HomeMy WebLinkAboutStaff ReportsSTAFF REPORT Item: Public hearing and consideration of a Conditional Use Permit (CUP), site plan only, for the Covenant Presbyterian Church located at the intersection of Rock Prairie Road and Edelweiss Ave.(0-63) Applicant: Covenant Presbyterian Church Item Summary: A Church Conditional Use Permit, use only, was approved for this property by the Commission on March 4`", 1999. The proposed church would be developed on 10 acres. The building is intended to be used weekdays and weekends during the day and evenings for various church and related activities. At this time the applicant is choosing to only develop approximately half the site, and reserve the remainder for possible future expansion. The property is currently zoned A-P (administrative-professional), along Rock Prairie Road, and R-1 (Single Family Residential) along the southern portion of the property. It is adjacent to R-1 to the south and to the east across Edelweiss Ave. The property to the west is zoned C-1 and faces Wellborn Rd. The property across Rock Prairie is zoned A-P and has received a conditional use permit for another religious facility. The Land Use Plan shows Single Family Residential and Office Use in this area. Religious facilities are allowed in any zoning district with a Conditional Use Permit granted by the Commission. The subject property was recently shown on a preliminary plat and was rezoned several years ago as a part of the development of Edelweiss. A final plat will need to return to the Commission for approval before Building Permits will be issued. Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) 1. "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." Staff conducted a technical review and found general compliance with development regulations with the exception of the items listed below in the staff recommendation. 2. "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City. The request is in compliance with the Comprehensive Plan. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. J:\PZTEXT\PZ03053.DOC Page 1 of 3 The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Unless the public hearing bring to light any new information indicating potential negative impacts, Staff recommends approval with Staff Review Comments. Commission Action Options: The Commission has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Approval with conditions relating to specific site characteristics or with time limitations; 3. Denial with specified reasons for denial; 4. Table; or, 5. Defer action to a specified date. Staff Review Comments #2 J:\PZTEXT\PZ03053.DOC Page 2 of 3 INFRASTRUCTURE AND FACILITIES Water: Adequate water service is currently provided to the site by 2 existing 8 inch water lines and a 30 inch water line that runs along the Rock Prairie frontage. Sewer: Adequate sewer service is currently provided to the site by an existing sewer line that runs through the subject property. Streets: The subject property will have more than adequate access from Rock Prairie, which is a major arterial and from Edelweiss, which is a major collector. Drainage: Detention is required on site. The detention pond plans are still under review by staff. The applicant will be required to fully comply with the Drainage Ordinance. Oversize request: None anticipated. Impact Fees: The subject property is wholly contained within the 92-01 sanitary sewer impact fee zone and will be required to pay a fee of $289.77 per Living Unit Equivalent, or LUE. Item Summary: The applicant is requesting a modification to the site plan that was approved for this project last year. The modification is the addition of a berm at the northwest property corner. Minor modifications to a conditional use permit site plan are generally approved at the staff level. Given that a standard berm used for screening purposes would be 3 feet in height, and that the proposed berm is in a very visible location, is approximately six feet in height and covers an area of approximately 20,000 sf, staff considers this to be a significant change to the site plan. Nonetheless, the berm does not displace any required landscaping or interfere with any easements. Staff also checked to ensure that it does not block the required visibility triangle at the intersection of the driveway and Rock Prairie Road. In fact, the berm will function as additional screening for some of the church parking. Unless the public hearing brings to light any negative impacts, staff recommends approval.
