Attached is the ordinance that amends the subdivision regulations bytaking Council out of the plat
review process., -The ordinance removes references to Council from the. plat review and sub reg variance
process. The ordinance establishes Courtcit as the authority for approving or disapproving oversize
participation requests a~-d development agreements l have also added a clarification to the requirement
thaf zoning requests be submitted-with preliminary plats if a zoning change is necessary for the plat.

Item: Consideration and possible action on an ordinance amending Chapter 9 of the College
Station City Code, establishing the Planning and Zoning Commission as the authority for plat
review and approval and establishing the City Council as the authority for review and approval of
development agreements and oversize participation requests.
Item Summary: The attached ordinance amends the Subdivision Regulations (Chapter 9 of the
Code)., The amendment makes the Planning and Zoning Commission the final authority for
approving or disapproving master plans, preliminary plats, final plats and variances to the
SubdivisonRegulations. The amendment gives Council authority far approving. or disapproving
oversize participation (OP) requests and development agreements.. If this. ordinance is adopted,
plats will no longer be placed on the Council agenda. The .action of the Commission in approving,
disapproving. or conditionally approving. plats will be final
In addition to the above, this amendment clarifies the timing for submission of rezoning requests
related to preliminary plats. Any zone change, necessary for a development would have to be
submitted with the. preliminary plat. This will make sure that the zoning/land use issues are
brought before Council on the "front-end'' of the platting process.
Item Background: _ On October 8 199:8, the Council discussed changes: in the agenda content
and process. At-that time, .Council decided to delegate all plat review to the Planning and Zoning
Commission. This amending ordinance provides for that delegation in accordance with Council's
direction.
Related Advisory Board Recommendations: This item was not presented to any advisory
boards for recommendations: Advisory board. review is not required for amendments to the
subdivision regulations. Additionally, the amendment was prepared at Council direction. The
Planning and Zoning Commission was advised ofthe pending change at the November 19, 1998
Planning and Zoning Commission Workshop.
.Staff Recommendation:: This ordinance. accomplishes the changes as directed by Council on
October S. This will save. hree weeks of process time for preliminary plats, master plans and final
plats (for those final plats that required .Council action). It will also reduce the number of items
prepared for the Council. agenda. We recommend approval

Section. 6-B. l is amended. to read as follows:
6-B.1 A master development plan is required .for large
developments where there are planning issues. including but
not limited o street locations and :sizes, public facility
locations, lot layout, park and greenbelt locations, etc. - to
be ` addressed and where .there will be subsequent
preliminary and or' final plats occurring over a long period of
time.
All Master Development Plans must be reviewed. and
approved byl~ the Planning & Zoning Commission~~

approved, the. applicant may submit a Master Preliminary
Plat covering the entire area included on the Master Devel-
opmentPlan.
Developments that will be developed in one phase will not

Any master development plan shall depict the following:
(a) proposed land uses,` including but not limited to
street
rights-of--way;
(b) proposed zoning changes;
(c) proposed drainage development;.
(d) proposed public improvements, including but

After approval of this master preliminary plat, t:he
subdivider may submit fractional final plats in
accordance with the. master preliminary plat by units
or areas. Each increment or area must be adjacent
to a preceding development or area. A master
preliminary plat shall be effective for a period bf one
(1) years. and may be extended for an additional
period of twelve. (12) months,: upon written .request
and approval of the Commission. The.' approval of
each increment as a final plat will extend. the
approval of the master preliminary plat. for: twelve
(12) months.

action by the. Commission C-e~t~c~l, the City will
transmit to the .subdivider one (1) copy of the plat
marked "APPROVED" or "CONDITIONALLY
APPROVED" with the conditions stated on the plat.
Approval or conditional approval will be the authority
to proceed with the preparation of the finale plat but
does not constitute .acceptance of the final plat.
Section 6-C_2 is amended to read as follows:
6.C.2 An applicant may request oversize participation on .any
infrastructure, as provided in Section.. 9 of ..these
regulations. Iri order to do so, .impact studies covering
the. :particular infrastructure must be ..submitted
justifying the request for oversize. These studies. shall
indicate what size infrastructure: is necessary. to serve
.the proposed :development as shown. on an approved
master development plan or master preliminary plat.
If -the. city's comprehensive. plan, calls for infrastructure
in excess of that required for the proposed
development, the applicant. may request participation
for this addtonai size. The City .Council .will consider

subdivider shall submit a formal request of zoning change. as
required under the zoning ordinance with the prelimina:~
plat application.

approved by .the Commission, and if desired by the
subdivider, it may be a portion of a master preliminary plat.

that it conforms to all requirements of these regulations.

That if any provisions of any section of this ordinance shall be held. to be
void or unconstitutional, .such holding shall in no way effect the validity
of the .remaining provisions. or sections of .this ordinance, which shall
remain in full force and effect.
IIL
T~iat any person, .firm, or corporation .violating. any of the ..provisions. of
this chapter shall. be deemed guilty of a misdemeanor,.. and. upon
conviction thereof hall be punishable by a fine of note less than Twenty-
five Dollars ($25.00) nor more than Two Thousand Dollars. ($2,000..00).
Each day'such violation'shall continue or be permitted to continue, shall
be deemed a separate offense: Said Ordinance, being a penal ordinance,
becomes effective ten (10) days after its publication in the newspaper, as
provided by Section 35-of the'Charter of the City of College Station.
