SUBJECT: Fitzi4 lly's Restaurant - Consideration of the addition of the
elevated deck at the rear of the existing restaurant located in
Northgate at 303 University. (Case file #99-411)
An NRB Review Subcommittee meeting was held on June 22, 1999, to review
the above-mentioned item. Jane Kee informed the subcommittee that College
Station citizen Benito Flores-Meath approached her about ordinances being
overlooked on this project. She stated that after some research she found that
the NRB was inadvertently overlooking an ordinance guideline in Northgate
District 1 (NG-1). It states that anything requiring a building permit in that
historic district requires the adherence to the guidelines in "The Secretary of
Interior's Standards for Rehabilitation." Ms. Kee stated that when this was
brought to her attention, the case file and NRB decision to approve the request,
was reviewed by staff. It was determined that the NRB's original decision to
approve the renovation of Fitzwilly's was in accordance with the standards and
there were no direct conflicts.
Julius Gribou stated that the Planning and Zoning Commission should be given
the opportunity to review all of the information presented at this meeting.

After reviewing the plans and elevations for the proposed elevated deck at
Fitzwilly's Restaurant I have found no direct violations of the Secretary of Interior's
Standards For Rehabilitation.
CONCERNS:
Cheryl Anz's concern of access to the roof:
A. Roof access could be controlled by a simple arbor over the deck.
B. Rod iron fence to be addressed below.
Elton Abbott, Jr's concern:
A. In the photos there is no 4X4 post installed. I think Mr. Abbott seen the
steel post that are extending above the steel frame which are about 11'
apart.
B. Mr. Abbott has a very legitimate concern of the strength of the
proposed fence. However, I feel if a top rail is installed you would create
an area where people could sit which would create another safety
hazard.I would suggest leaving the steel post extended through the deck
and incorporate these into the fence. Steel tubing could be welded
between the post then the vertical rods could be added. The steel post
could be wrapped with wood and made to match the 4X4s.
Julius Gribou's concern:
A. I think item "B" above answers Mr. Gribous's concern.
My concern:
A. There will need to be a capacity limit for the deck according to
design.
B. There may need to be a means of egress directly from the deck for
fire safety.
THE SECRETARY OF INTERIOR'S STANDARDS FOR REHABILITATION
REVISED 1990
1. A property shall be used for its historic purpose or be placed in a new use that
requires minimal change to the defining characteristics of the building and its site and
environment.
2. The historic character of a property shall be retained and preserved. The removal of
historic materials or alteration of features and spaces that characterize a property shall
be avoided.
3. Each property shall be recognized as a physical record of its time, place, and use.
Changes that create a false sense of historical development, such as adding
conjectural features or architectural elements from other building shall not be
undertaken.
4. Most properties change over time; those changes that have acquired historical
significance in their own right (are now over 50 years old) shall be retained and
preserved.
5. Distinctive features, finishes and construction techniques or examples of
craftsmanship that characterize a property shall be preserved.
6. Deteriorated historic features shall be repaired rather than replaced. Where the
severity of deterioration requires replacement of a distinctive feature, the new feature
shall match the old design, color, texture, and other visual qualities and where
possible materials. Replacement of missing features shall be substantiated by
documentary, physical or pictorial evidence.
7. Chemical or physical treatments, such as sandblasting, that cause damage to historic
materials shall not be used. The surface cleaning of structures, if appropriate, shall be
undertaken using the gentlest means possible.
8. Significant archeological resources affected by a project shall be protected and
preserved. If such resources must be disturbed, mitigation measures shall be
undertaken.
9. New additions, exterior alterations or related new construction shall not destroy
historic materials that characterize the property. The new work shall be differentiated
from the old and shall be compatible with the massing, size, scale and architectural
features to protect the historic integrity of the property and its environment.
10. New additions and adjacent or related new construction shall be undertaken in such a
manner that if removed in the future, the essential form and integrity of the historic
property and its environment would be unimpaired.

SUBJECT: Ktzwilly's Restaurant - proposal for the addition of an elevated deck at the rear
of the existing restaurant located in Northgate at 303 University. (Case file
#99-411)
An NRB Review Subcommittee meeting was held on May 5, 1999, to review the above-
mentioned item. Richard Benning and Terry Strickland submitted additional detailed drawings
for the subcommittee's review as requested at the last meeting.
Cheryl Anz voiced her concern about the rod iron fencing on the proposed deck. She stated
that the height of the deck could enable patrons to crawl up on the adjacent restaurant's roof.
Elton Abbott, Jr., inquired about the 4x4 posts on the railing. He stated that they looked like
they were 10' apart, instead of the 6' shown on the detail. Mr. Strickland stated that they
would be 6' apart. Mr. Abbott also stated that the rod iron railing is not very strong and was
concerned about the safety issues with people leaning on the railing. He suggested having a
structural engineer inspect the railing and suggested a top and bottom rail for added support.
Julius Gribou also voiced his concern about the railing and pointed out the difference between
the railing located at the front of the store and the proposed railing for the deck. He stated
that the proposed railing was more like that for a fence, and not one made for people leaning
against it. Mr. Gribou suggested using metal instead of wood posts and also suggested a top
railing for added support.
Cheryl Anz motioned to accept the proposal as presented, with the following conditions:
Address the safety concerns discussed at the meeting with the rod iron railing:
make sure the railing is sturdy like the railing in the front of the building;
Provide adequate railing at the top and bottom of the railing for added support;
Use metal instead of wood posts for the railing;
Address the safety concerns regarding access to the adjacent roof;
The motion was seconded by Elton Abbott, Jr., and passed 7-0.

SUBJECT: Fitzwilly's Restaurant - proposal for the addition of an elevated deck at
the rear of the existing restaurant located at 303 University Drive.

An NRB Review Subcommittee meeting was held on March 31, 1999 to review the
above-mentioned item. Mr. Strickland presented several drawings showing the
proposed elevated deck. He stated that the deck is 448 square feet with 4 foot hand
rails. He said that the deck will be located 6 inches away from the adjacent building.
He also mentioned that they may construct an awning in the future. The 4 foot metal
railings will be painted white to match the building, as well as the posts.
Cheryl Anz requested that he bring the proposed awning to the NRB before
construction.
Julius Gribou voiced his concern with the safety of the railings. He was also concerned
with the aesthetics of the deck and support columns, stating that they had no finished
appearance. Mr. Gribou requested that Mr. Strickland bring back some conceptual
drawings that shows in more detail what they are proposing.
James Massey stated that the design needs to be reexamined to take into consideration
the historic significance and the NRB comments made today.
Elton Abbott informed Mr. Strickland that the railings will have to be closer together.
Mr. Strickland stated that he was aware of that.
Ron motioned for Mr. Strickland to bring back more detailed drawings. Leslie Randolf
seconded and the motion passed 6-0.
