SUBJECT: PRELIMINARY PLAT for LEGACY ADDITION 1 (PP)
Item: Consideration of a Preliminary Plat for Legacy Addition (PP), consisting of
approximately 7.165 acres on the northwest corner of Holleman and Harvey Mitchell.

Applicant: Tony Jones
Item Summary: The applicant in this case is preparing the property for a duplex
development with a convenience store/service station at the corner of Holleman and
Harvey Mitchell Parkway. The Council approved R-2 zoning for the duplex lots a few
months ago and more recently approved a PDD-B designation for Lot 1, Block 2. The
PDD-B was approved to facilitate a convenience store/service station on the corner site.
The plat as forwarded to the Commission meets all applicable requirements, including the
PDD-B ordinance rezoning the commercial lot.
Staff recommends approval.

Dear Ms. McCully:
This letter is offered in answer to your questions in the staff review of December 3, 1999. 1 will
address each as numbered on your review:
1.) There will be no separate phases and final plat will be of the entire 7.165 acres.
2.) There is an existing 8" water line stubbed to this 7.165 acre tract at the southeast corner
of the intersection at Southwest Parkway and Holleman.
There is a 15" sewer line currently on this property on the south-side paralleling FM 2818.
There is also a sewer line going down the west property line from FM 2818 to Southwest
Parkway.
3.) Our request for zoning is for approximately 5+ acres to be R-2 (Duplex) and 2-acres
for C-1 (Commercial). On three separate occasions some four weeks ago I attempted
to visit with you regarding our anticipated request. Your absence and/or being in a
meeting prevented our discussions. I was advised to visit with Natalie regarding my
concerns and to get some answers to my questions. Natalie could not give an answer
for you. She told me that it had been Staffs previous position that C-1 would only be
at major intersections, Holleman and FM 2818 is a major intersection, along with
being a very dense area. We presumed we were following the intent and posture of
the Staff and Planning and Zoning Commission. It has been our intent to develop
these 2 acres as C-1, for a convenience store with gasoline islands. In our discussion
on December 7, 1999, you advised me that a better zone would be C-B as defined
under 7.22-D on page 7-37 of the Zoning Ordinance. I would have no problem with C-
B with conditional uses permitted. This would permit our projected use plans and
sounds like it would better follow Staffs advise.
The "Buffer" as you indicate is not defined. We are the owners of both parcels. There
would be a minimum of 15' by rear setback, but we have not considered anything accept
in designing buildings.
4.) The master drainage plan will be completed before the final plat is approved. The
hydrology and drainage calculations will be per codes.
5.) We have requested all easements from the Title Company and all existing easements will
be shown and noted on the plats.
6.) There has been no correspondence with the Parks Department. We intend on paying our
parkland dedication. I have called Steve Beachy and am awaiting his call to go over any
clarification.
7.) The purpose of the 24' private access is for a 12' on both properties to use as a drive for
parking and to produce a way to get drainage to the detention pond.

Staff received your letter dated December 8, 1999 regarding the above mentioned
preliminary plat. Unfortunately, we will not be able to process the preliminary plat until
the additional information that was requested with the first staff review is provided.

your letter and also clarified some outstanding issues.
Please address the attached "Staff Review Comments No. 2" and submit the following
information by Monday, December 20, 1999 at 10:00 a.m. to be placed on the next
available Planning and Zoning Commission meeting scheduled for Thursday, January
20, 1999 at 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue. (The
