.~ .: i ~~ ~~` MEMORANDUM Datie: 05/24/2001 To: Mark Smith, Director of Public Works C~ Mark McAuliffe, Land Agent / Sabine Kuenzel, Senior Planner t/ Fromm Judith A. Downs ~D R~ Davis McGill Greenway Daryl Grein came in this morning to discuss his proposed development of the Davis McGill trail. He apparently does have the land under contrail with Mr. McGill, and has 60 days to dose after June 11. I requested Mr. Grein provide us with a copy of his power of attorney to ad on Mr. McGill's behalf. Mr. Gtein stated that Davis McGill and his partners have offered to sell the entire property to him for .90/sf. Our offer to purchase the greenway was made at .74/sf for 6.44 acres, which amounted to $252,473. Mr. Grein proposed that he retain a portion of the greenway to increase his road frontage, which will reduce the 6.44 acres, and that we pay him .90/sf. I asked Mr. Gtain to make his counter offer in writing for the City's action. Attached is the proposed layout for the site. I encouraged Mr. Grein to indude the 11 lots that abut the greenway in the sale of this property, which should retain most of the 6.44 acres contained in the 100- year floodplain. Mr. Grein was interested in discussing other land use aspects of the site with me, even though I told him they were issues he would have to take up with development services. For your information, I'll just pass them along. He is proposing single family use of the property, he discussed constructing a pool and making it large enough to be available to the Raintree subdivision if they are interested. He has proposed that Appomattox continue on as a through street. When Sheila Faye called, she said that Daryl had a "short fuse" on his contrail. Apparently, his earnest money will go "hard" after June 11. I'm not sure what that all means to us, but he did seem an~dous that I would be out of town until June 12. Ventures, Inc., we respectfully ask that this rezoning request, which was tabled an August 24, 2000, be removed from the table at the next council meeting. We have already endured numerous administrative delays in this process since our submission of June 8, 2000 and therefore seek a speedy, favorable resolution of this matter. To address concerns raised by members of the council and the public, we are willing to accept the star's recommended zoning designation of R-1B for this 5.08-acre tract. This also follows the citizen comments from the council meeting of August 24, 2000, as well as being congruent with the draft East Bypass Area Plan. There are several reasons to proceed with this process rather than wait for the East Bypass Area Plan to be fonnalty adopted: 1. Tlrere is no issue of uparkland purchase': This tract has been for sale on the open market for more than ten years. This tract Itas been offered to the City for purchase in several discussions between Mr. Grein and various members of the staff. At no time has the City of College Station ever indicated by official act, that it was interested in a fair market value purchase of the entire tract. Based on this, there is no public purpose served by further delay. 2. _Tbe R-1B tlesi,~nnlion meek the slates! concerns. As e:cpressed by Humorous council members, local residents and City staff, the cntx of the land use question pertaining to this parcel is to avoid damage to property values in the Raintree Subdivision. Even though we feel it is excessive in this case, htr. Grein has agreed to the R- I B designation to avoid more delay. Our acquiescence to a designation of this 5.08 acres as R-1 B should remove, once a:id for all, those concerns. 3. The P&Z has already improved a mole iniertsive rrse for this cite. A R-1B designation will be less intense than the Planning and Zoning Commission recommendation of R-1 and is in accord with the recommendation of the draft plan (Item 2, page 18, page 19). Notice was made by facsimile and by certified mail. ~ ~"'' !~-~_~- -~_.~~~` ~'-~ -~s° ~ '~ • The failur comply with this section'~the results ~rcmrthe excavation of a portion of an existing~embankment and stockpiling of fill materials. The enforcement provision of this section of the City Code requires that "...the Administrator shall issue a written Notice of Noncompliance to the owner. The notice shall include a description of the nature and location of each alleged violation of this chapter, and, if readily apparent, the measures required to bring the development into compliance with the provisions and requirements of this chapter. The notice shall give a specific time allowance to the owner during which he must take one of the following steps to bring the development into compliance with this chapter". The notice gave five working days to submit an application for the necessary development permit. In order to receive the permit, they will have to demonstrate that the work completed to date, and any additional proposed work will not have an adverse impact on area drainage and will not cause erosion and siltation of the downstream area. They will also have to submit plans for any remedial work necessary to limit erosion potential from the work already completed. As you know, your client's rezoning request was tabled by the College Station City Council on August 24, 2000, pending consideration of the East Bypass Small Area Action Plan. This plan is scheduled to be presented to the Council on September 28, 2000, pending action by the Planning and Zoning Commission on September 21, 2000. Your client's item could be placed on the September 28th Council agenda as well. There are two alternatives for you to consider in response to your request to put the item back on the agenda. One alternative would be to place the tabled rezoning on the Council's September 28th agenda. The item would be placed so that the East Bypass Plan would be considered prior to the tabled rezoning. Council could, if it decided by majority vote, take the rezoning off of the table. Council could then consider the item as an R-1B alternative to the requested R-1. I would advise you that in recent years, Council has referred revised proposals such as this back to the Planning and Zoning Commission for consideration and recommendation prior to Council action. Another alternative would be to schedule a new zoning hearing before the Commission. You may submit this as an R-1B if you like. This could be heard by the Commission on October 5, 2000. We will waive the application fee if you would like to pursue this alternative. I feel this alternative may save your client time given the possibility that Council could refer the case back to P&Z for consideration and recommendation. You are correct in you assessment that R-1B single family density would be consistent with the pending East Bypass Small Area Action Plan. This plan is scheduled to be presented to the Council on September 28, 2000, pending action by the Planning and Zoning Commission on September 21, 2000. Your client's item could be placed on the September 28`h Council agenda as well. There are two alternatives for you to consider in response to your request to put the item back on the agenda. One alternative would be to place the tabled rezoning on the Council's September 28~' agenda. The item would be placed so that the East Bypass Plan would be considered prior to the tabled rezoning. Council could, if it decided by majority vote, take the rezoning off of the table. Council could then consider the item as an R-1B alternative to the requested R-1. I would advise you that in recent years, Council has referred revised proposals such as this back to the Planning and Zoning Commission for consideration and recommendation prior to Council action. Another alternative would be to schedule a new zoning hearing before the Commission. You may submit this as an R-1B if you like. This could be heard by the Commission on October 5, 2000. The Planning and Zoning Commission supported his request despite the recommendation of the City Planning Office to deny, modify, or table it. Grein's proposal appears to cram as many houses as possible into the tract so that he and the other speculators can maximize their profits. There was confusion about flood plain vs. flood way at the P&Z meeting. At one point Grein stated that he would not fill in the flood plain but his colleague indicated earlier that they would. If 55 houses were placed above the flood plain, the house density would be three times that of adjacent Raintree. Furthermore, absolutely no evidence of environmental concerns was apparent. Raintree residents are concerned that their neighborhood will suffer from this proposal, both financially and environmentally. We wish to clarify what his proposal actually is and to identify how we might still alter his plan. 1. Just what, in fact, is he proposing? Are there plans we can see? Specifically: a. Is he filling in the flood plain? Just extending Appomattox would require fill. b. Can Appomattox be extended any way Grein wishes? To the frontage road? c. What other access to the frontage road is proposed? d. What is the lot size, house density, house separation, house quality? Rentals? e. What about drainage? And the existing pond? What about the trees and shrubs along our houses and Wolf Pen Creek? g. How soon could he start development (for those of us who would move)? 2. How does Grein's proposal mesh with the East Bypass Development Plan? 3. Can the City even exercise control over the details of an R1 development? 4. L. Grein, acontractor/developer from the Houston azea, is seeking to rezone a plot of ground north of the Raintree Subdivision. Part of this property is already zoned R-1 and the rest is zoned A-O. I live at 7701 Sherman Court. My property shares a portion of a sizeable pond with Mr. Grein's property and the property of Boyd Sorell who resides at 7704 Sherman Court. It is my understanding that Mr. Gein is planning on Filing the pond. Mr. Grein has never talked to either Mr. Sorell or me about his plans for the pond. For that matter, neither has anyone from the City. It seems to me that the city needs to cleazly define the legal ramifications of any plans for the pond. I do not believe that Mr. Grein should have the right to azbitrazily eliminate the pond and water from the other two properties. There are several problems that need to be clarified. The City staff originally did not recommend approving the rezoning but the rezoning committee approved the request. I am not necessarily against the rezoning, but I think the developer of the property needs to work with all parties so that our rights are protected. Item: Public hearing and consideration of a rezoning of approximately 5.08 acres located adjacent to the Raintree Subdivision from R-1 Single Family Residential and A-O Agricultural/Open Space to R- 1Single Family Housing. (00-110) Applicant: Application is in the name of Greg Taggart for Darrell Grien and Davis McGill Item Summary: The 5.08 acres included in this request are part of the larger 14.23 acre tract that was considered by the Commission in July of last year for an apartment complex. The Commission and Council denied the rezoning due in large part to the reluctance to introduce apartment uses in this area of the City. The larger tract was annexed in two separate years - 9.15 acres were annexed in 1971, when property came into the City as R-1; the subject 5.08 acres came into the City as A-O in 1977. Both the R-1 on the adjacent property and the A-O on the subject property were considered holding zones. The subject property as well as all adjoining properties are reflected as mixed use on the Land Use Plan. The classification is often used in areas where infill development could have a negative impact on existing neighborhoods. The appropriate zoning districts for tracts that are so designated on the Land Use Plan are either one of the four PDD districts or a zoning that would assure development that is similar to adjoining land uses. The subject property is located immediately adjacent to the Raintree subdivision, which is zoned R-1 file://O:\GROUP\DEVE SER\CVSHT\August 24, 2000\raintree rezoning\CoverSheet.htm 10/18/2000 Page 2 of 4 Single Family, and is developed as a single family neighborhood with the typical lot size ranging from about 9000 to 14,000 square feet. A few lots are zoned R-lA along Butler Ridge, and were built as patio homes with a typical lot size of approximately 7000 square feet. However, all of the remaining lots in Raintree would meet the recently created R-1B designation, which has a minimum lot size of 8000 square feet. The applicant is requesting a rezoning to R-1, which would allow lots of as little as 5000 square feet. Staff has not seen a recent proposal for a subdivision of the subject property. Unless a PDD is presented for consideration, Staff would recommend that any rezoning of the subject property be to a zoning classification that is similar to the existing density of the Raintree area, which is the R-1B. Sound zoning practices discourage a piecemeal approach to zoning, and Staff therefore typically expects property under the same ownership to be submitted for rezoning at the same time. The 9.15 acres located to the west are under the same ownership, and have historically been associated with the subject property with previous rezoning proposals. Therefore, if the Commission recommends a zoning designation other than the requested R-1, Staff would recommend that the City initiate rezoning of the adjoining 9.15 acres to the same zoning district as is recommended for the subject property. This property includes part of the floodplain and floodway of Wolf Pen Creek. The developer has indicated that it is his intention to reclaim floodplain. This section of the creek is shown on the Greenways Master Plan as a Suburban Greenway with a priority ranking of #5. The functions of a Surburban Greenway are to primarily provide for flood control, recreation and transportation. It should be expected that there will be moderate to high levels of use and that these greenways will act as connectors to other locations of activity. The width should ideally include the entire floodplain or what can reasonable be obtained if there is existing development. No drainage development permit has been turned in for review as of this time. Under the City's drainage ordinance an additional review time of 60 days is provided for when a permit for reclamation of certain creeks is submitted. These locations include this section of Wolf Pen Creek to its confluence with Carters Creek. There is no ordinance authority at present to require preservation of the floodplain in this circumstance. Staff has indicated the City's desire to preserve this floodplain if possible and to avoid reclamation. At present nothing has been resolved. Item Background: The City is currently conducting a study of the East Bypass area to determine, among other needs, appropriate land use classification for the infill areas. The study is on-going and will be presented to the City within the next few months. The subject property was annexed in 1977. Until recently, there has been no development pressure on this particular property. On January 21, 1999, the Planning and Zoning Commission considered a file://O:\GROUP\DEVE SER\CVSHT\August 24, 2000\raintree rezoning\CoverSheet.htm 10/18/2000 Page 3 of 4 rezoning of the subject property, the 9.15 acres, as well as adjoining tracts to the north and south. The applicant had requested a combination of commercial, apartments, and townhomes. Staff had recommended denial of the request due to the fact that the Land Use Plan and Development Policies support only PDD zoning in mixed use infill cases. The Commission recommended denial as well, and the applicant returned to the Commission on July 15, 1999, with a request for PDD-H. The request consisted of an apartment complex and townhomes. That request was denied by the Commission and then by Council on August 12, 1999. Budgetary & Financial Summary: N/A at this time. As a part of the platting process, the applicant may opt to request Oversize Participation of the City Council for any larger water/sewer lines that may be required. Staff Recommendations: Staff recommends that the R-1 request be denied without prejudice in order to give the applicant the opportunity to return with either an R-1B or single family PDD-H for the entire 14.23 acres. Related Advisory Board Recommendations: The Planning and Zoning Commission held a public hearing on August 3 and recommends approval of the R-1 request by a vote of 5 to 2 with the condition that the floodway remain zoned A-O. Council Action Options: 1. Approval of rezoning as submitted. 2. Approval with physical conditions that will mitigate negative impacts. 3. Approval of a less intense zoning classification (only if recommended by PNZ). 4. Denial. 5. Denial without prejudice (waives 180-day waiting period). 6. Table indefinitely. 7. CITY COUNCIL MEETING your attotdance is needed to help show support for our neighborhood and voice our concerns with development of tlr property adjacent to Raintree to the north. The Planning and Zoning commission approved for this property to be rezoned to R-1, now it goes before the City Council. R-1 (single family) is better than the original multifamily apartments that were originally proposed for that area but there are still some con- cerns: R-1 is single family, but there is no limit on the do><sity of houses or the size of the lot. The proposed density of this new development would be 3 times that of homes in Rain- tree cucroitly. • This new plan does not address flooding and drainage is- sues brought up at many previous P&Z and Council. 'This development could mean the opening and extension of Appomattox to the Highway 6 frontage road and the increase of traffic through Raintree. A PDD (Planned Development District more specific plans required for development) or an R-1B zoning (largo- lot size) would be more appropriate for this praperry.
