(00.68) A Wolf Pen Creek Design Review Board (DRB) meeting was held or to review the above-mentioned restaurant proposal. Larry Wells with Municipal Development Group, informed the DRB landscaping, islands and parking already constructed. He stated that ~ placed on the site. The red color that is intended, is not as red as it looks - it is more tempered or muted than the sample boazd. The site plan showed the drive-thru for this building facing George Bush Drive. The canopy will be on three sides of the building -George Bush Drive, Harvey Road, and Office Max. The service entrance will be on the rear of the building. The drive-thru window is approximately the same size as a Taco Bell drive-thru window. There is no parking at all on the George Bush side of the restaurant, and Mr. Davis stated that none will be added. That is the side the drive-thru will be on. Senior Planner Kuenzel recommended that the lighting on the building be reviewed, and that at this time no new lighting will be added. She also mentioned that staff requested transformer _. screening from George Bush Drive. Further, she suggested that the sign colors and lighting be restrained, or muted. Bob Davis stated that, as far as signage, he would prefer to add a small pole-mounted sign at a later date. DRB chair Henryson stated that regarding parking, four existing parking spaces will have to be removed to install the drive-thru. Commissioner Rife said that the drive-thru will add to traffic congestion. DRB chair Henryson asked about the length of que space. Bob Davis replied that he did not anticipate the need for much que space. With Fazoli's staff dedicated to the drive-thru, it should be no longer than 35 seconds from the time a customer orders their food until they leave the drive-thru. Commissioner Horlen stated that, based on the Wolf Pen Corridor plan, the building is sitting backwards. The ordinance states that structures should be "oriented to the creek" and, in this case, the building should face George Bush Drive and the creek. DRB member Trainor stated that he believes the building should face Harvey Road as opposed to George Bush Drive. DRB chair Henryson stated that if the building sits as it is planned, people will not be able to see the creek from the restaurant pad. DRB member Ragland is concerned with the amount of traffic on the side of the building, and the pedestrian traffic outside the building. She stated that she wanted a sign to promote awareness to cars and pedestrians regarding the walk area through the parking lot. All of the funds are available, and anticipated construction time is six to nine months. The City is waiting to acquire the Right-of--way for George Bush Drive before beginning. Board member Ragland moved that if the four spaces in question remain, designate them as "employee parking only", place a "pedestrian crossing" sign where the walkway and driveway ,~ meet, and place a break in the pavement types in that area. Commissioner Horlen does not want the dumpster area and parking lot to be seen from the creek. DRB member Ragland moved to add additional landscaping on either side of the drive-thru and exit. DRB member Trainor seconded the motion. Motion passed 7-0. DRB member Ragland suggested reducing the amount of watering on site, and adding less water- intensive plantings for a softer, more natural look. She also recommended a larger variety of plantings. DRB chair Henryson suggested that the height and grouping be varied, and agreed that the planting should be varied. Rabon Metcalf, Municipal Development Group, noted that the irrigation system is already in place. Mr. Davis agreed to change the plantings, adding more up- to-date landscaping, while leaving as much existing landscaping as possible. DRB chair Henryson asked what kind of gate was proposed for the dumpster. Mr. Davis replied that a solid metal gate similar to a garage door without windows was what he planned. Commissioner Horlen responded that he wants it to look as little like a dumpster as possible. DRB member McLean recommended painting the fence green to match the rest of the building. Larry Wells recommended changing the driveway to go straight out of the parking lot instead of curving over to exit. He also mentioned adding more landscaping around the straight drive. Commissioner Horlen motioned to realign the drive, eliminating parking spaces and concrete, and add additional landscaping and designate four parking spaces. DRB member McLean seconded the motion. Motion passed 7-0. DRB chair Henrysan stated that the signage on the top of the roof was fine and prefers no further signage. She prefers building signage to pole signage. (00-68) Senior Planner Kuenzel presented the staff report and stated that this item is the final step in the site plan approval process as required of all Wolf Pen Creek projects. The applicant is proposing to construct a 3,862 square foot Italian restaurant with adrive-thru in the southwest corner of the Office Max parking lot on Harvey Road. The pad site has remained undeveloped since the construction of Office Max. It is the only pad site available in the parking lot, and has high visibility to public rights- of-way. Fazoli's Restaurant is proposed to be located at the corner of Harvey Road and George Bush Drive. All site plans within the Wolf Pen Creek Development Corridor are subject to review by the Design Review Board (DRB). In compliance with the City's land use and development codes, and guided by the Wolf Pen Creek Corridor Study and Master Plan, the DRB evaluates site plans based on the appearance of the development. The DRB reviewed this item on May 3 and recommended approval with the following conditions: 1. Change the color of the lights and roof to green instead of the proposed red. 2. Realign the drive, eliminating parking spaces and concrete, and add additional landscaping and designate four parking spaces as employee parking, and place a "pedestrian crossing" sign where the walkway and driveway meeting, and place a break in the pavement types in that area. 3. (00- 70) Staff Planner Anderson presented the staff report and stated the subject tract is currently unplatted. A plat is not being submitted for future development of an apartment complex. Item Summary: The applicant is proposing to construct a 3,862 square foot Italian restaurant with adrive-thru in the southwest corner of the Office Max parking lot on Harvey Road. The pad site has remained undeveloped since the construction of Office Max. It is the only pad site available in the parking lot, and has high visibility to public rights-of--way. Fazoli's Restaurant is proposed to be located at the corner of Harvey Road and George Bush Drive. All site plans within the Wolf Pen Creek Development Corridor are subject to review by the Design Review Board (DRB). In compliance with the City's land use and development codes, and guided by the Wolf Pen Creek Corridor Study and Master Plan, the DRB evaluates site plans based on the appearance of the development. Specifically, the DRB has discretionary review over lighting; garbage; utility service; relationship of building to site; relationship to adjoining areas; landscape transition; harmony in texture, lines, and masses; park access easements; building design; materials; colors; signs miscellaneous structures and street hardware; and maintenance. The DRB makes recommendations to the Planning and Zoning Commission regarding proposals for development in the Wolf Pen Creek corridor. Site History: The subject site is part of the LaCour Subdivision. In 1996, a development agreement was entered into by LaCour Investments, SCC Development, and the City. The following conditions were included in this agreement: • A 5.1 acre tract (the "Wolf Pen Creek Dedication") would be donated to the City. • A 35' wide, 0.094 acre right-of--way (the "Kyle Street South"/George Bush Drive Dedication) would be donated to the City. • A 20' wide, 0.295 acre minimum reservation area out of and along the southeast property line of the current subject property would be donated to the City. • A 30' wide "Private Access Easement" running roughly from the most southerly corner of the current subject property, north and west to Harvey Road would be dedicated. • The City would not require SCC to pay for or construct a pedestrian sidewalk along Harvey Road. All sides have complied with the terms of the agreement. Item Background: On April 19, 2000, the first DRB meeting regarding Fazoli's Restaurant was cancelled because of a posting mistake. Also, quorum was not met and in passing discussion with the applicant, it was decided the applicant could make a more thorough presentation with additional information. A second meeting will be held the May 3. Because of the timing of the DRB and P&Z meetings, DRB recommendations will be presented to the Planning and Zoning Commission at the P&Z meeting on May 4. Staff Recommendations: Staff recommendation will be presented at the PNZ meeting. Related Advisory Board Recommendations: The Design Review Board recommendation(s) will be presented at the P&Z meeting. Commission Action Options: The Commission has frnal authority over site plans in the Wolf Pen Creek Corridor Overlay. Item Summary: Last year the applicant went through the site plan review process and gained approval of their proposed site plan. However, in the course of site inspections conducted during the development and building of the project, it was discovered that multiple changes had been made to the site, without the approval or knowledge of staff or the appropriate boards. Staff cannot issue a full Certificate of Occupancy if the approved site plan is not followed. The applicant is therefore coming before the appropriate boards to gain approval of the all the changes. In an effort to work with the applicant, the City did grant a temporary 60 day C/O, with the condition that all necessary approvals must be granted or the site must be brought into compliance with the originally approved site plan. The changes are: 1. A 2 -foot sidewalk was added along the drive-thru up to the window. 2. The exit of the drive-thru was expanded from 12 to 22 feet in width. 3. A sidewalk was added from the southern service door to the drive-thru. 4. The brick paver area that was planned for across the drive-thru is now proposed to be concrete with a paving treatment to make it look like pavers. This same treatment is being proposed for the driveway on George Bush. 5. The applicant would like to spell out Fazoli's in greenery on the berm at the corner of Harvey and George Bush. In addition to the changes proposed, the applicant is also requesting approval of the sign face to be added to the freestanding sign shared with Office Max. In April of this year, the applicant began discussions with staff about receiving approval of the sign faces to be placed in the existing freestanding sign. The existing sign has a vacant section, intended to be used by whomever occupied the pad site. Upon researching the minutes from the DRB and P&Z meetings it was discovered that, although discussion had taken place regarding Fazoli's signage, the only approval received was for signage attached to the building. Comprehensive Plan Considerations: All site plans within the Wolf Pen Creek Development Corridor are subject to review by the Design Review Board (DRB). The DRB evaluates site plans and the appearance of the development for compliance with the City's Land Use Plan and development codes, and guided by the Wolf Pen Creek Corridor Study and Master Plan. Specifically, the DRB has discretionary review over lighting; garbage; utility service; relationship of building to site; relationship to adjoining areas; landscape transition; harmony in texture, lines, and masses; park access easements; building design; materials; colors; signs miscellaneous structures and street hardware; and maintenance. The DRB makes recommendations to the Planning and Zoning Commission regarding proposals for development in the Wolf Pen Creek corridor. Item Background: The site plan was originally approved by P&Z, with staff and DRB recommended conditions, in May of 2000. Construction began in March of this year. Related Advisory Board Recommendations: The DRB met on June 13th of this year to review the revised site plan. They recommend approval of the changes over which they have purview and of the proposed face for the freestanding sign shared with Office Max. The Planning and Zoning Commission has the final authority over these items. Meeting minutes are attached. The ZBA met on July 10th of this year to consider the applicant's request for a variance to the 1 80s end island requirement. They denied the variance request. The ZBA has final authority over this issue. A draft of the meeting minutes are attached. The applicant has submitted revised plans, showing compliance with this requirement. Commission Action Options: The Commission has final authority over site plans in the Wolf Pen Creek District. Applicant: Bob Davis Item Summary: This project is coming back before the DRB to review several items. Staff has become aware of multiple changes that have been made on site that are not in compliance with the approved site plan. These changes have been made without the knowledge of staff, DRB or P&Z. At this time, the WPC zoning district regulations do not allow for staff to approve even minor changes to a site plan. Therefore, in order for a full Certificate of Occupancy (C/O) to be issued, the changes must be reviewed by the DRB and approved by the P&Z. While preparing to bring the sign request to the DRB and P&Z, it came to the attention of staff that site plan changes were occurring in the field. After discussions with staff, the applicant became concerned about being able to receive a C/O in time for their planned grand opening on June 11 th. Therefore, the applicant has agreed to comply with the previously approved site plan if the necessary approvals are not received by the required Boards and Committees. Actions required for compliance may include, but are not limited to, the demolition and removal of existing improvements. With this understanding, staff may grant a conditional C/O permitting the applicant time to pursue the necessary approvals and variance. The applicant is fully cognizant of the City's intention to go into enforcement if the terms of the conditional C/O are violated. Issues/Items for Review: 1. At some point, whether by Fazoli's or the original developer does not matter, a sprinkler system was installed with hardware extending outside of the property lines. Approval for any item to be placed in the City's ROW is required through the P.I.P (Private Improvements in the Public ROW Permit) process. This has not been requested. Approval for any items to be placed in TxDot ROW must be granted by TxDot, and should be submitted through the City. This has not been requested. Any improvements outside the property lines are at the developer's own risk. If either the City or State proposes improvements in the ROW, the developer's items are subject to removal without notification or compensation of any kind. Staff is concerned about this issue, because construction of a sidewalk along Harvey Rd. is being considered. If it is installed, and irrigation removed, some of the required landscaping may not receive adequate watering. 9.
