DRIVE EAST, COLLEGE STATION, BRAZOS COUNTY, TEXAS. ~'~ ~ .~~~~
BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF COLLEGE STATION,
TEXAS:
PART l: That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A" and `B" attached hereto
and made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000,00). Each day such violation shall continue or be permitted
to continue, shall be deemed a separate offense. Said Ordinance, being a penal
ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

and tradition, Knox has crafted the definitive artwork for 7exar ABM University,
~ with intricate creations that call to mind the splendor of AVM's past and present.
o Knox was born in 1968 in Lubbock, Texas andgrew up on his mother's horse farm.
a But, Aggieland beckoned, and he served in the Gorps of Cadets, graduating from
Texas At~M in 1993 with a degree in architecture. Along the way he developed his
artistic skills with prints for the Corps and the University for two reasons: first to
satisfy his creative cravings, and second, to pay for school.
The interest in Knox' s artwork grew, and upon graduation he opened the first
artist-owned gallery in College Station. He began expanding his unique scope to
include creating artistic treasures for other universities. Known as the University
Artist®, Knox is a positive advocate for education. He uses his work to set up
numerous scholarship funds at each university that he portrays across the nation.
Now comes yet another honor, with the selection of Knox as the creator of the
artwork for the George Bush Presidential Library's commemorative first day cover
and fine art prints. Knox's creations represent the distinguished grace of former
President Bush and commemorate the deduction of the Bush Library.
It's a prestigious honor when an ABM graduate can become a truly integral
contributor to the history of the University. With his eloquent artistic style, his
admirable work ethic and unquestionable pride in wearing the Aggie ring, Knox and
his work are now part of ABM traditions.
The University steps into a new ring of honor and traditions with the opening of
the Bush Library. Knox's art is a splendid representation, not only for Texas ABM,
but for people around the world.

After concept sketches.and designs are created, Benjamin
formulates the final idea for a painting or drawing. He then

FOOTBALL CHAMPIONS and Dat Nguyen
were honored at the Texas State Capitol on March
10, T 999. Benjamin presented the original drawing
"Heart of a Champion" to Dat Nguyen on the floor
of the House of Representatives by invitation of .

The 199$ Aggieland Yearbook featured
Benjamin's painting "The Century Tree" on the
cover. A limited edition of 950 fine art prints is still
available, but soon. to sell out.
Hullabaloo in the Kitchen II is.a new cook-
book created by the Dallas County A&M' Mother's
Club. #o benefit Aggie scholarships. It features
Benjamin's artwork, over 600 family recipes, Spirit of
Aggieland section, and Twelfth Mom's Helpful Hints.
. Dianne Mayfield, President of the federation of
Texas A&M University Mothers' Clubs commissioned
.Benjamin to create an art piece that honors
J.V.. Pinky Wilson '20, author of the
Aggie War Hymn. The artwork was used on
her yearbook cover and presented to the Texas
.Aggie Band to hang in the band hall. Forty-
, eight Giclee art prints quickly sold out.
Benjamin's artwork was also featured on the
cover of the Class of'03 Freshman handbook.
The Texas A&M Student Recreation Center used
Benjamin's painting of the Recreation Center to
promote their "Walk of. Champions Brick
Campaign". The painting ,was also used as the
image on the.trophies awarded at the U,S. Open end
World Cup swim meets held at the Recreation Center
on December 1-5, 1998,
The Inaugural Basketball Game at Reed
Arena was November 13, 1998.:Benjamin created
the commemorative ticket for the Texas A&M Athletic
Department and a limited edition of 650 art prints was
created from the watercolor painting. .
Muster -Benjamin was the guest speaker for the
Texas A&M Club of Southern California in Los Angeles
for Muster 1998. He is the guest, speaker for the La
Grange A&M Club Muster 1999. His artwork was
also used for the 1998 Texas. A&M Muster poster.
DANGER 79ER is a new statue of lt. Gen. James F.
Hollingsworth '40' - "most decorated Aggie in history," ,The
statue is set within the Quad of the A&M campus. In the above
photograph Benjamin, General Hollingsworth and his wife
Janie, and Houston sculptor Larry ludtke celebrated the
unveiling ceremony on September 10, 1999. Benjamin also
presented the original painting "Danger 79er -Inspired.
by Greptness" to Janie and General Hollingsworth after the
unveiling. Seventy-nine Giclee art. prints, each signed by
General Hollingsworth and Benjamin; have been created from
the original painting.
TEXAS A&M WOMEN'S ATHLETICS
celebrated its 25th Anniversary on October 1; 2,
1999. The Athletic Department commissioned
.Benjamin to create•the .commemorative art prints,
Benjamin presented three of the Giclee artist proofs
to Texas A&M President Ray Bowen; Athletic
Director Wally Groff, and Senior Associate Athletic
Director Lynn Hickey. The ceremony wps held on
Kyle Field .during halftime of. the A&M/Tulsa
football game on September 18, . 1999.

THE JOHN L. HAGtER CENTER.is the new home for the Texas A&M Foundation on the
A&M campus. •At the building dedication on October 30, 1999, the Texas A&M Foundation
presented an original painting created by Benjamin to Mr. Hagler as a gift for his dedication and
service to Texas A&M. A limited edition of 250 Giclee art prints was created from the watercolor

would allow an art gallery but would not permit a retail framing shop or restaurants on site. The
applicant is proposing to relocate his gallery to the site, and is proposing a framing shop and on-
premise consumption of food and beverage, most likely in the form of an ice cream shop and/or
coffee shop. In order to assure that other more intense commercial uses would not be located in the
future on these lots that were originally designed for residential uses, Staff recommended that the
applicant submit a request for a PDD rather than a standard commercial district.
As with all PDD's, there are building elevation drawings and a conceptual site plan that are subject to
the P&Z and Council review. These are included in the applicant's submittal package. In summary,
the plan shows 3 buildings fronting on University Drive with associated parking to the rear. Access
will be taken via two driveways, one each off of Macarthur and Nimitz. The main building will be
fashioned as a replica of the original College Station train depot, and the applicant intends to place a
locomotive and box cars on tracks in front of the site.

The uses proposed would be consistent with other area uses along University Drive, which include
office, restaurant, financial institutions, and general retail. On smaller sites such as the one included
in this request, the City has allowed only limited commercial uses. The requested proposal would be
consistent with this policy.
Item Background: The College Heights area was platted many years ago as a residential
subdivision. Over time, the lots fronting on University Drive became commercial, larger lots to
general commercial and smaller lots to less intense commercial districts. The subject lots were
rezoned A-P many years ago to allow limited commercial uses.
Staff Recommendations: Staff recommends approval of the rezoning.
Related Advisory Board Recommendations: The Planning and Zoning Commission will hold a
public hearing a week prior to Council consideration and minutes are therefore not available at this
time. Results of the P&Z meeting will be presented to Council on June 22.
Council Action Options:
1. Approval of rezoning as submitted.
2. Approval with physical conditions that will mitigate negative impacts.
3. Approval of a less intense zoning classification (only if recommended by P&Z).
4. Denial.
5. Denial without prejudice (waives 180-day waiting period).
6. Table indefinitely.

donated the first $350 to assist in the $350,000 project. (Please see enclosures.) When I
last spoke with Shannon Zwernemann regarding the project in mid July of 1999, I
believe that there was to be a meeting with the City of College Station on 7/22/99
regarding the Depot Project.
I attended the June 15, 2000, meeting of the College Station Planning and Zoning
Commission to hear their position on historic overlay for older neighborhoods. At that
meeting I learned that the Benjamin Knox Gallery on University Drive is planning an
expansion which will include a replica of the College Station Depot! Is the project to
which we have contributed and the one planned by the Knox Gallery going to be a
joint effort?

THE COLLEGE STATION DEPOT
GENERAL LOCATION AND DESCRIPTION
Location
The proposed building site is located on Lot 1 A, Block "D" of the College Heights Addition located in the
City of College Station. The property is located adjacent to University Drive on the south and MacArthur
Street on the east. Immediately adjacent to the west and north of the site are the Northeast 1/s Lots 17 & 18
and lot 4 of Block "D" of the College Heights Addition, respectively. Refer to Figure #1 for the general
location map.
The nearest primary drainage-way is an unnamed tributary of Burton Creek Tributary C. The drainage-way
is located approximately 1,100 feet to the northeast. The property is located in the "Unshaded Flood Zone
X" as shown on FEMA (Federal Emergency Management Agency) map number 48041C0142C, effective
date July 2, 1992.
Description of Property
' Lot lA contains 0.48 acres of land which is currently developed. The development of the site consists of
an existing parking lot and concrete foundation for cone-story structure. There are no primary or secondary
drainage-ways within this lot. Several large trees located on the site will be preserved and incorporated into
' the new development. The proposed project will involve the construction a new single-story building. The
building will occupy approximately 2,544 SF. The existing parking lot will reused with minor changes.
' DRAINAGE BASINS AND SUB-BA
SINS
' Primary Basin Description
The property is located within a drainage Basin 1 (Burton Creek Drainage Basin) as set forth in the City of
College Station - "Drainage Policy and Design Standards" (Policy). As stated previously, the "Flood
Insurance Rate Map" produced by FEMA illustrates that the property lies within "Unshaded Flood Zone X".
The unshaded Zone X is defined as "Areas determined to be outside the 500-year flood plain"(FEMA). Refer
' to Figure #2 for the FIlZM map associated with this project.
Secondary Drainage Basin Description
Figure #3, existing conditions, shows that the existing site runoffdischarges directly into that adjacent streets,
University Drive and MacArthur Street. Once the runoffreaches the street, this secondary drainage pathway
then transports the stormwater to the unnamed tributary of Burton Creek Tributary C. Runoff after the
redevelopment is completed will flow along the same path just described. Refer to Figure #4 for the
proposed conditions.

Regulations
No deviations were taken from the City's "Drainage Policy and Design Standards" when this report was
composed.
t Development Criteria Reference and Constraints
No prior reports or investigations were reviewed for this site. Since no other reports or investigations were
reviewed, this report looks at the impact that the proposed development will have on the down stream
drainage-ways.
' The existing site is developed and has an existing parking lot and concrete foundation. At present, runoff
from the site flows to University Drive and MacArthur Street, which is considered to be the secondary
drainage-way. After development, that amount of impervious surfaces (pavement and building) will only
increase by a small amount. Also, the new development will utilize some of the existing parking lot and
landscaping (i.e. existing trees) that are currently on site. Therefore, the drainage from the site will not
change significantly from the existing conditions.
HYDROLOGICAL CRITERIA
Runoff Calculation Method
The Rational Method was utilized to calculated the peak runoff for the site under existing and proposed
conditions. Runofffor all areas was calculated based on "Soil Conservation Service Method" as required by
the Policy.
Runoff coefficients were determined for the existing and proposed land use. The following table shows the
coefficients that were used in the calculations.

The site is approximately 167' deep and 125' wide. Because the site is so small, the calculated time of
concentration would be less than 10 minutes for both the existing and proposed conditions. Therefore, in
accordance with the Policy, the minium time of concentration was taken as 10 minutes for both conditions.
With the time of concentration determined, the intensity was determined based on the Weather Bureau

General Concept
' As stated previously, the existing and proposed site conditions will transport runoff from to the adjacent
streets. Because the proposed improvements are utilizing existing features of the site, the runoff from the
site will not be significantly increased. The following table condenses the information that was obtained from

It should be noted that the Policy states that all development in the Burton Creek drainage basin must provide
' facilities to detain rainfall events up to and including the 100-year storm event. Although the redevelopment
of this site will increase the runoff, we believe that the amount to which the runoff is increased will be
insignificant. Therefore, we believe that no detention facilities should be constructed on this site and that the
' increase in runoff will have no effect on the down stream drainage-ways.
' CONCLUSION
' Compliance with City Standards
From the information that is presented in this report, we have shown that the redevelopment of this site will
meet the Clty's Policy regarding drainage improvements.
' Effectiveness of Drainage Design
The drainage plan shows that the stormwater runoff under the existing and proposed conditions will be
conveyed off of the site and into the secondary drainage-way (i. e. streets) in the same manner. All of the
storm drainage from the site will transported to the unnamed tributary of Burton Creek Tributary C via the
existing streets and storm drains.

THE COLLEGE STATION TRAIN DEPOT IS A VERY IMPORTANT PART
OF OUR HERITAGE. THERE IS A MYSTIQUE ABOUT IT. NOT ONLY IS IT THE
NAMESAKE OF OUR CITY, BUT IT HAS DEEP HISTORICAL ROOTS [N OUR
PAST. IT HAS AN INTEGRAL SIGNIFIGANCE IN TEXAS A&M'S HISTORY AS
WELL, FIFTY-FIVE YEARS BEFORE THE CITY OF COLLEGE STATION EVEN
EXISTED.
BENJAMIN KNOX HAS BEEN INTRIGUED WITH BUILDING A REPLICA
OF THE COLLEGE STATION DEPOT SINCE THE M[D 1990's, BUT FINDING
THE RIGHT LOCATION HAS TAKEN TIME. NOW, A PRIME LOCATION ON
UNIVERSITY DRIVE HAS BEEN SELECTED AND IS UNDER CONTRACT.
~ BENJAMIN IS PREPARED TO MAKE THE DREAM OF BRINGING BACK THE
DEPOT A REALITY. THE DATE OF COMPLETION IS OCTOBER 2, 2001,
WHICH MARKS EXACTLY 125 YEARS SINCE TEXAS A&M OFFICIALLY
OPENED TO STUDENTS.
THE PURPOSE OF THE COLLEGE STATION DEPOT, WITH ITS
LAVISHLY LANDSCAPED GARDENS AND ADJACENT COMPLIMENTARY
BUILDINGS, W[LL BE TO SERVE THE COMMUNITY AND TEXAS A&M
UNIVERSITY AS A CULTURAL LANDMARK. IT WILL PERMANENTLY HOUSE
THE BENJAMIN KNOX GALLERY AND INTERNATIONAL HEADQUARTERS,
~ AND ALSO PROMOTE FINE ART IN THE BRAZOS VALLEY. A SMALL OLD-
FASHIONED ICE CREAM PARLOR AND VISITOR CENTER WOULD
COMPLIMENT THE FUNCTION OF THE GALLERY. THEY ARE BOTH
CURRENTLY UNDER CONSIDERATION.
BENJAMIN KNOX PLANS TO CREATE A REPLICA OF THE DEPOT AS
A GALLERY FOR THREE REASONS:
~ 1 . AS AN ARTIST, HE IS WORKING TO MAKE FINE ART MORE
PROMINENT IN THE COMMUNITY.
2. AS AN ARCHITECT AND HISTORIAN, HE REALIZES THE
SIGNIFICANCE OF RECREATING AN ARCHITECTURAL LANDMARK
THAT THE CITY WILL BE PROUD OF.

THE COLLEGE STATION TRAIN DEPOT WAS MORE THAN JUST A
STRUCTURE THAT MARKED ONE'S ARRIVAL OR DEPARTURE FROM
AGGIELAND. IT WAS A PLACE OF ENERGY, EXCITEMENT, AND ANTICIPATION.
FOR 83 YEARS IT WAS INTERTWINED WITH THE HISTORY OF TEXAS A&M
AND THE CITY OF COLLEGE STATION.
FROM 1883 TO 1966, THE COLLEGE STATION TRAIN DEPOT
SERVED AS AN IMPORTANT LANDMARK FOR THOUSANDS WHO PASSED
UNDER ITS LONG OVERHANGS. THE DEPOT RECEIVED ITS NAME FROM
THE TRAIN CONDUCTOR ANNOUNCING THE STOP AT THE A&M COLLEGE
OF TEXAS AS "COLLEGE" OR "COLLEGE STATION." THE CITY OF
COLLEGE STATION, WHICH WAS INCORPORATED IN 1938, IN TURN
RECEIVED ITS NAME FROM THE DEPOT.
THE DEPOT HELD A SPECIAL ROLE IN AGGIE HISTORY AND
TRADITION UNTIL THE USE OF THE AUTOMOBILE REPLACED TRAIN TRAVEL
AS A MORE CONVENIENT MODE OF TRANSPORTATION. BY 1958 THE
STATION WAS NO LONGER IN USE. IN 1966 THE NAMESAKE OF THE CITY
OF COLLEGE STATION WAS TORN DOWN. NOW, ONLY A HISTORICAL
MARKER ERECTED IN 1994, IS A SYMBOL OF THE DEPOT'S EXISTENCE.

ONLY, ARTIST-OWNED GALLERY IN COLLEGE STATION. THE GALLERY
HAS PROVEN TO NOT ONLY BE AN ASSET LOCALLY, BUT NATIONALLY AS
WELL. BENJAMIN'S FOCUS AS AN ARTIST IS TO BE THE LEADER IN
~ PROMOTING HIGHER EDUCATION AND THE SIGNIFICANCE OF UNIQUE
PLACES ON A GLOBAL SCALE THROUGH F[NE ART. HE CURRENTLY HAS
ARTWORK AVAILABLE FOR SIX UNIVERSITIES. HE HAS RESEARCHED A
TOTAL OF 33 UNIVERSITIES ACROSS THE NATION AND WILL RELEASE
NEW ARTWORK FOR EACH IN THE NEAR FUTURE. HIS GOAL IS TO
~ REPRESENT 84 OF AMERICA'S MOST PROMINENT COLLEGES AND
UNIVERSITIES BY 2010. HE ALSO PORTRAYS NATURAL ENVIRONMENTS,
PARKS AND UNIQUE PLACES ACROSS THE GLOBE. COLLEGE.STATION IS
HIS HEADQUARTERS AND THE DEPOT WILL BE HIS GALLERY. HERE, HE
~ WILL DISPLAY HIS REGIONAL AND INTERNATIONAL EXHIBITS FOR THE
COMMUNITY TO ENJOY, AS HE HAS DONE FOR THE PAST SEVEN YEARS.
BENJAMIN KNOX WAS ABLE TO ATTEND TEXAS A&M UNIVERSITY
AS A DIRECT RESULT OF SCHOLARSHIP ASSISTANCE. HE BELIEVES
~ STRONGLY IN GIVING BACK, SO THAT OTHERS MAY HAVE THE SAME
OPPORTUNITIES THAT HE HAS HAD. THIS BELIEF 1S INTEGRATED INTO
THE PURPOSE AND MISSION STATEMENT OF THE GALLERY. THE MORE
THAT THE GALLERY GROWS, THE MORE IT GIVES BACK TO IMPORTANT
~ CAUSES.
DURING HIS SOPHOMORE YEAR IN THE CORPS OF CADETS AT
TEXAS A&M UNIVERSITY, BENJAMIN BEGAN HIS ART CAREER OUT OF
NECESSITY TO GENERATE MORE FUNDS TO PAY FOR SCHOOL. HIS
ARTWORK BECAME VERY SUCCESSFUL, AND AFTER COMPLETING HIS
~ TIME IN THE CORPS, HE CONVERTED HIS HOUSE INTO A GALLERY TO
MEET THE INCREASING DEMAND FOR HIS WORK. HE GRADUATED WITH A
DEGREE IN ARCHITECTURE FROM TEXAS A&M UNIVERSITY IN MAY
1993, AND SOON AFTER OPENED HIS CURRENT GALLERY LOCATED IN
~ THE 404 UNIVERSITY DRIVE SHOPPING CENTER.

WITH YEARS OF PLANNING AND SAVING, HE IS NOW PREPARED
TO BUILD A PERMANENT GALLERY TO BENEFIT THE COMMUNITY. HE IS
DRAWN TO BUILD THE COLLEGE STATION DEPOT BECAUSE OF ITS
HISTORICAL SIGNIFICANCE. IT WOULD BEST BE UTILIZED AS AN ART
~ CULTURAL CENTER, ESPECIALLY IF IT INCLUDES ARTWORK
REPRESENTING TEXAS A&M UNIVERSITY AND THE AREA. THE

AN ORDINANCE REZONING APPROXIMATELY 0.82 ACRES, LOTS lA, 17, AND 18,
BLOCK D, COLLEGE HEIGHTS SUBDIVISION, BEING 405 UNIVERSITY DRIVE EAST,
COLLEGE STATION, BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A", "B", and "C" attached
hereto and made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than
Two Thousand Dollars ($2000.00). Each day such violation shall continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance
#1638, is hereby amended as follows:
The following property is rezoned from A-P Administrative Professional to PDD-B
Planned Development District-Business:
Lots IA, 17, and 18, Block D College Heights Subdivision, being 405 University Drive
East, College Station, Brazos County, Texas. Shown graphically in attached Exhibit

The purpose of the planned development is to allow for a site to be constructed with
three buildings consisting of an 1800 square foot train depot, a 1250 square foot
building, and a 3325 square foot building with associated parking to be built behind the
buildings and away from University Drive. Site uses will be restricted to the
following uses:
Art studio or gallery.
Offices, professional or service.
Photographer's studio.
Specialty Retail
Framing shop
Accessory restaurant including, but not limited to, ice cream shop, coffee shop, etc.
Other uses typically associated with art studios
The site shall be developed in accordance with the attached conceptual plan (refer to Exhibit
"C"). The following specific conditions shall be met on site:
1) Landscaping shall be installed as a buffer along the northern property line adjacent to
the residential area.
2) Lighting shall be directed away from the residential area
3) The construction of Buildings B and C shall coordinate in style and materials with
Building A
4) Any on-premise consumption of food and beverage serving area shall be restricted in
size to no more than 25% of the floor area of Building C.
