TJClcp ' TOTAL P.03 -- Bridgette George - Re: Castlegate ~ Page 1 ~~- ~~ From: Jessica Jimmerson 1 To: Jane Kee; Natalie Ruiz; Ric Ploeger Date: 7/10/01 1:15PM ~~ Subject: Re: Castlegate Jane, Natalie, Ted and I met yesterday to discuss this project and some of the issues that are arising from Castlegate being the first project to exercise the option to develop the park themselves. 1. Mr. Phillips should receive credit for any dedication that is above and beyond what is required at this time. However, I would suggest that we look at it another way, instead of granting them credit now for a certain number of dwelling units to be built in the future. We have run into this issue before in Pebble Creek. The initial dedication in Pebble Creek was tied to a certain number of dwelling units 10-15 years ago when the project began. I know that the circumstances were a little different, but now we are feeling the affects because the parkland requirement has changed over the years, but we are not able to require additional parkland. I would suggest in the case of Castlegate, we determine exactly how many acres are required for parkland and how much is required for the development fee with the current proposal and then state in the Parks Board Minutes that any excess can apply toward the future development requirements for any project by Mr. Phillips in the same park zone . Basically, the excess land and development funds may count toward a future requirement, but the developer cannot lock in a certain number of dwelling units at today's requirement. 2. In regard to design and construction of the park, we are looking at this as though it is another piece of City infrastructure, similar to a street. It is required by the Subdivision Regulations, so if it is not in place and accepted by the City prior to the filing of the final plat, then a bond or guarantee is required before the plat can be filed. Once the improvement is approved and accepted by the City the bond can be released. The only difference here is that the approval of the construction plans is by the Parks Board instead of by Development Engineering and that the inspection and official acceptance is by the Parks Department instead of by the Public Works Department. Three of the eight phases have been final platted and filed at the courthouse. Three more have been approved by the P&Z and may be filed in the near future. Another phase has been submitted for review by staff. To address the issue of the Parks Department designing and sealing the construction plans, my thought on the subject is, would we design a street for a developer? Maybe there are some special circumstances that I am not aware of, like maybe we don't have written design criteria for an outside designer to follow, like we do for streets or maybe we want to have the highest possible level of control over park design and implementation. 3.The smaller park at the entrance to Castlegate was platted with the first phase. That property is already the City's. Development Services does not have any type of agreement that would cover the pump/fountain area. At this point, we would suggest discussing with Mr. Phillips the possibility of some kind of maintenance easement with the HOA. I would think that the Parks Board could require an easement of that nature as a condition of approval of the two parks. Hopefully, this discussion will help us not only with the concerns about the project currently before us, but will also help us set a standard process for dealing with future ones. »> Ric Ploeger 07/09/01 03:45PM »> We met with Wallace Phillips this afternoon concerning Castlegate Park. As you know he intends to develop the park himself. This is an option in the dedication ordinance. Mr. Phillips is not in as big a hurry as I originality thought. We intend to show the Parks Board (Tuesday) a conceptual design of the park and explain that we will be back in the future with detailed plans for their approval. A number of issues are yet unresolved. 1. Mr. Phillips wants to know how many dwelling units his dedication will cover. He has plated 391 units Bridgette George - Re: Castlegate Page 2 and at one time proposed 757 for all of Castlegate. He said this may go up or down. He is dedicating 8.26 acres that will cover 834 dwelling units according to the ordinance. Do we give him credit for the 834 and how do we do that officially? As part of the parks board minutes? On the development fee side it is a bit more complicated. If we go with the 834 figure he will be required to build at least $257,706 worth of park amenities. I think he will do that with the site plan that we are currently working from and we can do an estimate to determine that from the final plans. 2. The next issue is one of design. Normally neighborhood park design is done by the parks planning staff & one of the staff engineers reviews and seals the plans. Mr. Phillips wants parks to do the design .This is somewhat of a problem due to the current workload but Mr. Phillips said he can wait. We will check with engineering to see if they can work with us to complete the design and do the inspections and treat Mr. Phillips as if he were a general contractor. I have no idea what type of agreement we would need with Mr. Phillips on this issue. Any ideas? Are we in a hurry from the standpoint of issuing building permits? Mr. Phillips indicated that a letter of credit could be obtained to guarantee the construction of the park. 3. Mr. Phillips has constructed a series of ponds on the smaller park are that are filled by a well. The water will be circulated by a pump from one pond to another. Eventually this will become park property although I do not know when. Do any of you know when this will be? Steve and I had talked to Mr. Phillips about the maintenance of the pumps being the responsibility of the homeowners association but there is nothing in writing about this. Mr. Phillips is interested in this detail being worked out. I am concerned about the future maintenance of this area as it is at the entrance of the development and the neighborhood will expect a high level of care.Does development services have any type of agreement with Castlegate that can be modified to include the maintenance of the pumps? Sincerely Yours, /~zc~~ Wallace Phillips Manager MEMORANDUM August 31, 2000 TO: Planning and Zoning Commission FROM: Jessica Jimmerson SUBJECT: Master Preliminary Plat for Castlegate Subdivision Item: Consideration of a Master Preliminary Plat for Castlegate Subdivision consisting of 338.26 acres located north of Greens Prairie Rd., west of the future intersection with Highway 40. (00-136) Applicant: Wallace Phillips Item Summary: Section 8-0 of the Subdivision regulations state that," All subdivisions shall be provided with water supply and distribution systems for fire protection and domestic use." Staff has not received any details from the applicant showing how water will be provided to this subdivision. The City's master utility plans call for a 24-in water line to run parallel to the future Highway 40. An offsite improvement of over 5000 feet of 24-in waterline needs to be addressed at the master preliminary plat stage. In addition to the offsite waterline, an offsite regional detention facility is also being proposed to manage the site's drainage. Staff has not yet received information for the detention facility. Full construction drawings are not required until the final plat. However, the details for the location of the waterline and the easement, as well as, the detention facility are necessary to meet the master preliminary platting requirements. At this time, staff recommends denial of the master preliminary plat. It is anticipated that the applicant will be submitting the additional information required. Therefore, it is possible that the staff recommendation will change at the podium. Attachments: 1. Area map 2. Application 3. Civil Engineer Castlegate Subdivision Response to Staff Review Comments No.2 The following changes have been made to the plat: • The total acreage has changed from 338.27 acres to 336.60 acres due to revised survey information for the Reserve Tract B area. • The 153.5 acre Reserve Tract A is shown as smaller reserve tracts with the proposed land use per the Master Plan. • The pavement width for Castlegate Drive has been changed to 18' on each side of the median per the PDD-H standards. • The end of the street medians have been moved back from the intersections of the streets to allow for traffic to turn properly. • The water line along Castlegate Drive from Green's Prairie Road to the intersection with Ravestone Loop has been changed from 12" to 8" in diameter. Planning 1. We have tried to make the dimensions more readable. Also, attached is a single copy of the plat with some of the information turned off which will make the dimensions easier to read. Preliminary plats will be required for the reserve tracts. 2. The Owner's land planner intended the "typical" lot sizes presented in the PDD-H zoning applications to be a typical size and not a minimum lot size. We have calculated the lot sizes and the following is a list of the lots which are smaller in area than the typical lot size. Please let us know of the standards which are not the same. 4. It has been noted that the street connecting Green's Prairie and SH 40 will be built with Reserve Tract B. 5. It has been noted in the title block that the current zoning of the reserve tracts is "A- O". The platting of the adjacent properties is also noted. 6. The 6' wide connector trails have been labeled. Engineering 1. The storm sewer, waterlines and sanitary sewer lines are shown separately on copies of the plat which are attached. 2. The storm sewer sizes have been added and the discharge channels are labeled. 3. Channel cross-sections are shown on Sheet 7 of 7. 4. The off-site water line that will provide water to this subdivision is currently being designed by CSC Engineering & Environmental Consultants, Inc. The water line will be located along the north right-of--way of SH 40 and will have lines across SH 40 to serve this subdivision. An oversize participation will be required if the City would like the line to be larger than required for this subdivision. 5. The information on the pipelines has been added to the plat. Electrical. The electrical service requirements are noted on the plat. Land Management 1. The directionals have been removed from the street names. 2. These streets have been renamed on the plat. I have enclosed with this letter a several page diagram of the portion of the Castlegate Subdivision in question so that you can have an idea of the project about which we are making this request. As I indicated to you yesterday, the City of College Station has constructed an impact fee sewer trunk line along Spring Creek. The Castlegate Subdivision will ultimately tie into the Spring Creek trunk line. Unfortunately, there have been some construction delays and problems with the trunk line and there are homes, both completed and under construction, in the Castlegate Subdivision. The first of the homes is scheduled for closing on Friday and the buyers plan to move in on Saturday. Unfortunately, without your authorization letter, the City will not be able to issue a certificate of occupancy. We anticipate that each following week there will be one more house completed and sold. It is my understanding that the final modifications to the Spring Creek trunk line will be completed within the next few weeks. To be safe, we have anticipated 90 days for completion of the Spring Creek trunk line. Ninety days is approximately 13 weeks and it is anticipated that there will be one house each week for thirteen weeks which will be occupied by their owners. Over the course of the 90 days, we have estimated the amount of sewage generated to equal 125,000 gallons. The volume of the sewer lines in the Castlegate Subdivision, as calculated by the design engineer, Joe Schultz RPE #65889, is 25,609 gallons. The diagrams I have included of the Castlegate sections which will be potentially affected by the authorization letter indicate where we estimate the homes will be completed and the order of their Aua-02-01 05:03pm From-Ellison Law 9796938819 T-245 P.04/08 F-318 Page 2 August 1, 2001 completion is indicated by the number assigned to the lot. The number 1 indicates the first home anticipated for completion and so forth. As you can see, our need to obtain the authorization allowing the City of College Station to haul the sewage to its sewer treatment plant is critical. Without that, the homeowners will not be allowed to obtain certificates of occupancy. Thank you foryour expedited consideration of this request. Because of the urgency of this request, would you please fax the letter to me at 979/693-8819 and to the City of College Station Waste Water Division, Attn: Dale Schepers, Division Manager to 9791764-3452. If I am able to receive your authorization letter by noon tomorrow, I should be able to obtain a certificate of occupancy which will allow the new homeowners to close on their home on Friday and move in an Saturday. This memo responds to your request for an analysis of the legal issues involved in this transaction and suggestions for protecting the city's interest in any such contract_ My understandings of the facts related to this issue are set forth below_ Please let me lmow if my factual assumptions are incorrect as this could affect the legal analysis and options for protecting the city interest. A. Factual Background 1. A developer has constructed the wastewater collection system for a new subdivision located within the city of College Station. 2. College Station has accepted the developer's dedication of the subdivision's wastewater collection system for public use. ZOO~j d'I'I 'ptreraa.~g ~g sesaiilBW co i ~ ~~ ~ arc vW.r RT ' i r rn ino ~ ~., 3. The city of College Station used an impact fee agreement to finance construction of the extension of its wastewater main to connect with the developer's subdivision. 4. College Station acquired from the developer engineering plans and specifications for the extension of the city's wastewater main to the developer's subdivision. The developers engineer obtained TN7RCC approval of the plans and specifications under TNRCC's design criteria rules (30 TAC 317). 5. College Station hired an independent contractor to construct the extension of its wastewater main pursuant to the design plans acquired from the developer's engineer_ 6. The city has determined that the independent contractor deviated from the plans and specifications in the construction of the wastewater main extension. The most significant deviation is the failure to maintain the slope required by the design plans. As a result of this deviation the capacity of the line has been reduced by approximately 12%. 7. College Station has made a conditional decision to accept the "as built" line in return for a credit against the cost of the construction contract rather than to require the contractor to repair the defective slope. 8. The developer's engineer is currently working to develop documentation to submit to TNRCC to obtain TNRCC's approval of the "as built" non-conforming line. 9. The date that the city's wastewater main extension to the developers' subdivision ca~i be placed in serviced is not determinable at this time. The contractor must still complete remedial work on the line. Additionally, TNR.CC approval of the "as built" non-conforming line must be obtained before the line can be placed in service_ l 0. The developer is willing to reduce the density of his project in order to conform to the reduced "as built" capacity of the city's main line. 11. Houses in the developer's subdivision are nearing the completion stage. The city and the developer bave been discussing alternative plans for providing wastewater service in order to avoid any unnecessary delays in the release of the certificates of occupancy. 12. College Station is considering a contract with the developer which would allow issuance of certificates of occupancy for homes constructed in the developer's subdivision in return for the developer's assistance to the city in providing for temporary trucking of domestic waste from the subdivision to other points in the city's wastewater collection system until the extension of the city's wastewater mains to tJle subdivision can be completed. l3. One way to accomplish this waste hauling would be pump wastewater from a manhole within the developer's subdivision to a temporary storage tank. A licensed -2- ~OO~J d'I'I 'pueTaa.~,.~ 'A sMatllgW SR!.7. Pnr arc cF~ RT' IT Tn.~~~r~ waste hauler could.be contracted to transport this waste to other locations in the city's wastewater collection system. B. Analysis of Legal Issues 1. Obtaining approval for the "as built" non-conforming lines Texas law requires that engineering plans and specifications for sanitary sewer collection system projects be reviewed and approved by the Texas Natural Resource Conservation Commission (Texas Water Code ~ 26.034, 30 TAC 317.1). TNRCC has adopted rules governing the design of sewage collection systems. Among other things, these rules require: • Sewer lines shall be designed for the estimated future populations to be served, plus adequate allowance for institutional and commercial flows. (30 TAC 317.2 (a)(1)) • New sewers shall be sized using an appropriate engineering analysis of existing and future flow data. (30 TAC 317.2 (b)(3)) • All sewers shall be designed and constructed with slope sufficient to give a velocity when flowing full of not less than 2.0 feet per second. (30 TAC 317.2 (c)(2)) • TNRCC must approve plans and specifications that comply with its criteria and conform to commonly accepted sanitary engineering design practices. (30 TAC 317.1(a)(A~)(a)) • TNRCC may also approve non-conforming applications when the commission determines, after an engineering evaluation of the supporting information provided by the submitting engineers design report that the non-conforming application will not result in a threat to the public health or the arvironmart. (30 TAC 317.1(a)(4)(B)(iii)) Based on 30 TAC 317.1(a)(4)(B)(iii) TNRCC could approve the "as built" line with slopes which do not conform to the desiga criteria if the commission determines this would not pose a threat to the public health yr the environment. TNRCC would treat taus request for approval of the "as built" line as a variance request and could add conditions in order to grant the variance. Atypical condition for this circumstance would be more frequent line cleaning in order to minimize the chance of blockage. 2. Obtaining Approval For Temporary Waste Hauling TNRCC's rules do not specifically provide an approval mechanism for temporary hauling of municipal sewage. However, TNRCC design criteria regulations do provide a mechanism for approving an "alternative wastewater collection system" when justified by unusual terrain or geological formations, low population density, difficult construction, or other circumstances -3- 600 Q] d'I'I~pIIBjaa.zg ~ 9MaglezQ 5R/.7 on - ETC vts.r n~ ~ ~ r T~ ins i i n where an alternative wastewater collection system would offer an advantage over a conventional gravity system. (30 TAC 3172 (d)) This would appear to provide a mechanism for TNRCC to approve temporary waste hauling From the developer's subdivision collection system wztil it can be connected to the cities conventional gravity system. Although this alternative may result ui forma] approval of a temporary waste hauling plan, it may be more time consuming and burdensome than the informal approval process discussed below. TNRCC had also adopted rules gOVernutg transporting and temporary storage of domestic septage. Although there is a distinetioz~ in the rules between domestic septage and domestic sewage, the chief of TNRCC's plans acid specs review team who drafted the rules has advised me that the rules were intended to cover transporting o.f domestic sewage. These rules require that transporters register with the TNRCC (30 TAC 312.124) and provide for temporary storage at a fixed site (30 TAC 312.147.) Although no formal permit is issued, TNRCC's regional office can authorize temporary pumping and hauling of waste according to the chief of TNRCC's plans and specs review team. C. OptYOns for Protecting College Station's Interests Three options for protecting College Station's interests in a contract that would allow the city to issue certificates of occupancy for houses in the developer's subdivision in return for the developer's agreement to assist the city in providing wastewater services are summarized below: 1. Make the developer solely responsible for providing alternate wastewater service- Pros: • Imposes least burden on College Station's time and resources Cons: College Station would have minimal control over developer's implementation of this alternative. Additionally, College Station could remain liable for collection system overflows or improper handling of waste taken from the subdivision's collection system, which has been dedicated to the city. 2. The city .could assume responsibility for implementing the alternative wastewater system on a temporary basis, but require the developer to obtain all regulatory approvals. Pros: • Because developer would bear burden for any delays in obtaining regulatory approval, he would have an incentive to expedite TNRCC approval process. -4- S00~ d'I'I 'pueraa.r; ~ 9MaII1eW 9R/. 7. f'ni ETC v~.t n7:rT Tninr~rn • City would exercise control over operations of alternative wastewater system and thus minimize potential for overflows or spills. Cons • Conditions unposed by TNRCC may impose burden on implementing alternative wastewater system. However, contract can specify that developer is responsible for all costs of implementing alternative system. 3. City could assume responsibility for both obtaining regulatory approvals ar-d implementing temporary alternative wastewater system but requires the developer to be responsible for all costs. Pros: • City exercises greatest control over both regulatory approval process and implementation of the alternative wastewater project. Cons: • City will not control timing of regulatory approval from TNRCC_ Delays could lead to complaints from developer. D. Factors to Consider in Contracting with Developer 1. You may want to limit the number of certificates of occupancy that will be issued under the contract without additional approval. This limitation could be based on the amount of anticipated flows that could be managed by a temporary pump and haul method_ Additionally, by limiting the number of CO's issued you could maintain pressure on the developer to obtain approval of tlae "as built" gravity line. 2. The contract should specify that no certificates of occupancy will be issued until all regulatory approvals for the temporary pump and haul disposal method has been obtained and the city is capable of providing the pump and haul services. 3. The contract should expressively describe the expenses that each party is responsible for. Tbese costs could. include the cost of obtaining the regulatory approvals and the cost of implementing the pump and haul altemative. The city may wish to consider hiring a transporter registered with TNRCC tovmplement the pump anal haul alternative. ,Fldditionally, you may want to consider requiring the developer to place in escrow a sum -5- 9~~ ~ ~i'T'I vuaTaa.z,a ~A SMaII1gW coo ~ 7 rn /`7T(• w.r ~~ • r T T~ inr .. n sufficient to cover the cost of the pump and haul alternative for a rolling three-month period. 4_ The contract should include an indemnity provision requiring the developer to indemnify the city for any liability it incurs in implementing the temporary pump and haul alternative. This indemnity should be broad and include indemnification against fines and penalties for violation of state or federal regulatory requirements. The only exception to this indemnity would be for acts caused by the city's negligent acts or omissions- 5. If the developer has stated a willingness to reduce the density of his project in order to conform to the reduced "as built" capacity of the city's wastewater main, you may want to require this as a condit7on of the contract. (lf density is not reduced, the city could be required to add additional wastewater collection capacity at some point in the future to servo the projected population.) I hope files information is useful to you in evaluating the city's options. If you need any additional information please feel free to call. P_ I Agenda Item Cover Sheet Agenda Item # m Submitted By: ~Tane R. Kee, City Planner uncil Meeting Date:August 9, 2001 r Approval: ity Manager Approval: Item: Presentation, discussion, and possible action on amending the City of College Station Code of Ordinances to provide a process whereby a charitable non-profit corporation may request approval to establish a cemetery, crematory or mausoleum with the City of College Station. Item Summary: This ordinance will provide for the development of the proposed Aggie Field of Honor cemetery, implementing legislation passed in the last legislative session. Any other cemetery that meets the criteria of the ordinance may be permitted as well. House Bill 166 was approved in the last legislative session. This legislation amended the Health and Safety Code to preclude the establishment of a cemetery within certain distances of cities based on population size. Exempt from this regulation is a City with a population of at least 60,000 in a county of no more than 155,000. It states that no later than December 1, 2001 a charitable non-profit corporation may file a written application with the governing body to establish or use a cemetery within the city limits. The City must prescribe by ordinance the information that is to be submitted in any application. The City may then authorize the establishment of a cemetery by ordinance if the City determines and states in such ordinance that the establishment of a cemetery does not adversely affect the public health safety and welfare. This amendment to the City of College Station Code of Ordinances is the ordinance that prescribes what information shall be submitted by a non- profit corporation to request the use of property as a cemetery, crematory or mausoleum. The following is required: • An application with basic information • A sworn affidavit stating compliance with local and state codes • Site layout • Internal traffic circulation • Site access • Interment areas, and • Planned improvements There is also indemnity language and a hold harmless clause required as a condition of approval. Finally the Council must find that the use of property as as a cemetery, crematory or mausoleum does not adversely affect public health, safety and welfare and that the property is located in an area with limited urban growth potential. Staff Recommendation: Approve code amendment as submitted. Council Action Options: Approve the ordinance as written, modify the language or deny the ordinance. Supporting Materials: 1.
