If a petition for rezoning is denied by the City Council, another application for rezoning shall not be filed within a period of
180 days from the date of denial, except with permission of the Planning & Zoning Commission or City Council. The
following items must be submitted by an established filing deadline date for consideration:

$250.00 application fee.
Two (2) copies of a fully dimensioned map on 24" x 36" paper showing:
a. Land affected;
b. Legal description of area of proposed change;
c. Present zoning;
d. Zoning classification of all abutting land; and
e. All public and private rights-of-way and easements bounding and intersecting subject land.
Written legal description of subject property (metes & bounds or lot & block of subdivision, whichever is applicable).
The attached Rezoning Supporting Information sheet completed in full.

1.) List the changed or changing conditions in the area or in the City which make this zone change necessary.

The proposed property was previously used as a restaurant site for years
in the county and in the City since 1980 under the zoning of A-O•
The building was destroyed in a fire in the mid-1990's, and it
is now necessary to re-zone the property to continue business
usage of the subject property since the frontage on Harvey Road
is now part of the city limits.
2.) Indicate whether or not this zone change is in accordance with the Cornpwhensive Plan. If it is not, explain
why the Play is bwoeted.
This subject frontage property is defined as business property
in the deed restriction documents of the Harvey Hillsides Subdivision
which lies outside the College Station City Limits. It has been
designated as a mixed use area in the Highway 30/60/158 Planning
Study presented to the Planning & Zoning Commission in June 2000.
The zone change is consistent with other commercially zoned tracts
located in the same area.
3.) List any other reasons to support this zone change,
Support of this zone change would make the zoning of the property
consistent with its intended usage, improve the property's value,
increase sales tax revenue and property tax values for the City.
This will also provide a convenient location for family dining,
community enhancement, and for visitors. We have received tremendous
support from local citizens to restore this site as a local, family-
oriented restaurant.
