RE: Zoning of the parcel located at 2500 Dartmouth; the southwest corner of
Dartmouth and Southwest Parkway
Dear Mr. Dosani:
The zoning on the property in question is C-N Neighborhood Business, which lists only a
few neighborhood retail uses as permitted, and it further requires those uses to be
considered by the Planning and Zoning Commission before they will be permitted. The
C-N district does not list service stations or convenience stores as permitted uses;
however, the district does allow other uses to be considered by the Commission. In order
to approve any use, whether it is listed or not, the Commission must rule that such a use
is oriented to the neighboring residential areas and that it will not negatively impact these
areas. The Commission uses the purpose statement to measure proposed uses, and it
takes into consideration the surrounding developments.
Earlier this year, the Commission considered your proposed use of the subject property as
a convenience store and service station. If you will recall, the Commission was
concerned that the site layout and the building design were not oriented to the
neighborhood. Therefore, initially the Commission denied your application. Upon
reapplication, you and your engineer addressed the Commission's concerns by doing the
following:
1) designing a building that had a residential look (using brick that would match
the apartment complex to the south, etc.)
2) keeping the canopy at the lowest height possible and designing it such that it
matches the building
3) designing the lighting such that it would not impact the single family area to
the north
4) adding green space that would assure a more attractive site
5) orienting the building to both Southwest Parkway and Dartmouth, and
6) adding site features to facilitate pedestrian movements from all directions.
The Commission overturned its original denial and approved the project as it was
presented to them after taking these changes and additions into consideration. Therefore

it seems very unlikely to me that the Commission would approve a use that does not
incorporate the site and building features listed above.
You have stated to me that you have been approached by representatives of Texaco, who
wish to place a typical metal building on the site. For the reasons described above, Staff
would recommend that the Commission deny such a proposal, and any other that does not
incorporate the elements as listed above.

Dear David:
Per my phone conversations with Mr. Bob Mosely (City ingineer) and Mr. Ted Mayo (Asst. City
Engineer) a lift station pump system may be installed at the above referenced site so long as it meets the
following design criteria:
1. Shall adhere to all the minimal requirements as defined by Section 317.3 of TNRCC;
2. The lift station shall not be placed within the city's right-of--way;
3. The wet well shall have a volume of not less than 750 gallons;
4. The lift station system shall have duplicate pumps with a pumping capacity of 4U gpm @ 10'
TDH;
~. An audio/visual alarm system shall be provided that will activate in case of power outage, pump
failure or at high water levels.
These design parameters are based from a 35 gpm peak flow and aworse-case scenario of a 20 minute
power outage.
