(93-426) A Presubmission Conference was held Wednesday, December 22, 1993 to discuss the above mentioned parking lot plan. David Pullen moved to recommend approval of the proposed site plan with the following conditions: CONDITIONS OF APPROVAL: _ City Council grants approval of a license to encroach into the 15' utility easement on the west side of the property. Planning and Zoning Commissioner Mary Elizabeth Herring seconded the motion to approve the site plan with the condition listed above which passed unopposed (3 - 0). The following comments were made by the various reviewing agents: I PRC Report Signs Now/Aggieland Case #93-426 Page 2 COMMENTS/CONCERNS: _ Work with staff on the screening and possible relocation of the dumpster. _ Make sure the canopy construction does not interfere with telephone service. Coordinate details with G.T.E. Representative Laverne Akin at (409) 821-4723. _ Take notice that any further changes may require fire protection review. _ The canopies cannot extend more than 15' away from the face of the building. Either shorten them to 15' or provide fire wall protection between properties as required by the Standard Building Code. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to the Planning and Zoning Commission within five days after the PRC Committee meeting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of the final site plan as approved by the PRC, showing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no further development approval shall occur, and no further action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site plan shall be final. Any notice of appeal shall state with particularity the aspects which are to be appealed. Coordinate appeal process with Development Coordinator Shirley Volk at (409) 764-3741.
