AGENDA ITEM NO. 1: Hear visitors
Benito Flores-Meath, 901 Val Verde, commented that he attended the joint workshop with P&Z and
the Qity Council and he said that he appreciated the work that was done during the meeting. He said
that he made suggestions to the Council during their "Hear Visitor" sections regarding neighborhood
problems. He wanted the ordinance changed that reflects no more than 4 non-related residents living in
a single family home. He wanted this changed to no more than 2 or 3 people. He also requested some
sort of fee or licensing procedure for rental of residential or single family homes that are not owner
occupied. He read through examples from other cities with similar ordinances.
The following items were approved by common consent.

STAFF REPORT
Item: Consideration of a FINAL PLAT (REPLAT) for the HENTON-LINCOLN Subdivision
located on the south side of University Drive and the north side of Lincoln Avenue.
Applicant: DAVID SCARMARDO
Item Summary: This item is a replat of 16.82 acres from 4 lots of about 4 to 5 acres in size to 8
lots ranging from .77 to 3.25 acres in size. The replat includes two private roadways contained
within 30 feet private access easements to provide internal circulation to and between the newly
created lots. The location of where one of the private roadways comes out onto University Drive
has been coordinated with a median opening planned as part of the State's widening of
University Drive. The location of these access easements has also been coordinated to
accommodate traffic from the Quality Suites and Cedar Creek Condo's located immediately east
of this site.
The land use plan shows this area for retail commercial uses along the University Drive frontage
and high density single family uses along the Lincoln Avenue Frontage. This land use pattern is
reinforced with a pending rezoning from A-P to C-B and the step down zoning pattern in this
area.
Item Background: A rezoning of a portion of this subdivision from A-P to C-B was approved
by the Commission on October 21, 1999. The Commission approved the rezoning with the
condition that a buffer be established meeting the R&D requirements whereever the newly
created C-B lots and the adjacent R-4 meet and that no penetration occur for vehicular access.
The P&Z agreed with the applicant's request that the buffer not extend through the detention
pond. This rezoning will be considered by City Council on November 11, 1999.
This replat is a combination of all of the Henton Subdivision and a portion of the One Lincoln
Place Subdivision to form the Henton-Lincoln Subdivision.
Budgetary & Financial Summary: The applicant has not requested any oversize participation
funds.
Staff Recommendations: Staff recommends approval with the condition that water be extended
through Lot 7 at the time of development of this lot.
Commission Action Options: The Commission has final authority over the final plat. The
options regarding the final plat are approval as submitted, approval with conditions, or denial.
Defer action or table only at applicant's request.

INFRASTRUCTURE AND FACILITIES
Water: Water will be extended to all lots in this subdivision as part of this plat. Water
will be extended through Lot 7 at the time of site development of this lot.
Sewer: Sewer will be extended to all lots in this subdivision as part of this final plat.
Streets: The subdivision has frontage on University Drive, a major arterial, and
Lincoln Avenue, a major collector. All commercial lots to the subdivision will take
access via University Drive. The proposed residential portion of the subdivision, Lot 7,
will take access to Lincoln. There will be no vehicular connection or access between
the commercial and residential portions of the subdivision.
Off-site Easements: N/A
Drainage: A detention pond to serve all lots in the subdivision will be located on Lot
8.
Flood Plain: No part of this proposed subdivision lies within the 100-year floodplain.
