You'll recall this issue came to our attention because the Health Department expressed concerns over the septic systems on Marshall Lane (We can provide you with the letter if you'd like). As we've discussed, we're prepared to look at contributing funding if possible. We're not able, however, to jump-in and make any decisions on the engineering or infrastructure issues. We did meet several months ago with Public Utilities staff at the site and they determined that there were several ways to extend sewer to the site. There are two or three manhole locations within a "stone's throw" of these properties. Additionally, since there is a new commercial development right next door, I'm assuming the service will be even closer to Marshall Lane. If Public Utilities/Engineering/Planning can decide on the best way to extend the services, we'll look at providing eligible funding. By the way, we're looking at categorizing these as Emergencies, so if each of the three families turn out to be eligible, we'd have about $18,000 to $20,000 to potentially contribute to the sewer line extension. None of our funds could be used for the easement acquisition however. There's one other issue we need y'all to help us address -that is whether this extension would benefit any other property owners other than our applicants. If so, then it may be more difficult or impossible for us to use CDBG funds. In that eventuality, I'd hope that the City would still look at providing sewer services to these citizens, especially given their proximity to existing services. Finally, we'll defer decisions on easement questions to whoever typically processes easement acquisitions. Please keep us posted as y'all debate these issues. We'd like to attend any meetings that would be appropriate for us. We'll let you know ASAP on any developments regarding the families eligibility as Emergency applicants. (00-130) Item Summary: The applicant is proposing to incorporate approximately 3 additional acres into the existing development plan. The existing plan shows approx. 3 acres of commercial property along Navarro. The step-down approach was used here, with C-N zoning on the 2 acres closest to the residential duplex development and 1 acre of C-1 zoning on the corner. The applicant is proposing to expand the step-down approach. The 6 acres in the new request provide 3.5 acres of R-3, Townhome Residential adjacent to the existing duplex development. This new rezoning proposal would actually reduce the overall amount of commercial property at this intersection from 3 acres to 2.5 acres. The Land Use Plan does show this area as High Density Residential, with some Mixed Use further north on Wellborn, closer to 2818. The property is currently bordered to the west by Wellborn Road and the Railroad tracks, to the north by property zoned A-O, which has some existing residential use, to the east by R- 2, duplex, which is part of the Steeplechase Master Plan, to the south by R-1 file://O:\GROUP\DEVE SER\CVSHT\August 24, 2000\steeplech...\steeplechase cvrsht.ht 10/18/2000 Page 2 of 3 and A-O. The R-1 is also part of the Steeplechase Development. Discussions did occur with the applicant about the possibility of using a PDD zoning. At this time the developer does not wish to limit the uses and restrict the site layout to the degree required by a PDD application. However, the applicant has expressed a willingness to provide buffer areas to mitigate any possible negative impacts to the adjacent residential development. Item Background: It appears that this property was annexed by the City in 1995. The developer master planned and rezoned this property in 1998. Before the developer plats this area the parent tract for the additional 3 acres will need to be shown on a preliminary plat or master plan, depending on the configuration of the parent tract. Staff Recommendations: Staff recommends approval of the rezoning with buffers as recommended by P&Z. P&Z recommends a 15 foot buffer area between the R-3 and C-1 and between the adjacent A-O and C-1 with a 6 foot wooden fence having masonry columns and substantial landscaping in the buffer area. The developer should determine whether to incorporate the buffer on the C-1 or R-3. Staff requests additional direction as to what should constitute "substantial" landscaping. The R&D zoning district buffering requirements do provide guidelines for the quantity and type of plantings per linear foot. Staff suggests applying the 25-foot buffer area requirements to the buffers in this project. Related Advisory Boards: The Planning and Zoning Commission considered this proposal on August 3rd, 2000. They recommend approval with the buffer conditions described above. The meeting minutes are attached. Council Action Options: 1. Approval of rezoning as submitted. 2. Approval with physical conditions that will mitigate negative impacts. 3. Approval of a less intense zoning classification (only if recommended by PNZ). 4. Denial. 5.
