REGULAR AGENDA
AGENDA ITEM NO. 4: Consider request(s) for absence from meeting.
Commissioner Happ motioned to approve the absence requests, which was seconded by Commissioner
Harris. The motion carried 6-0.
AGENDA ITEM NO. 5: Consideration of a Master Development Plan for Bella Vista
Subdivision located northeast of Wellborn Road and southeast of Graham Road and consisting
of approximately 87.33 acres. (01-20)
Staff Planner Jimmerson presented the staff report and opened by stating that she is presenting both
Agenda Items No. 5 and 6 simultaneously. She reports that Staff is not making a recommendation for
the Master Development Plan at this time. However, if the Commission chooses to approve the
rezoning request (Agenda Item No. 6), Staff is recommending applicable conditions.
Ms. Jimmerson states that the applicant is requesting approval of the Master Development Plan and the
rezoning request to enable the development of a residential subdivision and some additional industrial
property as shown on the Land Use Plan. The residential proposal includes 244 single family lots and
142 townhouse lots in addition to three industrial lots: She explained that the areas that are proposed
to be rezoned to R&D are clearly indicated on the Land Use Plan as future industrial areas.
Furthermore, the R&D zoning district is the least intense of the currently available industrial zoning
districts and includes buffer standards in the zoning requirements. Additionally, Staff feels the tract of
land near the intersection of Graham Road and the future extension of Victoria would be more

CASTLEGATE FINAL PLAT
Phase I, Section I
I met with Wallace Phillips, Joe Schultz and Nora Thompson to discuss the filing of the
final plat and issuance of building permits. Wallace's goal is to file the final plat on
Friday, March 2, 2001 and begin pulling slab only permits on Monday, March 5, 2001.
In order to file the final plat, several guarantees must be in place:
• The remaining infrastructure for Phase I, Section I. Joe Schultz submitted an
engineer's estimate with percentages of completion on various items. Bob Mosely
was concerned with allowing the developer to guarantee partial amounts of the water,
sewer & street systems that have not been tested. I informed Joe Schultz that we
would require a 100% guarantee of the water, sanitary -sewer_and street systems.
• The off-site 24" waterline. Wallace plans to finish this waterline extension to Phases
I - IV in order to get building permits. He would like for us to accept that portion of
the line for building permit issuance and then finish the remaining line before any
O.P. is released. Wallace plans to provide two letters of credit for this line each at
50% of the total cost (close to $800,000). One letter of credit will expire in 30 days,
this will cover the portion of the line to the first four phases of Castlegate. The
second letter of credit will expire in 90 days, this will cover the remaining portion of
the line. No O.P. will be released until 100% of the line is completed and accepted.
• Sewer impact fees in the amount of $349.55 per lot. Tim Crowley has an agreement
with the City to receive impact fee credits for the portion of the Spring Creek sewer
line design that is currently under construction. (Tim paid LJA to design the line and
the City is building the line based on those plans.) In that agreement, it states that the
City will not determine the amount of credits until the line is completed and accepted.
Wallace must guarantee or pay the sewer impact fees before filing_the final plat since
the off-site sewer line is still under construction. Along with that guarantee, Wallace
must submit something in writing stating_from Tim Crowley that gives Wallace the
credits for the subdivision.
• Parkland development fees in the amount of $309 per It. Wallace is planning to
develop the City parks in this subdivision and is currently working with the Parks
Department on plans. The parkland for phase I is being dedicated with the plat;
however, the development of that park will not be complete in the near future. The
guarantee must remain in place until the park improvements are constructed and
Off-site detention - Wallace is not responsible for guaranteeing or constructing the
off-site detention facility with this phase. According to Ted Mayo, theyare_allowed
up to 75 building permits without off-site detention. Joe Schultz is also looking into
the possibility of increasing that number by diverting some of the run-off to the future
lakes in Castlegate.

I later met with Ted Mayo and Bob Mosely concerning the proposed sequence of events.
Bob expressed concern about the off-site sewer line that the City is currently
constructing. Some of the flowlines were not met and the sewerline will lam` not flow.
Bob is currently working with Young Contractors and the legal department to resolve this
problem. Apparantly, there is a "professional liability" clause in the contract between the
City and Tim Crowley that releases LJA engineering. Bob is working with Roxanne to
find out who's responsible for the problem and how to get it fixed.
I set up a meeting with Roxanne, Jim and myself on Wednesday, February 28th to discuss
these issues. Primarily, we're concerned about our level of liability once we issue the full
building permits. What happens if the homes are finished before the sewerline is
completed? What if we end up going into litigation on the sewerline and homes are still
not able to get a C.O.? I informed Wallace and Joe of our concerns and that we needed to
work with the legal staff before committp-afto issuing permits.

3. In regards to the parkland development, we understand that discussions
have begun with the Parks Department. Maybe with the next phase, we can
get something in writing (an e-mail from parks staff will be sufficient) stating
that with the final plat of phase X, the Parks Board will have approved the
plans for developing the parks and with phase Y the construction will be
completed. We are looking for a clear plan that defines the expectations with
each phase, so there will not be any misunderstanding on this issue in the
future.

impact of the increased peak discharge on the structures under Greens
Prairie Road and the affected adjacent off-site property. This information
should be shared with the appropriate Brazos County personnel.

Item: Consideration of a FINAL PLAT for the CASTLEGATE SUB., SEC 1, PH
(23.44 acres) located north of Greens Prairie Road and west of proposed State
Highway 40. (0-178)
Applicant: WALLACE PHILLIPS, GREENS PRAIRIE INVESTOR'S, Ltd.
Item Summary: The Section 1, Phase 1 Final Plat includes 50 PDD-H single
family (0.24 ac. avg.) lots and is in compliance with the Master Preliminary Plat
for the Castlegate Subdivision which was approved in September 2000. This
property was rezoned from A-O to PDD-H in August 2000. The Park Board
approved a proposed 3.91 acre park site in June 2000.
Budgetary & Financial Summary: An oversize participation request will be
considered by the City Council November 9,2000 for the cost difference between
a 12" off-site waterline and a 24" waterline as requested by the City.
Staff Recommendations: Staff recommends approval of the final plat as
submitted.
Commission Action Options:.
The Commission has final authority over the final plat. The options regarding the
final plat are approval as submitted, approval with conditions, or denial. Defer
action or table only at applicant's request.

INFRASTRUCTURE AND FACILITIES
Water: A 24" waterline will be constructed along proposed SH 40 from
an existing 24" City line at SH 6 & Greens Prairie Road west and north
approximately 7200' to serve this development. Water service will be
extended from this line thru the subdivision as required.
Sewer: Sanitary sewer service will be extended to and thru this
subdivision from the City's Spring Creek Sanitary Sewer Impact Fee line
which is currently under construction and will run from east to west
along the north side of this development.
Streets: This initial development includes the entrance off of Greens
Prairie Road --Castlegate Drive which is divided at Greens Prairie with
two 18' one way lanes, a 30' median and a ROW width of 130'. This
entrance runs west approximately 1100' to Ravenstone Loop where it
tapers to 36' pavement and 70' ROW. Ravenstone Loop (60' ROW/24'
pavement) has two segments in this Section 1, Phase 1, each about
1250' in length. The street geometric design criteria varies from the City's
standard criteria and was approved with the rezoning to PDD-H.
Off-site Easements: Easements for the off-site waterline and impact fee
sanitary sewerline are in place.
Drainage: Compliance with the Drainage Ordinance will be verified. A
regional detention pond is being built just west of SH 6 and will include
capacity for this development.
Flood Plain: There is no 100 year floodplain on this 23.44 acre tract.
Oversize request: See Budgetary and Financial Summary Section.
Impact Fees: This development is in the Spring Creek Sanitary Sewer
Impact Fee Area (97-01) and impact fees of $349.55 per living unit
equivalent will be due at time of filing of the final plat.

these issues. Primarily, we're concerned about our level of liability once we issue the full
building permits. What happens if the homes are finished before the sewerline is
completed? What if we end up going into litigation on the sewerline and homes are still
not able to get a C.O.? I informed Wallace and Joe of our concerns and that we needed to
work with the legal staff before committed to issuing permits.
