(0-166) Applicant: ARKITEX STUDIO Item Summary: New facilities for the Baptist Student Ministries are being planned for the vacant land on the southwest corner of Church and College Main. They are requesting a Conditional Use Permit for a non-profit community building. In the planning field, a community building is commonly defined as "a place, structure, area, or other facility used for and providing religious, fraternal, social, and/or recreational programs generally open to the public and designed to accommodate and serve significant segments of the community". Formerly, Baptist Student Ministries functioned as a student union, providing office and meeting space. They hope to continue the uses housed in their previous building. The site is in the NG-1 Historic Northgate zoning district and is surrounded by NG-1. To the west of the site is the City owned parking lot, to the south is developed commercial, and to the north is a vacant commercial building. The First Methodist Church is to the east and, like the subject property, the First Methodist Church land to the northeast has been cleared to make room for expanded facilities. Comprehensive Plan Considerations: The subject property and surrounding area is shown on the Land Use Plan as redevelopment. It has frontage on College Main and Church Street, taking access from Church. Both streets are classified as minor collectors on the Thoroughfare Plan. Item Background: In August of 2000, the building at 203 College Main was demolished in anticipation of new facilities for the Baptist Student Ministries. The new construction therefor requires CUP and site plan consideration. Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." Staff conducted a technical review and found general compliance with development regulations with the exception of the items listed in the Staff Review Comments. 2. "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City. The request is in compliance with the Comprehensive Plan. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Unless the public hearing bring to light any new information indicating potential negative impacts, Staff recommends approval with Staff Review Comments. Related Advisory Board Recommendations: The Northgate Review Board met September 27, 2000 to review the site plan for Baptist Student Ministries. All of their requests have been addressed in the current site plan. Commission Action Options: The Commission has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Approval with conditions relating to specific site characteristics or with time limitations; 3. Staff Review Comments No. 2 2 INFRASTRUCTURE AND FACILITIES Water: Adequate water service will be provided to the site by a 6-inch water line that runs parallel from Church Avenue to the N.W. corner of the bldg. Sewer: Adequate sewer service will be provided from a 4-inch sewer line to a 6-inch city sewer line. Streets: Church Street and College Main are classified as a major collector on the Thoroughfare plan. Drainage: The increase in impervious cover and flow onto Church Avenue is considered to be minimal and no site changes will be required. Flood Plain: Not located within a floodplain. In the site plan checklist (which must be turned in with a site plan application), the area of a project is to be included in the title block so that anyone may look at the plan and easily find the basic information. Please include in this area that the site is 0.5 acres. 2. Please make the appropriate change to the screening fence description to reflect the decision of the NRB. 3. The Development Services staff has discussed the routing of the stormwater across the public access sidewalk. It is the opinion of City staff that this deliberate inundating of the sidewalk with rainfall runoff would pose a health and safety hazard to the public. Please reroute the stormwater runoff to the back or sides of the building by way of gutters, underground to the parking lot and/or rear, or under the sidewalk. Please include the size of the existing sanitary waste line. 6. Is there no solid waste container necessary on this site? 7. What is the purpose of the rectangular pads south of the building? 8. Please screen the A/C units from the public ROWs. 9. Please provide the common and scientific names of the existing trees. 10.
