All owners of the subject property and property owners within 200 feet of the subject property have received notification of this request. SABINE MCCULLY Senior Staff Planner November 9, 2000 Dear Mayor and Council Members of the City of College Station: The supporting information contained herewith is regarding the rezoning request for 4004 Harvey Road from A-O to C-B. The Staff initially recommended C-B zoning for the referenced property. Their current recommendation of PDD-B is not necessary since the issues surrounding the current zoning request can be effectively managed in a way that protects property owners while promoting controlled growth of the community. The Council is requested to approve the zone change with restrictions that will ensure that there is minimal impact to adjacent areas. Specifically, lighting issues and outside seating can be addressed with restrictions placed on the zone change or in a development agreement between the City and the property owner. There have been cases with previous Councils where property previously designated in a planned development area have been removed from the district and zoned by the sitting Council as commercial, effectively defeating the original intent of the PDD. The use of PDD does not protect property owners or our gateways from the actions of future Councils. Additionally, the Highway 30 corridor is not protected from unregulated lighting and outside activity on parcels where commercial zoning is currently allowed. The corridor is also not protected from undesirable uses that are permitted on the properties which line the north side of Highway 30 that are currently zoned A-O, including poultry production, truck gardens, and livestock barns and stables. The entire corridor should be addressed comprehensively with the use of an Overlay District, ensuring that all current and future property owners are protected and that the appearance of the gateway is preserved. Section 5.1 of the City's Zoning Ordinance governs areas annexed into the City limits to be classified as A-O for a period not to exceed one year, and after such time, the Planning & Zoning Commission is charged with initiating zone change proceedings. An Overlay District is deemed appropriate for the Highway 30 corridor since it has been 20 years since the area was annexed into the City and since these frontage road properties are primarily small, individually owned parcels. In summary, your approval of C-B zoning with restrictions is a practical and appropriate decision. Secondarily, a comprehensive Overlay District is necessary for the corridor, and the Council should be credited for taking the responsibility to address this issue. It may also include those areas mentioned in Section 5 above. This district is designed to promote orderly, timely, economical growth and to recognize current conditions. It is a reserved area in which the future growth of the City can occur. PERMITTED USES: Single family dwellings. Mobile Homes, located pursuant to an approved location permit as provided in Section 7.9H. HUD-code manufactured homes, located pursuant to an approved location permit as provided in Section 7.9H. Barn, stable for keeping private animal stock. Country club (publicly or privately owned). Crop production. Farm. Truck garden (including greenhouse for commercial purposes). Golf Course. Home Occupations. Pasturage. Poultry production (non-commercial). Riding academy (private). Proposed C-B Business Commercial PURPOSE: This district is intended as an alternative to general commercial districts in areas where certain commercial uses may be appropriate, but where more intensive uses of the land may not be compatible with the surrounding character. Only limited outside business activity is allowed. Outside business activity is defined as outside display of merchandise for sale but does not include outside storage of merchandise. Outside business activity locations are permitted only in areas no further than 50 feet from the building where the primary business is located and are not allowed in areas out in the parking lot. Sincerely, +~4ilas Enclosure: as stated Recently you published a letter from one of your readers scolding the College Station City Council for their questioning of an administrator of a local agency. May I take a few lines of print to counter those observations and extend kudos to our community leaders. We own a home in the Harvey Hillsides Addition which is in close proximity to and parallels Harvey Road (Texas 30) northeast of the Earl Rudder Freeway. We have made a number of proposals on the development of this beautiful two-mile stretch of highway and envision it as a scenic east entrance corridor to College Station and Texas A&M. Specifically, we have suggested zoning for professional and administrative offices with daytime, weekday operations which blend with the existing wooded, rural setting, and landscaped to the high standards set by College Station. Too, we have not. lost sight of the fact that the quality of the corridor's development will impact on our property values. On several occasions we have appeared before the College Station City Council as well as the Planning and Zoning Commission. Our comments and suggestions have been received by both bodies with interest, openness, courtesy, professionalism and constructive questioning--even though we neither reside, nor do we vote, in College Station. Commendable! So our hats are off to the decision-makers and planners of College Station and to their development of a beautiful new east entrance corridor of which we can.all be proud. She explained that the PDD would help to diminish the negative impacts on the area. Chairman Mooney h echoed the same concerns. Mr. John Vilas, 15 Ranchero Drive, reiterated the concerns regarding the C-B zoning and also stated that mixed zoning would cause some additional problems to their area, particularly regarding spot zoning. He indicated that the PDD contains several provisions which coincides with the visions of the residents of the subdivision, including open space buffers, landscaping, and the Planning and Zoning Commissions' concurrence on any changes from the original approved plan. Please deny the request to rezone 4004 Harvey Road to C-B. Kathy Eugster, 12 Vista Lane, stated that she opposes the request because of the potential of the negative impact of the lighting, noise, and smell as observed by viewing the other such site owned and operated by Mr. Ross. Mr. Delph Ross, the applicant, pointed out to the commission the commission options as stated in the staff report indicating that the rezoning request can be approved with physical conditions that will mitigate negative impacts. Staff Planner Jimmerson stated that it is not uncommon to require a buffer area. However, some of the conditions are already addressed in the ordinances while other conditions would be very difficult to effectively and clearly place upon the site plan. If the item is required to return as a PDD, the conditions could easily be placed based on the layout of the site. Chairman Mooney closed the public hearing. Commissioner motioned for the approval. Commission Harris seconded the motion. Commissioner Horlen stated that PDD is being overused, and the area is appropriate for C-B. Property owners need to have some options of what to do with their property, and Mr. Ross is correct in his opinion that PDD's prohibit small businesses and developers. PDD's will not solve the problems discussed. He said that he believes the property owner should be able to determine what to do with his own property. Commissioner Warren said that her concern about the C-B in that area has to do with entry and exit points of that corridor which is an entry into the city. The use is excellent, but long-term planning and impact management is something we should maintain over this corridor. Commissioner Floyd said that he agrees with Commissioner Horlen in the overuse of the PDD, but in the initial presentation of this request, we determined the most important thing was to ask the citizens what they want. We have that input through the 30/60 study. Therefore, I cannot support the C-B rezoning request. Chairman Mooney agreed that a PDD is necessary in this case as the only avenue that can be utilized at this time to protect this corridor, having listened to and considered the citizen's input on the concerns of their area through the 30/60 study. The best burgers and french fries come out of your grill. My friends and I always come and hang out there or bring dates. We want to open a place like that when we get older. Actually, I've always wanted to write song lyrics. It would be a hoot hearing my worfs come out of a singer's mouth and over the radio. On Wellborn Road you can get your cat fixed or groomed, buy feed, pay your speed- ing ticket, get married and buried, acquire gas in multiple forms and play a few rounds of 42 with a Shin- er by your side. . First the bad news. It's closed on Sundays. Other than that, it doesn't have any short- comings that I can see. Koppe Bridge serves up the best burgers and fries and such you've ever %%Tapped your jaws around. Real meat that tastes like meat, and plenty of it. Old tables with names of hungry patrons carved into them, a covered porch, beer signs and country music. Bring your dominoes and grab a cold one. This is'Texas paradise. Drive south just a bit and the Well- born Road Veterinary k, oppital is on your right. Joseph and Dorothy Mikeska, both good Aggie vets, will gladly remove any corn cobs your dog may have swallowed whole, spay or neuter your pet or remedy any other animal malady. Now, suppose your cat or dog did- n't take kindly to being fixed by Dr. Mikeska. What to do? Take the crit- ter down the road to Shadow Rock Pet Resort for grooming or a day in a luxury suite.. She said that the weekends are quite busy with students, however. "At lunch we have a lot of Bryan and College Station profes- sionals and fewer students," Gonzalez said. "We always go out to Koppe Bridge for hamburgers and to watch football games," Barron said. "They have the best ham- burgers in College Station and the restaurant has great atmosphere." Chicken Driving down Texas Avenue across from campus the sign, "Layne's" clearly can be seen. Many students have not discov- ered this source of fowl food. The fabulous chicken fingers and French fries are the main menu items. The chicken fingers are paired with Layne's fabulous secret recipe sauce, and many student's visit Layne's on a regular basis. Roger Reyna, an employee at Layne's, said the majority of their business comes from their regular and take out customers. "I think our place runs through word of mouth," Reyna said. "We have regular customers who visit us almost everyday. "Our take out is great for a quick bite to eat."
