Item: is eating and-~~' c~ o'nsi'ct~ra~ien- rezoning of 19.149 acres from A-O Agricultural
O en to R-1B Single Family Residential, 1 ed east of State Highway 6 and north of Emerald
Par his rez r hase 11 of the Emerald Forest Subdivision. This phase is
located south of the existing Emerald Forest Phase 10 and east of existing Emerald Forest Phase 8
with frontage on Appomattox Drive. Application is in the name of Allen & Greg Swoboda.

Item Summary: This request .will add 19.149 acres of single family residential zoning to the
existing Emerald Forest Subdivision.. The proposed R-1B zoning district is in compliance with
the medium density single family residential designation shown on the City's Comprehensive
Land Use Plan. The adjacent phases of Emerald Forest, Phases. 8, 9 and 10, are zoned R-lA
which allows a minimum lot size of 4,000 square feet per single family lot. The remaining
surrounding property is zoned A-O Agricultural Open. The proposed R-1B zoning district will
allow lots that are larger than the minimum R-1 lot, but smaller than the minimum A-OR lot. The
minimum lot size in the proposed. R-1B zoning district is 8,000. square feet with a maximum of
5.4 dwelling units. per acre. The maximum number of dwelling units given the proposed R-1B
zoning, is a total. of 1,03 dwelling units. In reality, the number of dwelling units will be less given
that land will be dedicated for public rights-of--way.
Item Background: The subject 19.149 acres are a part of a larger parent tract, which includes
previous phases of the Emerald Forest. Subdivision. This particular phase, Phase 11, is the fnnal
phase of the existing Master Preliminary Plat. Since this Master Preliminary Plat has expired, a
revised Preliminary. Plat will be required prior to the final platting of this phase..
Staff Recommendations: Staff recommends approval of the rezoning.
Related Advisory Board Recommendations: N/A
Commission Action 'Options: The Commission acts as a recommending body on the question of
rezoning, which will be ultimately decided by City. Council. The Commission options are to
recommend approval of rezoning as' submitted;- recommend approval with physical conditions
that will mitigate negative impacts, recommend a less intense zoning classification, recommend
denial, table indefinitely, or defer action to a specified date.
INFRASTRUCTURE AND FACILITIES:
The developer will be extending necessary public infrastructure to support this rezoning request
as part of the platting process. Drainage-will be addressed at the time of final plat review.

Open to R-1A Single Family Residential, located east of State Highway 6 and north of Emerald
.Parkway. This rezoning request is for Phase 11 of the Emerald Forest Subdivision. This phase
is located .south of theexisting Emerald Forest Phase 10 and east of existing Emerald Forest
Phase 8 with .frontage on Appomattox Drive. Application is in the :name of Allen ~ Greg

given the proposed R-1A zoning, could be a total of 165 dwelling units, but in realoty, the
property is being platted for 55 lots. The average lot size is 12,200 s.f. The rear setback can
be reduced from 25 feet to 20 feet with R1-A zoning.
