ORDINANCE NO.
AN ORDINANCE :REZONING A TRACT OF LAND TOTALING 6.76 ACRES, LOCATED
IN THE CRAWFORD BURNETT LEAGUE ABSTRACT #7, BEING 300 SOUTHWEST
PARKWAY, IN COLLEGE STATION, BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE. CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That the City of College Station. Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A", "B", and "C" attached
hereto and made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable. by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000.00). .Each day such violation shall. continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective not less than ten (10) .from the date of it's
passage by the City Council, as provided by Section 35 of the Charter of the City of
College Station.
PASSED, ADOPTED and APPROVED this 23rd day of September, 1999.

The following property is rezoned from R-4 Apartment Low Density to R-5 Apartment
Medium Density:
A 6.76 acre tract- by metes and bounds in the attached Exhibit "B" and shown
graphically in Exhibit "C", out of the Crawford Burnett League Abstract #7, being 300

tract of land conveyed to Jerry Windham as recorded in Volume 628, Page 523 .and .Volume 928,
Page 34 of the Brazos County Deed Records and being. out a called 3.6.182 acre tract as described
in Volume 436, Page 558 of the Brazos County Deed Records, located in the Crawford Burnett
Survey, Abstract Number 7, Brazos County, :Texas, said 6.8031 acre tract more particularly
described by metes and bounds as follows (with bearings referenced to monuments found a-ong
the common southeasterly right-of--way line of Southwest Parkway and the northwesterly line of
said 6.76 acre tract):
BEGINNING at a'/z-inch iron rod found in the southeasterly. right-of-way line of
Southwest Parkway (80 foot wide right-of--way) said point being the northwesterly corner
of the herein described tract. and northeasterly corner of the residue said 36.182. acre
tract, ..from said point a found '/z-inch iron rod` bears South 56° 57' 06" West, a distance of
453.88 feet;
THENCE, North 56° 57' 06" East, along the southeasterly right-of--way line of said
Southwest Parkway, at a distance of 313.02 feet pass a found '/z -inch iron rod, and
continuing for a total distance 439.06 feet to a "capped" 5/8-inch iron set atthe
northeasterly corner of the herein described tract and the northwesterly corner of called
5.572 acre tract as described in Volume 743, Page 382. of the Brazos County Deed
Records, from said point a found '/z-.inch iron rod bears North 56° 57' 06" East, a distance
of 396.83 feet;
THENCE,. South 43° S I' 38" East, along the southwesterly line of the said 5.572 acre
tract of land, a distance of 646.86 feet to a "capped" 5/8-inch iron .rod set in the
northwesterly right-of--way line of Christine Lane (right-of--way width varies), said point
being the southeast corner of the herein described tract and the southwest corner of said
5.572 acre tract, from said point a found '/z-inch iron rod bears North 44° 09' S9" East, a
distance 410.48 feet;
THENCE, South 44° 09' S9" West, along the northwesterly right-of--way of said Christine
