HomeMy WebLinkAboutField NotesFIELD NOTES Variable Width Access Easement 0.0199 Acres Being all that cer,~ain tract or parcel of land lying and being situated in the MORGAN RECTOR LEAGUE, Abstract No. 46 in College Station, Brazos County, Texas and being a part of Lot 1 A of the Replat of L~cour Subdivision as recorded in Volume 3510, Page 191 of the Official Records of Brazos County (O.R.B.C.), and being a portion of the same land identified as 12.18 acres conveyed to Thomas D. and Bernazd D. Lacour by Debra Estelle Lacour McLaughlin et al by deed recorded in Volume 398, Page 768 of the Brazos County Deed Records (B.C.D.R.), and being more particularly described by metes and bounds as follows: BEGINNING: at a 1/2-inch iron set for the south corner ofsaid Lot lA, said iron rod also being in the northwest line ofthe 0.2952 acre dedication of WolfPen Creek according to the replat ofLacour Subdivision recorded in Volume 3510, Page 191: THENCE: N 36° 21' S5" W (Plat call - S 35° 11' 18" E) along the common line ofsaid Lot 1 A and said 0.562 acre tract for a distance of 38.47 feet to a 1/2-inch iron rod set for Point of Curvature of a curve to the left; THENCE: 51.25 feet along the arc ofsaid curve having a central angle of 04° 51' 47", a radius of 603.80 feet, a tangent of 25.64 feet and a long chord beazing N 38° 47' 48" W at a distance of 51.23 feet to a wood stake set for corner; THENCE: S 45° 23' 44" E into the interior ofsaid Lot lA for a distance of 54.89 feet to a wood stake set for corner; THENCE: N 89° 36' 16" E for a distance of 36.87 feet to a wood stake set for corner, said corner also being in the said northwest line of the 0.2952 acre tract; THENCE: S 32° 48' S5" W (Plat call - S 33° 59' 32" W) for a distance of 38.82 feet the POINT OF BEGINNING and containing 0.0199 acres of land, more or less. Box 564 McLennan County Waco, TX 76703 GRANTEE: CITY OF COLLEGE STATION, TEXAS GRANTEE'S MAILING ADDRESS: 1101 Texas Avenue Brazos County College Station, Texas 77842 CONSIDERATION: Ten Dollars ($10.00) and other good and valuable consideration. PROPERTY: Being all that certain tract or parcel of land lying and being situated in the MORGAN RECTOR LEAGUE, Abstract No. 46 in College Station, Brazos County, Texas and being part of Lot 1A of the Replat of Lacour Subdivision as recorded in Volume 3510, Page 191, of the Official Records of Brazos County, Texas (O.R.B.C.) and being a portion of the same land identified as 12.18 acres conveyed to Thomas D. and Bernard D. Lacour by Debra Estelle Lacour McLaughlin et al by deed recorded in Volume 398, Page 768 of the Brazos County Deed Records (B.C.D.R.); provided, however, that this conveyance shall grant the rights herein specified only as to that portion of the above-described property more particularly described on the attached Exhibit "A" known as the "easement area," and any additional area outside the easement area necessary and incident to the uses of the Easement Area to construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and remove an access road upon, over, and across said property as herein described; and to ,,r~ trim and control the growth of trees and other vegetation on and in the easement area or on adjoining property of GRANTORS, which might interfere with or threaten the ingress and egress of vehicles across said access road. GRANTORS expressly subordinate all rights of surface use incident to the mineral estate to the above described uses of said surface by GRANTEE, and agrees to lender's subordinations on behalf of GRANTEE. GRANTORS will provide GRANTEE with the names and addresses of all lenders. It is expressly understood that the GRANTORS or future Owners of this property reserve the right to use this EASEMENT for all purposes which do not interfere with or prevent its use by the GRANTEE.
