W. Corner of University Drive at State Highway 6 (See enclosed map.) Proposed Use: Convenience store/fuel station The Planning and Zoning Commission will hold a public hearing to consider the use for the subject property on Thursday, July 1, 1999 at 7:30 p.m. in the City Hall Council Chambers at 1101 Texas Avenue South, College Station, Texas. All property owners within 200 feet of the subject property have received notification of this request. Giesensehlag: As we discussed briefly yesterday, my cheat, Pren*r Builders, worked as the general contractor of the convenience store project located at the northwest corner of Highway 6 and University Dr. on approximately 1.148 acres of land and owned by Gateway Fuels, L.L.C. (the "Corner Tract"). It is my understanding that your client, CSI Associates, a Texas general partnership, ("CSI') owns the approxfi a 4.839 acre tract contiguous with the Corner Tract on its western most and northem-most boundary lines (tbe "CSI Tract'). Apparently, Premier Builders moved approximately 1,000 square yards of dirt onto the CSI Tract along the property's southern-most boundary line as a part of building up the Corner Tract for development, and now, the City of College Station, Texas wf1 not grain Gateway Fuels, L.L.C. a per ument certificate of occupancy to operate the convenience store located on the Corner Tract until either (i) the dirt moved onto the CSI Tract by Premier Builders is removed, or (9) the owner of the CSI Tract consents in writing to the dint being on the CSI Tract. It is my understanding that your client does not object to the presence of the dirt on the CSI Tract, and in fact, that the dirt will reduce your cherrt's dirt tarork costs wben developm=nt of 1-x CSI '7':n^t commences. If CSI Associates will not require removal of the dirt from its property, please have your client execute this letter below Mi the appropriate blank before a notary and return the original document to my office, By executing this letter, your client acknowledges and agrees that the City of College Station my rely on the consent hereby given to issue a permanent certificate of occupancy with respect to the Comer Tract to Gateway Fuels, L.L.C.
