Laauwe Date: 06/20/00 Staff Review Comments Page 1 of 1 STAFF REPORT Item: Public hearing and consideration of a Conditional Use Permit for Vickie's In- Home Group Day Care located at 1011 Hereford Street. This request is to allow an in- home child care facility within the single-family residence. (0-109) Applicant: Vickie Zamzow Item Summary: Child care facilities may be permitted as conditional uses in any district upon approval from the Planning and Zoning Commission. The applicant is requesting permission to operate a child care facility in her home located at 1011 Hereford Street. The applicant currently has a Registered Family Home in which she cares for six (6) unrelated children. Ms. Zamzow wishes to upgrade her child care business to a License Group Daycare which would allow her to take care of up to an additional six unrelated children. This increase in number of children necessitates compliance with the child care facility provision of the Zoning Ordinance. Item Background: The Zoning Ordinance defines a child care facility as "any facility or premises where seven (7) or more children under sixteen (16) years of age regularly attend for purposes of custody, care, or instruction; and which children are not members of the immediate nuclear family of any natural person actually operating the facility or premises." Ms. Zamzow currently has two children in her immediate family. The applicant proposes the child care facility to have hours of 7:30am to 5:30pm, Monday through Friday. The ordinance and state licensing allows in-home child care for twelve (12) non-related children, however the applicant has expressed an interest in taking care of only an additional four or five children. This would increase the overall total ofnon-related children to ten or eleven, respectfully. The applicant has addressed an interest in hiring either one full-time employee or two part-time employees to help provide care for these additional children. Hereford Street is a residential thoroughfare in the commonly known Southside area. The proposed location of the in-home child care, at 1011 Hereford, is the third house on the northeast side from Holleman Drive. The applicant has stated that the home's location near Holleman, a minor arterial, will lessen the potential traffic impact to the neighborhood. In addition, the applicant has noted that parents arrive at varying times throughout the day to drop off and pick up their children, which also lessens the traffic impact. Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) 1. "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." Currently, the subject property has four off-street parking spaces. The applicant has indicated that one will be used for the residence, one for a potential employee, and two for the pick up and drop off of children. 2. "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." :• The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Unless the public hearing bring to light any new information indicating potential negative impacts, Staff recommends approval. Commission Action Options: The Commission has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Approval with conditions relating to specific site characteristics or with time limitations; 3. Denial with specified reasons for denial; 4. Table; or, 5. Defer action to a specified date. Streets: The subject property has 100 feet of frontage on Hereford Street and is provided access through a private driveway. Off-site Easements: None Drainage: Drainage is adequate for proposed use. Flood Plain: Subject property is not located within a flood plain.
