From: Veronica Morgan To: internet:udgcs@txcyber.com Date: Fri, May 7, 1999 5:00 PM Subject: Request for information re: Commerce National Bank on University I have reviewed the site plan for Hartland Bank and QAB (which I knew had a detention pond near a drainage easement). Hartland Bank did not show the utility easement in the front of the property where they proposed to place the detention pond. They did show the 10' and 20' utility easement that runs through the property north/south. The pond had a slight encroachment into the first few feet of that utility easement but it was not a cut situation. According to the plan it showed the grades bermed up only slightly. On QAB the detention pond was constructed wholly outside the easement. The answer to your question is: if you desire to place the detention facility within the easement you will need to obtain a license to encroach, regardless of your construction type. In discusions with Tony Michalsky, their electrical is very shallow and if you remove any cover you will have to deepen their lines at your expense. I dont know the depths of the other utilities but the Carter & Burgess plans should help you with that. Also re: the drive thru canopy, you will need to obtain a license to encroach for that facility as well. have been unsuccessful in reaching lawrence carter to see if they would entertain signing a license for this use and what restrictions (height, etc.) they may require. This should give you enough information to go on to help your client make a decision on the site layout. Along with the site plan is a temporary building plan. The bank is needing some assurance that a temporary building can be approved for that site, so they can proceed with the design of the permanent building to be located as shown. Since our last meeting with staff, we have designed the detention pond to meet the ordinance requirements and avoided the easements as suggested. This design however produces a pond that we perceive is "out of scale" for the development and the location of the property. Specifically, the square footage of the pond is larger than the square footage of the bank. As such, we are requesting a meeting with the necessary personnel to discuss other design options.
