AN ORDINANCE AMENDING CHAPTER 12, "ZONING", SECTION I, "ESTABLISHMENT
OF DISTRICTS, PROVISION FOR AN OFFICIAL ZONING MAP", OF THE CODE OF
ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE
ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES AS
DESCRIBED BELOW; DECLARING A PENALTY, AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That Chapter 12, "Zoning", Section I, "Establishment of Districts, Provisions For An
Official Zoning Map", of the Code of Ordinances of the City of College Station,
Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this
ordinance for all purposes.
PART 2: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000.00). Each day such violation shall continue or be permitted
to continue, shall be deemed a separate offense. Said Ordinance, being a penal
ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

follows:
The following property is rezoned from A-P Administrative-Professional, C-3 Planned
Commercial, C-1 General Commercial, R-1 Single Family Residential to PDD-B,
Planned Development-Business.
10.255 acres being all that certain tract or parcel of land lying and being situated in
College Station, Brazos County, Texas, said tract being all of Lot Four (4) and a
portion of Lots One (1) and Two (2), Block Four (4), Anderson Ridge Subdivision,
Phase Four (4), according to the plat recorded in Volume 795, Page 257 of the official
records of Brazos County, Texas, being more particularly described in the attached

subsequent assessments for that and prior years due to change in land usage,
ownership, or both, the payment of which GRANTEE assumes.
2) GRANTOR reserves unto itself an exclusive temporary eonstruetion
easement on, across and over the Property, save and except the tut around area
which is depicted and labeled in the site plan attached hereto as Exhibit B (the
"Turnaround Area") to erect, construct, install, and inspect a water towec and
connecting lines, access facilities, and related equipment, all to be located on the
adjacent property owned by Grantor. The Turnaround Area shall be Iocatcd s
minimum of 350 feet away from the East property tine abutting Park Place and a
minimum of 40 feet away from the western property Iiae of Lot 1 all as described
in a deed dated of even date herewith from Montana Microgroove Associates to
the City of College Station. The temporary construction easement shsll terminate
25 months from the date hereof, GRANTOR agrees to install temporary fencing
around the turnaround area for the duration of the construction easement or until
completion of construction, whichever occurs first.
GRANTOR shall require its independent contractors to maintain public liability
insurance cdverage on the exclusive easement area of the Property. GRANTOR
shall additionally require its contractors to indemnify and hold GRANTEE and its
lessees,. tenants and assigns harmless from and against all loss, liability, and
orpensc of whatsoever nature (including reasonable attorney's fees) to persons or
property caused by, arising out of or otherwise related to the contractors negligent
activ~tres on the Property for the duration of this easement.
Except for damage caused by GRANTEE, its lessees, tenants or assigns and
provided that the temporary construction casement area has not been paved or
otherwise improved by GRANTEE, its lessees, tenants or assigns, GRANTOR
hereby agrees to promptly restore the temporary construction easement yea to its
original condition on the date hereof, solc[y at GRANTOR's expense.
GRANTOR and GRANTEE tech respectively agree to minimize any disruption
to each other's operations for the duration of this temporary conswct~on
easement.
GRANTOR, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty GRANTS, SELLS, and CONVEYS to GRANTEE the Property,
together with all and singu~ar the rights and appurtenances thereto in any wise belonging, to have
and hold it to GRANTEE, GRANTEE's heirs, successors and assigns forever,
