Item: Public hearing and consideration of a conditional use permit for the use only of a proposed
martini and wine room located at 313 Church Street in Northgate. (98-707) ,
Item Summary: This request is for the. use only of a nightclub located in the multi tenant building
on the corner of Church St. and Second St. (the same building as Burger Boy). The business
would be open in the evenings and primarily serve mixed beverages, coffees and espresso. The
property is in the NG-1 zoning district.
Item Background: This building was recently remodeled and .includes` some parking spaces.
Because of he urban style shared parking concept in Northgate, the Northgate Review Board only
required 10 parking spaces. The remainder. of the parking demands would be met by off-premise
parking including on-street parking spaces, he Patricia street parking lot (across the street from
this building), the Northgate parking garage in the future, and other public parking areas.
Budgetary & Financial Summary: N/A
F Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit. a conditional use subject to appropriate conditions
and safeguards, when after public notice and hearing the Commission finds that: (Staff comments
are in italics)
1. "The proposed use meets all the minimum. standards established in the ordinance for the
type of use proposed." The business will be located in an existing building and no siteplan will
be required. In order to meet the requirements of a liqueur license, the business is required to be
'' 300 feet from any .church or school. It appears that this locations :does not meet this
requirement. The owner can seek a variance to this .requirement from the City Council.
~' 2. "That the proposed use. meets the purpose and intent of the ordinance and is in harmony
with the development policies and goals and objectives as embodied in the Comprehensive Plan for
Development of the City." This use is not in conflict with the Land Use Plan which shows a mix
of residential and commercial uses in the Northgate area..

3. "That the proposed use will not. be detrimental to .the health, welfare, and safety of the
'~~ surrounding neighborhood or its occupants, nor be substantially or permanently injurious to
'~ neighboring property." The public hearing is an opportunity for the .Commission: to measure the
potential impact on surrounding land uses.
~~, "The Commission may impose additional reasonable restrictions or conditions to carry out the
spirit and intent of the .ordinance and to mitigate adverse effects of the proposed use. These
requirements may include, but are not limited. to, increased open space,. loading and. parking
requirements, additional landscaping, and additional improvements such as curbing, sidewalks and
screening."
Unless the public hearing brings to light any new information :indicating potential negative
.impacts, Staff recommends approval with the condition that the owner obtain the appropriate
liqueur license.

Water:... A 6 inch line is located along .Church Ave., and a 2 inch line is located along
Second Street. Water service for the proposed usage could be served: by either line.
Sewer: There is a 6 inch line along Church, and a 6 inch line that runs to the "rear of the
property. Either line. could handle the additional sanitary sewer loading resulting from
the proposed usage.
Streets: The property is bounded on the southwest by Second Street and on the
southeast by Church Avenue.
Off-site Easements: N/A
Sidewalks: There are `existing sidewalks in front of the building.
Drainage: N/A
Flood Plain: The property is not located within the 100 year floodplain.
