The street will be forma~i closed when the city votes to abandon the right-af-way. From that point in time, the City~f free of any further obligation toward the land or ownership interest, although utility easements survive the action (telephone, electric, cable, and storm drainage service at the rearbf the Devonshire lots). Abandonment of right-of-way reverts the ownership boundary to #hat which was inexistence prior to the road, in this case, the old league line down the middle of North Graham Road. Since the Devonshire subdivision plat granted additional right-of-way for the road,. you will receive more than half of the roadway. If left without a legal description as received from the abandonment action, there could be confusion should you sell your home. Therefore, the developers of Edelweiss have instructed McClure Engineering to prepare a plat which will provide legal descriptions, show easements and give you precise lot dimensions. We fenced around this culvert for cosmetic reasons. The existing pipe that goes through our. backyard is about one foot above the ground elevation and stops short of our back tat line by several feet. Therefore, there is an open. ditch several feet long which extends to the back of our fence line. This ditch collects all the water and debris which.. comes. out cif the culvert. The water which enters the culvert frorn the Shire street side comes from x-eighbors washing automobiles, excess waterfrom lawn sprutklers and rain water. Therefore, there is usually standing water in the ditch. Any trash that is thrown. down the culvert from the Shire'stroet side,. ends up in the diteh. We have..also had mosquito problems in past-years because of the standing water. The city. has. been called an this problem and. they tried to redig the ditch for better drainage, but it did clot help. When Graham Road. is abandoned: and our fence lines :extend to this road, we foresee problems with the existing pipe and ditch which mill then be visible in our backyard: The following is suggested: 1. Lowering the. existing. pipe. in our backyard below ground 1eve1 so that it can be covered with dirt and grass will grow on top of it. 2. Ttepairing the existing pipe as it has separated and has created a cavity where the dirt around it has washed out. 3. Add pipe to the bulk head so that it extends out'of uur backyard; bury the pipe below the .ground level and tie it into the existing drainage line on the abandoned Graham Road.
