STAFF REPORT Item: Public: hearing and consideration of rezoning Lots 2 and 3 of Block 4 of Pooh's Parks Subdivision located along the north side of Holleman between Texas Avenue and Lassie. Lane from WPC -Wolf Pen Creek to C-1 General Commercial. [# 99-100 (Lot 2, Blk 4) and # 99-102 (Lot 3, Blk 4)] Applicant: Eric Seitz. c/o Kimley-Horn & Assoc. for John Denison, property owner of Lot 2 and for Garland Williams, property owner of Lot 3, Item Summary; In October of last year the Council rezoned the Lot 1, Blk 4, west and adjacent to these two lots from WPC to C-1 General Commercial. At that time P&Z had recommended that the City initiate rezoning of the remainder of the individual lots along Holleman west of the future extension of George Bush from WPC to commercial. This applicant came into request rezoning of two of the remaining lots prior'to any initiation taking place. Item :Background: The. following comments were taken from the staff report prepared for the rezoning. considered in October of last year: " One of the. things staff analyzes in a rezoning case,. along. with the Comprehensive Plan, is whether conditions have. changed to justify a particular request, especially if that request is :contrary to the: land use plan. In this case, the rezoning that took place two years ago (the 'large Pooh's Park rezoning constitutes a sgnificantchange in the WPC boundary. It left several small lots along Holleman as well as some lots along Texas Avenue, isolated from the remainder of the district. This change. could justify rezoning these lots out of the WPC district and to another commercial zoning classification. Another change that has occurred in the area is the addition to the thoroughfare plan of the extension of George Bush Drive East to .Holleman. This. future street extension should serve as-a definitive boundary, a demarcation line, between the existing. C-1 zoning west of it and the. remainder of the Wolf Pen Creek district to the east. The P&Z held a hearing on 9-17-98 and recommended rezoning lot 1, block 4 from WPC to C-1 and recommended denial of rezoning lots 8, 9, & 10. The Commission felt that this motionshould send a message to property owners in the WPC corridor that the Commission -will not look favorably on taking any property east of the George Bush Drive. extension out of the WPC zoning district. The Commission also suggested that the City look at initiating rezoning the remaining lots on Holleman that. are west. of the George Bush extension and the lots on Texas that extend from Holleman. north to the large Dale tract from WPC to C-l or some other commercial district. Staff Recommendations: Staff recommends approval. o:lgroup\deve_ser\stfrpt\99-100.doc .~ Commission Action Options:: Thee Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options .are to recommendapproval of rezoning as submitted, recommend approval .with physical conditions that will mitigate negative impacts, recommend a less intense zoning classification, recommend denial, table indefinitely, or defer actiomto a specified date. Infrastructure and facilities-:Information INFRASTRUCTURE AND FACILITIES: This site has adequate public infrastructure to support this rezoningrequest. Drainage will be addressed atthe time of site plan review. According to FEMA floodplain maps, these lots are not located within the 100-year floodplain.
