Dear Fain:
I have reviewed the proposal set forth in your letter of February 1, 2000. Additionally, I
have discussed this proposal with the College Station staff members who participated in
our meeting of January 10, 2000.
The proposal outlined in your letter is not consistent with the general terms for an
agreement we discussed on January 10. At that time, we discussed a scenario where
College Station would provide water to the subdivision through the Wellborn Special
Utility District system. While there were numerous details to be resolved, we proposed
an agreement through which the residents of this portion of the City would receive water
service from the City with the same rates, fees and costs as other College Station
residents. Those were the general terms under which we felt that we could recommend
Council approval of an agreement.
If the general terms we discussed on January 10 are not acceptable, we need to focus on
the standard alternatives for water service for new development. These alternatives
include connection to the municipal system through developer extensions (and City
oversize participation) or development of municipal facilities through an impact fee cost
recovery plan.

Dear Jim:
Wellborn Special Utility District (Wellborn SUD) directed me to request that the
City of College Station consider allowing Wellborn SUD to provide water service and
operate the water system on an interim basis in Sweetwater Forest subdivision, until such
time as the City of College Station is able to provide both functions.
The water system in Sweetwater Forest, including fire protection, service lines
and meter boxes, would be designed and constructed at the developer's expense and
according to City of College Station Water Division specifications. After passing
inspection by the City of College Station Water Division staff, the water system in
Sweetwater Forest would be operated by Wellborn SUD, including meter reading,
customer billing, and repairing leaks, etc. When a property owner in Sweetwater Forest
requires water service, the City of College Station Water Division would be contacted to
install a City of College Station standard water meter, according to their standard
procedures. The fee for this installation would be paid to Wellborn SUD by the property
owner, along with a deposit and impact fee; then installation fees would then be
forwarded to the City of College Station.
As soon as the City of College Station Water Division is able to provide water
service and operate the water system in Sweetwater Forest subdivision, Wellborn SUD
would immediately cease their service and operations and turn the Sweetwater Forest
system and customers over to College Station. There would be no claim for
compensation for either the water system or customers in Sweetwater Forest. Wellborn
SUD is requesting that they share equal indemnity with the City of College Station during
the period Wellborn SUD operates the water system in Sweetwater Forest.
All prospects for lots in Sweetwater Forest will be informed that initially they will
be customers of Wellborn SUD and will be responsible for the same fees and water costs
as Wellborn customers in new subdivisions outside of the city limits of College Station.
Then as soon as the City of College Station can provide water directly to Sweetwater

Forest, they will assume responsibility for the operation of the water system, and the
property and homeowners in Sweetwater Forest will become customers of the City of
College Station at the same lower rates enjoyed by the other citizens of College Station.
The advantages of interim water service to Sweetwater Forest subdivision by
Wellborn SUD under this proposal are:
• City of College Station will acquire the water system and customers in
Sweetwater Forest at no cost.
• City of College Station standard specifications and procedures will be utilized
for the Sweetwater Forest water system design and construction. Also, the
installation of the College Station standard water meters will be by College
Station employees.
Citizens of College Station who have purchased a home site in Sweetwater
Forest will be able to utilize the existing water source on the property, thus
allowing them to commence construction of their homes in a rural
environment within the city limits without waiting until water is provided by
College Station.
• Citizens of College Station who are homeowners in Sweetwater Forest will
have a reduction in the cost of water services and usage fees as soon as the
service and operation of the water system is turned over to the City of College
Station Water Division.

I spoke with Mike McClure and advised him that we would not be able to process any final plats for
Sweetwater unless they included plans for connection to the municipal water supply. Mike discussed
alternate arrangements with Wellborn Water - I advised him that water supply from Wellborn was not an
issue that we could address through the platting process. I explained that we could work with an offsite
extension with oversize participation but that any other alternatives would have to be work out through the
Water/Wastewater Dpt.
The preliminary plat will proceed.

here's what Nat and I did. Talked to Mike. It's very important to Fain to have this thing in the hopper. So,
we'll stay on schedule and at the Jan 6 P&Z they can approve with the condition that the City work out the
meter arrangements or whatever language is appropriate. If they don't feel comfortable with that or the
parkland issue they can hold the PH and close it and then
(1) table it IF we decide that filing means the P&Z mtg. date. Then 30 days is not a problem, or
(2) if you feel uncomfortable with that, Mike will get up and ask them to table pending resolving the
parkland and/or water issue.
We will have to know at the 19th mgmt. council agenda mtg. whether Tom will let this stay on the 27th CC
mtg. or not. (P&Z would meet again the 20th so we won't have the results by the 19th). If he won't let it
stay on then we have to renotify for CC, but as long as we know by the 21 st we're OK.
