7.10 DISTRICT C-N NEIGIiBORHOOD BUSINESS
A. PURPOSE: This district .provides small commercial sites for residential convenience
goods and personal service businesses. No use .shall be allowed which would adversely
affect the health, safety, welfare, or residential. character of the neighborhood. The use
shall be a low traffic generator and shall not create any noise, li~ht, or odors abnormal to
the neighborhood. No outside storage or display of goods or ma erials shall be allowed.
B. PERMITTED USES:
All uses ppeermitted within the C-N District shall be determined for each proposed,location
by the Planmn and .Zoning Commission pursuant to the procedures established in
Section 10.6. Uges to be considered by the Commission are:
Retail sales of beer and wine only -restricted to off-premises consumption - 2,500 square
feet maximum floor area.
Retail food store -.2,500 square feet. maximum floor area.
Retail sales - 2,000 square feet maximum floor area.
Restaurant providing prepared food for off-.premise consumption only - 1,500 square feet
maximum. floor area.
Personal service shops - 2,000 square feet maximum floor area.
Offices - 2,000 square feet maximum floor area.
Small recyclin collection facilities.

Other uses to be determined by the Commission.
C. SPECIAL .RESTRICTIONS: The following ~ special restrictions are applicalble to all
developments located within C-N zoning Districts:
1. 10,000 square feet total maximum building. floor area.
2. No C-N zoning district shall exceed 2 acres in area.
3. Adjacent C-N zoning districts shall not exc~ci a combined totai of 2 acres vi area.
4. Muumum depth-
1 acre or less site - 150 feet
Site greater than 1 acre - 250 feet.
5. No restaurants providing on-premise consumption or commercial amusements shall
be allowed.
D. SITE PLAN/LANDSCAPE REVIEW REQUIItED: Refer to Sections 10 and 11.
E. CONDITIONAL USES PERMITTED: The following conditional uses shall be allowed
in addition to any use allowed under section 8. i2:

RE: Consideration of gas pumps on a C-N zoned lot
The Commission .has final approval over all. uses and site plans for C N zoned properties. As
such, the Commission is charged with determining whether or not each individual request is in
compliance with the purpose statement of this district, ,and whether the proposed use would be
compatible with the existing and future uses of the surrounding area. The C N district specifically
lists the uses that may be considered by the Commissions for .approval, with floor area restrictions
by use. The district also authorizes the Commission to consider "other uses".
The applicant proposes to build a convenience store with four gas pumps on the C N zoned corner
of Dartmouth and Southwest. Parkway. This relatively new extension of Dartmouth shows firture
R-5 zoning immediately abutting the site to the south and A-P zoning to the west. T'he area ac;ross
Dartmouth to the east is platted as a future duplex subdivision. Dartmouth is shown on the
Thoroughfare Plan to continue to the south and connect with Krenek Tap. The subject property
was identified in the 2818 Extension Study as commercial to serve the future medium and high
density residential areas and to Central Park.
The convenience store would be permitted because retail sales are permitted with a maximum lease
space size of 2500 square feet. The conceptual site plan that accompanies this submittal shows an
overall building size of 6100 square feet, which would meet the maximum building size restriction
of 10,000 square feet. If the total building is divided into lease spaces that meet the square foot
maximum of each individual use, the retail uses of the proposed development would fit withui the
uses the Commission may authorize in a C-N district.
The gas pumps are not listed specifically as a use that the Commission could consider, however,
the applicant is requesting that the Commission authorize the gas pump use under the C N
provision that "other uses to be determined by the Commission." In making its determination, the
Commission should take into consideration the intent of the district (i.e. the Purpose statement),
whether the use would be compatible with other C N uses (i.e. the list of Permitted Uses), and
whether the use would be compatible with the existing and future uses in the immediate area.
