Project: EAGLE AVENUE CHURCH OF CHRIST (CUP) (0-114)
1. Scale is off on several dimensions.
2. Label current zoning of all abutting parcels.
3. For the proposed driveway, give the separation distances of opposite and
adjacent driveways.
4. Indicate driveway throat length.
5. Are all the easements shown? Utility lines must lie within easements.
6. If the site does not contain any floodplain, a note reflecting that fact must be
placed on the site plan. (According to FEMA map.....dated.....)
7. Show meter and transformer locations.
8. Label the setback lines. (ex. 7.5' side setback line)
9. Need 360 sq. ft. of interior parking islands.
10. The end islands shown must be 360 sq.ft. The ordinance states 180 sq.ft.
per parking row, the middle aisle contains two rows.
11. Where is the solid waste container? A container, with screening, will be
required.
12. The City requires #4 bars on curb detail.
13. Label Eagle Avenue on all pages of site plan.

15. Canopy trees must have a minimum separation distance of 20 feet (trunk-to-
trunk).
16. Irrigation is required; please show a general irrigation plan.

18. What type of landscaping will the parking islands contain? Parking islands
may not be concrete.
*NOTE* The Planning and Zoning Commission may also impose reasonable
restrictions or conditions such as an increase in the amount of landscaping and
parking.

STAFF REPORT
Item: Public hearing and consideration of a Conditional Use Permit, site and use for a
religious facility, Eagle Avenue Church of Christ to be located at 1815 Eagle Avenue.

Applicant: John Rhodes for Stylecraft
Item Summary: The applicant is proposing to construct a 2,000 square foot religious
facility to be used weekdays and weekends during the day and evenings for various
church and related activities. The proposed hours of operation are on Sundays 9-1 lam
and 6-7pm and on Wednesdays from 7:OOpm-8:15pm. In addition, afull-time minister
will utilize the building Monday through Friday from Sam-Spm. The church currently
has approximately 15 members. At this time no daycare or playground usage is
anticipated. The church would need to come back to the Planning and Zoning
Commission for a new Conditional Use Permit if such usage is proposed at a later date.
The proposed church is to be developed on approximately one acre out of a 5.751 acre
tract that is currently zoned C-1, General Commercial. The total tract is split into two
sections by a 30' Public Drainage Easement. The section to the east, which fronts to
State Highway 6, is approximately 3.652 acres and is currently developed as the office,
showroom and model homes for Stylecraft Builders. The approximate one-acre to be
developed for the proposed church is part of the remaining 2.099 acre section to the west
of the easement. The church is reserving the remainder of the section for possible future
expansion. The tota15.751-acre tract currently has the same property owner. If a
separate owner purchases any of the sections/phases, a replat will be required.
The subject property is adjacent to R-1, Single Family to the west and to the south across
Eagle Avenue. As stated earlier, Stylecraft Builders has developed the portion of the C-1
tract to the east. The Land Use Plan shows Single Family Residential in this area.
Religious facilities are allowed in any zoning district with a Conditional Use Permit
granted by the Planning and Zoning Commission.
Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to appropriate
conditions and safeguards, when after public notice and hearing the Commission finds
that:

1. "The proposed use meets all the minimum standards established in the ordinance for
the type of use proposed." Staff conducted a technical review and found general
compliance with development regulations with the exception of items listed in Staff
Review Comments #3.
2. "That the proposed use meets the purpose and intent of the ordinance and is in
harmony with the development policies and goals and objectives as embodied in the
Comprehensive Plan for Development of the City. The request is in compliance with
the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, nor be substantially or permanently
injurious to neighboring property." It is my understanding that the applicant has met
with the Homeowners Association regarding the proposed use and site. The public
hearing is an opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to carry out
the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use.
These requirements may include, but are not limited to, increased open space, loading and
parking requirements, additional landscaping, and additional improvements such as
curbing, sidewalks and screening." A six foot wood fence and a 20' Public Utility
Easement currently separate the subject property and the R-1 Single Family Residential.
The Planning and Zoning Commission may impose more screening and buffering to
separate these two uses.
Unless the public hearing brings to light any new information indicating potential
negative impacts, Staff recommends approval with the condition that Staff Review
Comments #3 be addressed.
Commission Action Options: The Commission has final authority over the Conditional
Use Permit and associated site plan. The options regarding the use permit are:
1. Approval as submitted;
2. Approval with conditions relating to specific site characteristics or with time
limitations;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.

INFRASTRUCTURE AND FACILITIES
Water: Adequate water service is currently provided to the site by a 12 inch
water line that runs along Eagle Avenue.
Sewer: Adequate sewer service is currently provided to the site by an
existing sewer line that runs through the subject property.
Streets: The subject property will have adequate access via a driveway onto
Eagle Avenue, a local street, that intersects with State Highway 6.
Off-site Easements: A 20' Public Utility Easement on the west side of the
property separates the C-1 tract with the R-1 Single Family tract.
Drainage: All drainage is oriented toward the existing 30' Public Drainage
Easement located on the east side of the site.
Flood Plain: None.
Oversize request: None anticipated.

Response Received: I have had several inquiries. Most callers did not indicate
an opinion for or against the proposed church, however I have had three callers
who are concerned with potential traffic impacts.
