $1.00 per square foot. These prices do include the floodway and floodplane. This last Sundays paper drew a picture of an angry developer ready to build no matter what. It's funny how the papers want to get that shock result from its readers at any cost, it sells papers. It didn't say how I explained to the two residents that I was going to build up a dam to retain water for them when we started to develop commercially, or build up as agriculture. After all if you denie me R-1B for this portion to remain agriculture, we must still install a sound productive way to produce a profitable business for this land. I would like to work with The City of College Station to develop a first class contemporary office/apartment complex community as well as a 55yr and older retirement home in the near future. Upon inspection I observed that twelve loads of wet dirt topsoil) had been placed along the fill previously placed last year. Since this area drains through the pond, the hay bale check dam installation you installed downstream will serve to provide erosion control for this new activity. There are a couple of things that need to be addresses in a timely manner. First you need to reinstall hay bales in the bottom of the outlet channel where they have been displaced. The Commission and Council denied the rezoning due in large part to the reluctance to introduce apartment uses in this area of the City. The larger tract was annexed in two separate years - 9.15 acres were annexed in 1971, when property came into the City as R-1; the subject 5.08 acres came into the City as A-0 in 1977. Both the R-1 on the adjacent property and the A-0 on the subject property were considered holding zones.
