(98-706) Item Summary: The. request is for approval of the .sorority use and associated site plan. The ~, existing zoning on the property, R 6, would allow for high density apartment development without ~ additional review. Area uses include a orority house to the west, an apartment complex to the east across Rhett Butler, duplexes to the north across University Oaks, and the Circuit City facility ~ abutting to the south.. The area to the west of Munson includes a number of similar sorority houses, many of which were built in the late `70's to early `80's, prior to the` current site plan (parking and landscaping) requirements. The site plan shows parking that exceeds the current ~ ordinance re uirement b 15%. q Y Relationship to Comprehensive Plan: The Land Use Plan shows this area as attached residential. I, Item Background: A similar use and site plan were approved in 1994 by the Conunission on the subject tract. Budgetary & Financial Summary: NA , Staff. Recommendations: Section 14 of the. Zoning Ordinance authorizes the existence of conditional uses.. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comrraents are in italics) L "The proposed use meets .all the muumum standards established in the ordinance for the type of use proposed." This use meets all"of the minimum ordinance requirements. 2. "Than the .proposed use meets the purpose and .intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plain for Development of the City." This use is not in conflict with the Land Use Plan. 3. "That the proposed use .will not be detrimental. to .the health, welfare, and safety of the surrounding .:neighborhood or .its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding7and uses. I, "The Commission may .impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse. effects of the proposed use. These comments have been addressed on the revised plan that. is included. with the Commissioners' packets. Commission Action.
