Item: Public hearing and consideration of a Conditional Use Permit, use only, for a religious
facility to be located on the southeastern corner of Sebesta Road and Foxfire Drive (99-709)
Applicant: Korean Mission Church of Texas A&M
Item Summary: The proposed church would be developed on 4.98 acres. The building is intended
to be used Sunday mornings and Wednesday and Friday evenings for church and related activities.
The property is currently zoned A-OR (rural residential). It is adjacent to A-OR to the south along
Foxfire Dr. The property to the east along Sebesta Rd. is zoned A-O and is developed as
Sandstone Park. The property across Foxfire Dr. is zoned A-OR is developed as another religious
facility. The property across Sebesta Rd. is zoned R-1, developed as single family homes and M-1
developed as a warehouse. The Land Use Plan shows low density Single Family Residential.
Religious facilities are allowed in any zoning district with a Conditional Use Permit.
A site plan will need to return to the Commission for approval before proceeding with Building
Permits.
Item Background: The subject property was platted as part of the Foxfire subdivision and was
rezoned to A-OR several years ago with the rest of the Foxfire.
Budgetary & Financial Summary: NA
Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to appropriate conditions
and safeguards, when after public notice and hearing the Commission finds that: (Staff comments
are in italics)
1. "The proposed use meets all the minimum standards established in the ordinance for the
type of use proposed." This use meets all of the minimum ordinance requirements.
2. "That the proposed use meets the purpose and intent of the ordinance and is in harmony
with the development policies and goals and objectives as embodied in the Comprehensive Plan for
Development of the City." This use is in line with the Land Use Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, nor be substantially or permanently injurious to
neighboring property." The public hearing is an opportunityfor the Commission to measure the
potential impact on surrounding land uses.
"The Commission may impose additional reasonable restrictions or conditions to carry out the
spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These
requirements may include, but are not limited to, increased open space, loading and parking
requirements, additional landscaping, and additional improvements such as curbing, sidewalks and
screening."

Unless the public hearing brings to light any new information indicating potential negative
impacts, Staff recommends approval.
Commission Action Options: The Commission has final authority over the Conditional Use
Permit and associated site plan. The options regarding the use permit are:
1. approval as submitted
2. approval with conditions relating to specific site characteristics or with time limitations
3. denial with specified reasons for denial table, or defer action to a specified date

INFRASTRUCTURE AND FACILITIES
Water: Public water is available to the site. Any required fire protection will be
provided through the site plan process.
Sewer: Same as water
Streets: Sebesta Rd. and Foxfire Dr. are minor collectors. Both streets will Provide
adequate access to and from the site.
Off-site Easements: N/A
Drainage: Will be coordinated through the site plan process. Development must occur
in compliance with the City's Drainage Ordinance.
Flood Plain: None on site.
Oversize request: See Budgetary and Financial Summary Section.
Impact Fees: N/A
Parkland: N/A
Sidewalks: Public sidewalks were installed with the construction of the surrounding
streets.
