Application is in the name of Fain McDougal. (99-10'n Item Summary:. The. subject property was rezoned from C-N to A-P in 1991 as a part of the City- initiated rezonings that took place to implement the. University Drive Plan. The intent was to create a core of administrative/professional development, with higher intensity commercial development at either end of the University Drive Corridor. However, subsequent rezonings have created substantially more C-B zoned .property in the. Corridor, and' the latest Land Use Plan for the Corridor takes these changes into account and reflects regional commercial for the area just west of Tarrow and extending to the Spring Loop .intersection. The requested rezoning is in compliance with the Land Use Plan and with the City's development goals for the Corridor. Item Background: The University Drive Corridor Study, which was adopted by Council in 1991, recommended. a ,mix of commercial and office. uses for. the majority of the University Drive frontage. extending from Tarrow to the East Bypass. The intent of the .recommendations was to encourage an attractive entrance into the City through land. use and aesthetic controls. Council approved a new commercial .district, which lists a range of uses such as hotels, restaurants, and retail; but prohibits .convenience stores and service stations'. The. lots that. had been zoned C-1 during the 1980's were rezoned to the new C-B District in 1992 to ensure uses would be in compliance with the corridor plan. The Qverlay District was.. created and :applied to the corridor as well. This district contains specific aesthetic requirements and restrictions. The. original intent of the University. Drive Plan was to leave a substantial amount of property in the corridor A-P in order to ensure Ghat .these. tracts would develop exclusively asoffice/service uses. Some of the. earlier rezoning xequests for C-B in the Corridor were denied in favor of A-P, including a-request in 1992 for the subject property that was rejected. However, most of the more recent rezoning. decisions have.. supported additional C-B in the area,: giving potential development a wider range-of land use choices and allowing for other uses: such as hotels and restaurants.. The subject tract was first rezoned R-4 to'continue the line of fourplex development that exists to the north of the subject tract.. It was then. rezoned to C N in 1983 to facilitate a convenience store, which was approved but never built. In' 1986, a site plan was. approved for a small shopping center, which :also was not built. Staff Recommendations: Staff recommends approval. Related.Advisory Board Recommendations: N/A Commission Action .Options: The Commission acts as a recommending .body on the question of rezoning, which. will be ultimately decided by City :Council. Sewer: Sewer service is currently under construction as part of the Wheeler Subdivision and is sized as shown in the University Drive Wastewater Impact study by Camp Dresser McKee. Streets: The site has frontage on University Drive, a major arterial, and on Spring Loop, a major collector. Access will be restricted to Spring Loop with possible internal access through the Hartland Bank property located immediately to the west. Off-site Easements: N/A Drainage:. Willbe reviewed at site plan stage. Flood Plain: None on site. Oversize request: N/A Parkland: Not required of commercial development.
