AGENDA ITEM NO. 9: Public hearing and consideration of a rezoning for Klunkert Office
building located at 4090 Raymond Stotzer Parkway, from A-O Agricultural Open to C-2
Industrial Commercial. (99-127)
Senior Planner McCully presented the staff report and said that the subject property is in the process of
being remodeled from a nonconforming service station that was annexed into the City several years
ago to a construction office. The changes made thus far have fallen under legal nonconforming status,
but the applicant intended to expand the use to include on-site storage of construction materials, which
is beyond the scope of legal nonconforming status. The Land Use Plan reflects the area as future light
industrial/research and development. That classification would call for exclusively industrial
development, and the requested C-2 includes several industrial type uses in addition to general
commercial uses, such as those allowed in C-1. The industrial uses listed in the C-2 district would be in
compliance with the plan. Staff recommended approval of the rezoning request.
Chairman Rife opened the public hearing.
Mr. Matt Klunkert, 8413 Shadow Oaks, (the owner) explained that this use would be for a commercial
industrial construction company. There would be very little equipment stored on site, and would not
involve any fuel storage. The surrounding properties are owned by Texas A&M University.
Chairman Rife closed the public hearing.
Commissioner Horlen moved to recommend approval of the rezoning request. Commissioner Warren
seconded the motion.
Commissioner Floyd said that he was in favor of the intentions of the applicant. He commended the
applicant for building a nice building, and felt it was an improvement to one of the major gateways
into College Station. His concerns were with the other permitted uses in the C-2 classification.
Commissioner Kaiser was also concerned with what other types of businesses could be brought in if
this business were to relocate.
Commissioner Mooney expressed his concern with security for this business with the storage of
equipment. He felt that intense screening would allow for security and beautification of the
development.
Chairman Rife called for the vote, and the motion to approve the rezoning failed 1-5; Commissioner
Horlen voted in favor of the motion.

Commissioner Floyd moved to deny the request without prejudice. Commissioner Mooney seconded
the motion, which passed unopposed 6-0.

Item Summary: The subject property is in the process of being remodeled from a
nonconforming service station that was annexed into the City several years ago to a construction
office. The changes made thus far have fallen under legal nonconforming status, but the
applicant intends to expand the use to include on-site storage of construction materials, which is
beyond the scope of legal nonconforming status.

Item Background: The subject tract was annexed into the City in 1995 and was placed in an
interim A-O zoning classification. At the time of annexation, a service station existed on the
property. The preexisting use was permitted to continue operation due to non-conforming status
that is due most uses by state statute upon annexation into a municipality. The current owner
purchased the property a couple of years ago, and remodeled the existing building into an office
use without enlarging it or replacing the use for a more intense use. The replacement was thus
permitted under the use's legal nonconforming status. The applicant also replaced an existing
nonconforming parking lot, which was also not enlarged; the replacement was therefore also
permitted with the condition that it meet current development requirements.
Since 1995, three rezonings have taken place within the area bound by 2818, Raymond Stotzer,
and the City limits lines. Two of the three rezonings were similar to this request, in that they
were on individual tracts that had frontage on Raymond Stotzer and the requests were in
compliance with the Land Use Plan. Those tracts are currently zoned M-1 and C-2.

Staff Recommendations: Staff recommends approval.
Related Advisory Board Recommendations: The Planning and Zoning Commission held a
public hearing on December 16, 1999 and recommends denial without prejudice to give the
applicant the opportunity to return with a request for PDD-B. The Commission was concerned
with the broad range of the C-21ist of permitted uses (see minutes for more detail).

Mayor Mcllhaney opened the workshop meeting at 3:05 p.m.
Workshop Agenda Item No. 1-Discussion of consent agenda items listed for Regular
Council Meeting
Council members asked questions about the following consent agenda items: 11.05, 11.07, and
11.14. PARR Director Steve Beachy provided an explanation for the ball field shade covers.
Wastewater Superintendent Bill Riley discussed the Drought Contingency and Emergency Water
Plan. On Item No. 11.14, Councilman Silvia explained that the ordinance amendments to the
Health and Safety Code to the city's code of ordinances met the state statutes.
Workshop Agenda Item No. 2 -Presentation, discussion and possible action during a joint
workshop of the City Council and 4B Business Development Corporation regarding
economic development goalstpriorities, issues and role of the 4B Business Development
Corporation.
Economic Development Director Foutz explained the purpose of the joint workshop was for
review and discussion on the economic development goals, issues and the role of the College
Station Business Development Corporation (4B Board). 4B Board members present were Harry
Green, Nancy Crouch, Mark Weichold and Gene Joyce.

The developer Tony Jones, 2800 Longmire #50 asked for approval of R-2 zoning for 5 acres and
C-1 or C-B for the remaining 2.08 acres.
Robert Jefferson of 1728 Purple Martin expressed support of the development.
Donald Jones of 804 Berry Creek expressed support of the development.
Mayor McIlhaney closed the public hearing.
Councilman Maloney made a motion to deny the rezoning request. Councilman Massey
seconded the motion, which failed by a vote of 2-4, Councilman Hazen absent.

Councilman Silvia made a motion to approve Ordinance No. 2426 rezoning a tract of land
totaling 5.07 acres from R-1 Single Family to R-2 Duplex Residential and deny C-1 for 2.08
acres without prejudice and send back to Planning and Zoning Commission so the applicant may
return with a request for PDD-B zone. Councilman Maloney seconded the motion, which
carried 5-1, with Councilman Hazen absent.

Senior Planner McCully presented this item. The property is in the process of being remodeled
from a nonconforming service station into an office for a construction company. The changes
made thus have fallen under legal nonconforming status. The applicant intended to expand the
use to include on-site storage of construction materials, which is beyond the scope of legal
nonconforming status. The Land Use Plan reflects the area as future light industrial/research and
development. The Commissioners commended the applicant for the improvements to the area.
Their concerns related to the other types of permitted uses in a C-2 classification.
The Planning and Zoning Commission recommended denial without prejudice to give the
applicant the opportunity to return with aPDD-B.
Senior Planner McCully read a letter from Mr. and Mrs. Gilmore of 4098 Raymond Stotzer
Parkway who opposed the rezoning.

applicant the opportunity to return to the Planning and Zoning Commission with the request for
PDD-B zoning. Councilman Garner seconded the motion, which carried 5-1, with Councilman
Hazen absent. .

12.5 Public hearing, discussion and possible action on a rezoning approximately 0.71 acres
located near the northwest corner of Highway 6 and University Drive East from C-B
Business Commercial to R-5 Apartment Medium Density. (99-1641
Mayor McIlhaney opened the public hearing. No one spoke. She closed the public hearing.
Councilman Silvia made a motion to approve Ordinance No. 2427 rezoning approximately 0.71
acres, located near the northwest corner of Highway 6 and University Drive East from C-B
Business Commercial to R-5 Apartment Medium Density. Motion seconded by Councilman
Massey, which carried unanimously, 5-0, Councilman Hazen and Mariott absent.
12.6 Discussion and possible action on an ordinance amendment to Chapters 3 and 9 of the
College Station City Code, adding sections providing for a moratorium on certain building
permit and platting applications.
Development Services Director Jim Callaway presented amendments to Chapter 3 and 9 of the
City Code to establish a moratorium on replats and building permits that could provide for
additional inappropriate infill development in older areas zoned for single-family residential
uses. The two areas are:
Area 1 - An area bounded by Texas Avenue, Holleman Drive, Wellborn Road and
George Bush Drive.
Area 2 - An area bounded by Texas Avenue, University Drive, the Earl Rudder Freeway
and Harvey Road.
The following individuals came forward to support the ordinance amendments:

Mayor Pro Tem Mariott made a motion to approve the ordinance as presented amending
Chapters 3 and 9 in the City Code of Ordinances, adding sections providing for a moratorium or
certain applications in specific areas. Motion seconded by Councilman Maloney.
