Please allow this letter to serve as a request of the owner to extend the Development Agreement dated November 24, 1992, and extended in November, 1995. I have enclosed a proposed Addendum To Development Agreement which is identical to the one approved in 1995. The reason the Development Agreement was originally granted was twofold. First, there were ongoing hydrology studies which everyone knew would impact the location of the floodway. Those studies and a Letter of Map Revision are pending at the Federal Emergency Management Agency and, as a result, the actual location of the floodway is still undetermined. Second, it was advantageous to delay the platting and dedication until the private development could relate to the park development in a manner that was advantageous to both the public and private sector. As you know, the plans for Wolf Pen Creek Corridor are still not completely resolved and it is necessary to extend this Development Agreement. My first reaction is that they will have to go back to the Design Review Board because none of the site proposals that the Board saw this summer showed three 8 foot in diameter signs on the building. As I recall, the only signs indicated was on the storefront and a directional sign for the drive-thru. The applicant expects to have at least one additional DRB review and is therefore seeking preliminary comments at this time. Staff and the applicant request that the DRB members that are present on July 5 also plan to attend any future meetings if needed. Most of the site was developed in the early 1990's when Wolfe Nursery built the first major development in the WPC zoning district. The existing site features such as circulation aisles and parking spaces are therefore not coming under review. At this time, the applicant is not proposing to change the building color. New site features, such as the building expansion and the proposed parking addition are subject to DRB and P&Z review. The landscaping also comes under review because most of the landscaping that was installed with the nursery has died. The standards of approval to be used by the DRB and P&Z on WPC projects are found in Section 7.21 E. of the Zoning Ordinance. These include the following: 1 provide additional parking. He intends to provide 30 additional parking spaces before opening and has an alternative plan to provide up to 39 additional spaces for future overflow parking. The applicant intends to provide 66% of the parking required and to request a parking variance of the Zoning Board of Adjustments for the remaining 34%. The applicant will also provide 30 motorcycle and 10 bicycle spaces, which cannot be counted toward meeting the parking requirement under the ordinance, nor can the 39 future spaces count unless they are installed before opening. However, the ZBA may take these conditions into consideration for the parking variance request. In effect, the applicant is proposing to provide 82% of the parking, counting the bicycle and motorcycle parking. The additional future parking of 39 spaces would bring the total of parking provided to 96%. These numbers may change somewhat with a revised site plan, which will include changes to meet both Staff review comments as well as DRB comments. The parking variance request will be similar to the Rudy's restaurant parking variance, which was recommended by the DRB in an effort to encourage more design flexibility on that site.
