Regarding the easements in TxDOT ROW:
It was my understanding that easements that were dedicated prior to acquisition of ROW by TxDOT
would have some prior rights that would prevent TxDOT from requiring any lines to be relocated without
compensation by TxDOT. I do not recall any discussion about permits at all.
What ever easements that may have been dedicated to the City were not processed through us.
Although I have not seen the easement documents, it is my understanding that there are no City
signatures or acknowledgments on them. This leads me to believe that the easements may have been
dedicated to the City without any City participation or review. If so, that explains the problem with the gas
line being excluded.

There are several pending issues related to this subject.
The first involves the Phase II of the Spring Creek Sewer Trunkline. This is currently under construction
by Young. They have several grade problems which among them is the bore under Hwy 6. This is too
high on the upstream side and too low on the downstream side. This issue we are working on. Even if it
was completed to plan grade on the downstream side, there are grade problems because LJA (design
firm) did not accurately measure the existing inlet flow line inlet grade at the manhole which was the
termination of Phase I. My remembrance when we were working on the Development Agreement that
allowed Crowley to provide the engineering design was that Crowley provided the professional liability.
Can we make Crowley responsible for any cost impact because of this error? Young is currently past
their required substantial completion date with no completion in sight.
I had also previously received a request from Chuck Ellison to certify the cost of engineering services for
impact fee credit. I responded to him that the agreement indicated that no fee credits are eligible until
completion of the project.
Among the other issues is the easement provided along the future Hwy 40. 1 am told that Crowley
dedicated and filed an easement to the City and then provided right-of-way to TxDOT. This easement
does not have any City signatures related to acceptance by COCS. When Brett was trying to get the
crossing of the Spring Creek Sewer Trunkline across the TxDOT right-of-way and this easement his
dealing with TxDOT were such that TxDOT required that we obtain a permit from them, not only for the
right-of-way crossing, but also for our utility easement. The Castlegate Developer is currently
constructing a 24 inch water main within this easement and PUD electric is installing electric within this
easement to serve the Castlegate Subdivision. To my knowledge, neither has obtained a TxDOT permit.
Is this something that we should be concerned about? TXU gas came in yesterday working on plans to
install a 6 inch gas main within this easement with intent to obtain a TxDOT permit. The easement
document lists specific uses of which gas service is not included. Does the easement have to be
modified and refiled to allow gas service? Also does the fact that it is now part of the TxDOT right-of-way
enter into this?
The Castlegate Developer is currently pressing to file final plat, sell lots and obtain building permits on the
first phase. His internal water and sewer lines are in with partial construction on the roadways. Until the
24 inch off-site water line is complete, there is no water available to pressure test the lines, flush, or

perform bacteria tests. Also the sewer lines cannot be flushed and tv inspected. Hence, none of the
Phase I infrastructure can be accepted. Discussion has been to allow the Developer to provide a
financial guarantee on the entire infrastructure to allow filing of final plat and issuance of building permits.
I assume his contractor constructing the off-site water line would have to have it connected to the fire
hydrants within Phase I in order to provide fire protection so that combustibles could be brought on site.
Assuming that building permits are issued and houses are constructed, C.O.s cannot be issued until the
Spring Creek Phase II is complete and sewer service is available. My question is what liability to the
home builders or house purchasers does the City incur if this happens?

In the past we have not allowed partial completion for such items as roadways with flexbase and no
pavement because, if exposed to the elements for a period of time, the entire roadway would be required
to be reworked. The internal water lines indicate that almost all is complete. These have never had
water or a pressure test to verify their soundness, therefore, it would be speculative to assume that all is
well and additional work will not be required. The sewer lines indicate the same thing. If so desired, the
developer could use a water truck and pumping to clean the line and allow us to tv inspect for
acceptance. I can not verify that, should this project go into default, all of the infrastructure could be
completed with a financial guarantee of $208,637.86.

agreed to assign its rights to the credit against the impact fees to Greens Prairie Investors, Ltd.

Castlegate development.
In the event that wastewater services through the Spring Creek interceptor are not available to
the development when residential final inspections are requested, certificates of occupancy for
residences in the development will be issued under the following conditions:
The developer provides alternate wastewater service, such as vacuum truck
service or construction of a temporary by-pass line.
2. The alternate service will be at the developer's expense.
The alternate service will be provided until the Spring Creek wastewater
interceptor is completed and in service.
4. The alternate service will be approved by the City of College Station Water/Waste

Dear Mr. Ellison:
On April 17, 2001, I sent you a letter, via facsimile, providing confirmation of our previous
conversations regarding wastewater service to the Castlegate development. This letter, copy
attached for your convenience, listed four specific conditions for issuing certificates of
occupancy in the Castlegate subdivision in the event wastewater services were not available
through the new Spring Creek wastewater interceptor. Those conditions included the following:
4. The alternate service will be approved by the City of College Station Water/Waste
Water Department prior to issuance of certificates of occupancy.
Building permits have been issued within the subdivision. It is my hope to avoid any
unnecessary delays in the release of certificates of occupancy for those building permits. To that
end, I am requesting that you, or the appropriate Castlegate representative, provide the City of
College Station with your plans for providing alternate service. This will allow us to obtain
approval of the City's Water/Wastewater Department before we receive requests for final
inspections from Castlegate builders. As I recommended in our phone conversation this
morning, the plans for alternate service should provide for some mechanism to ensure that the
service continues to be provided in the event the developer ceases to provide alternate
wastewater service.

Re: Engineering Submittals for the Proposed Water Main Servicing Castle Gate Community and Subdivision;

Dear Mr. Mayo:
CSC Engineering & Environmental Consultants, Inc. (CSC) is pleased to submit to the City of College Station
(City) the attached engineering submittals for the above-referenced development. 'File following documents are
submitted for vour review and consideration:
• Water Demand and Analysis Report, including construction cost estimates (three copies)
• Technical Construction Specifications (three copies)
• Review Sets of Construction Plans (three copies)
The focus of our submittals is the water main that will provide service to the Castle Gate Community. The proposed
water main will extend from the College Station water tower on Greens Prairie Road in a westerly direction for a
distance of approximately 6,900 lineal ft along the proposed northern boundary of the State Highway 40 right-of-way.
Our submittal indicates that a 12-inch diameter water main would provide adequate service to the proposed Castle Gate
Community. However, we understand through meetings with City staff during August and September 2000 that the
City requires that the water main be oversized to 24-inch diameter and that the City will contribute funds to pay for the
construction of the oversized line.
The cost of constructing the 12-inch water main needed for development of the proposed subdivision is approximately
$330,440 (Table 2 of Water Demand and Analysis Report, hereafter "Report"). and the corresponding cost for the 24-
inch line required by the City is approximately $812,680 (Table 3 of Report). Therefore, the cost difference associated
with the construction of the oversized lines is $482,240 ($812,6804330,440). The developer of the subdivision plans to
construct the water main as part of the same effort involved in the construction of the utilities (water and sanitary sewer
for the proposed subdivision). The construction cost of the water and sanitar% sewer utilities in the subdivision are
estimated to be approximately $1,885,500. Thus the total project construction cost, i.e. the 12-inch water line plus the
subdivision utilities, is approximately $2,215,940. Therefore, the 'oversize" construction cost associated with the 24-
inch water main is approximately 21.7 % of the total project construction cost ($482,240/$2,215,940).

Dear Ms. George:
Attached is a final plat application for a revised plat for the above referenced subdivision.
The plat was approved by the Planning & Zoning Commission on November 16, 2000,
but has not been filed yet. The plat has been revised to shown the area in the median of
Castlegate Drive as a common (private) area instead of street right-of-way. This revision
was requested by the City to allow the Developer to construct landscaping and other
facilities within this median area. The boundary of the common area is approximately 2
feet behind the median curb line which will allow for future maintenance of the street.
Natalie said the application fee would be waived for this resubmittal.

CASTLEGATE SUB SEC 1 PH 1 (23.44 acres) located north of Greens Prairie
Road and west of proposed State Highway 40. (0-178)
Applicant: WALLACE PHILLIPS, GREENS PRAIRIE INVESTORS, LTD.
Staff Recommendations: Staff recommends approval as submitted.
Item Summary: This is a revision to the final plat approved by the Planning and
Zoning Commission on November 16, 2000. The revision is to create a common
area in the median of Castlegate Drive near the entrance to the subdivision. The
developer intends to build a small logistics center in the median. Maintainance
will be by the home owners association.

This letter is to serve as confirmation of our conversations regarding wastewater service to the
Castlegate development.
In the event that wastewater services through the Spring Creek interceptor are not available to
the development when residential final inspections are requested, certificates of occupancy for
