AGENDA ITElVI NO. 1: Approval of minutes from the Regular Meeting held on October 15,
1998.
Commissioner Maloney moved to approve the minutes from the Regular Meeting of October 15, 1998.
Commissioner Parker seconded the motion which passed unopposed. (5-0).
AGENDA ITEM. NO. 2: Public hearing and consideration of a conditional use permit for the
site plan of a proposed addition of a fellowship hall for the existing Pleasant Grove Baptist
Church located at 1216 Detroit Street in the McCulloch Subdivision. (9~-7~~) .~~
Senior. Planner McCully .presented the staff report and. said. the site plan shows compliance with all
current ordinance requirements with the exception of completion and approval of a drainage report and
fire flow analysis. Staff recommended approval of the proposed site plan with the condition. that the
drainage report and fire flow analysis are submitted and approved.
Commissioner Garner asked staff if this area was not included in the sidewalk .master plan. Ms.
McCully said that if the master plan did not include this. area the Commission could still require
sidewalks in the plan as a condition.
Chairman Massey opened the public hearing.
Reverend AC. Clark approached the Commission and said that the church has been in the same location
for 25 years and there has been adequate parking. for the .number of .members of the church. The

fellowship hall would not increase the number of members attending sec-vices and functions. The church
- -intends-to increase--the number- of parking paces n_the future~_There are no sidewalks in the area, but_f
the City felt the .need to build. sidewalks in .this neighborhood the church would be willing to do it's part
also. He felt the addition of sidewalks would improve the integrity of the neighborhood.
Chairman Massey closed the public: hearing. `
Commissioner Maloney moved to approve the request with the condition that the drainage report and
fire flow analysis are completed and approved by staff. Commissioner Parker seconded the motion
which passed unopposed (5-0).
Commissioner Maloney expressed his concern that the area needed. sidewalks.. and street lighting.
AGENDA TEEM NO. 3: Public hearing and consideration of a conditional use permit for the use
only of a proposed martini and wine room located at 313 Church Street in Northgate. (98-707)
This item was withdrawn by the applicant prior to the meeting: ',
AGENDA TI'EM NO. 4: Consideration of a Preliminary .Plat of Nantucket Cove in the Extra
Tec-ritoral Jurisdiction (ETA of approximately 30 acres_ containing 14 lots. located south of
Nantucket Phase II and a resubdivision of the Deer Park Subdivision. (98-326) .
City Planner Kee .presented the staff report and explained that the. Land Use Plan shows this area as
medium density single family residential This request is less dense that what the Land Use Plan shows.
Staff recommended. approval as submitted. with a variance to the cul-de-sac length.
Mr. Steve .Arden was present to answer any questions....
Commissioner Garner moved to approve of the request with a variance to the cul-de-sac length.
Commissioner Parker seconded the motion which passed unopposed (5-0).
AGENDA ITEM NO. 5: Consideration of a Preliminary Ptat of The Gateway, approximately 75
acres,; divided into 6 C-B and R-S zoned lots .located on the northwest corner of the University
Drive and Highway 6 including the Glenhaven extension.. (98-327)
City Planner Kee. presented the staff report, .She. explained that the Land Use Plan shows the area as
mixed..: use development. Staff recommended approval of the Preliminary Plat with the. following
conditions:
• The 1.15 acre tract at the corner of University Drive and "State Highway b should be included
with this Preliminary Plat because. it was subdivided out .since the adoption of the City's
Subdivision Regulations.
• The plat needs to reflect shared or cross access with the adjacent properties.
• A water line will need to-be extended across Lot 1 to serve the corner piece. Staff would
support a variance to require the development on the corner piece to construct this waterline
rather than the developer of Lot 1 (the easement is provided).

AGENDA ITEM NO. 1: Approval of minutes from the Regular Meeting held on July 16,1998.
Commissioner Garner noticed. an error in the second paragraph under Agenda Item No. 4 in the
sentence "The assumption was made by that the floodway.:.", she requested removing the word "by" in
the sentence. This will be corrected in the signed. original. Commissioner Parker moved to approve the
minutes with this. change. Commissioner Mooney seconded the motion vhich passed unopposed (5-0).
AGENDA. ITEM NO.2: Public hearing and consideration of a conditional use permit for the use
only of a proposed addition. of a fellowship hall for the existing Pleasant Grove Baptist Church
located at .12.1.6. Detroit Street in the McCulloch Subdivision. (98-704)
Staff Planner Battle presented the staff report. and stated that this request is for a use only and.the site
plan would have to come back to the Commission for approval at a later date. He explained that the
existing .church facility has been located in this neighborhood for a number of years... Several
nonconformities exist on this .site due to it's age. The nonconformities include parking.. area and
landscaping. No additional parking spaces.... will be required because the fellowship hall would not
increase the sanctuary seating capacity. He,pointed out that a parking lot plan and a landscape plan
showing compliance with all '...current requirements must he submitted at the time. of site plan
consideration. This conditional use permit would be for the use only. He said that the Commission
heard a similar request in November 1.994 '.and approved the. addition of a fellowship. hall. The project
was not built and the Conditional Use Permit expired. after twelve months. Thirty-two property', owners
within 200 feet of the site were notified of this request. No response was received prior to the meeting.
The Commissioners expressed concern for adequate parking and layout of the parking area. Mr. Battle
explained that this issue would be addressed at the time of site plan approval.

Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may
"`Y ~ permit a conditional use subject to appropriate conditions and safeguards, when after public notice and
hearing the Commission finds that: (Staff comments are in italics)

1. "The proposed use meets all the minimum standards established in the ordinance for the type of
use proposed." The. applicant will return to the Commission for final site. plan approval.
` 2. "That the proposed use meets the purpose and intent of the ordinance. and is in harmony with the
development policies and goal's. and objectives as embodied in the Comprehensive Plan for Development
of the City." The Land Use Plan reflects the area as residential -and churches are generally
j considered compatible uses with residential as long as potential negative impacts-are mitigated
' 3. "That the proposed use will not be detrimental to the health, welfare,. and safety: of the
surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring
property." The public hearing is an opportunity for the Commission. to measure the potential impact
on surrounding land uses.
"The Commission may impose additional reasonable. restrictions or conditions to carry. out the spirit and
intent of the ordinance and to mitigate adverse. effects of the proposed use. These requirements .may
include,. but are not limited to, increased open space, loading and. parking requirements, additional
landscaping, and additional improvements such as curbing, sidewalks and screening." In the past, the
Commission has required additional. site improvements such as fences or vegetative buffers to screen
adjacent residential areas from a new conditional use or an expdnsion.
Chairman Massey opened the public hearing.
Constantin Barbu, .Architect. far the project, explained that the intent of the fellowship hall is to be able
to hold meetings without opening the church during the week. In the past -the church would have to be
6Crearranged" with tables and chairs for these types of meetings which. was quite an inconvenience. He
said that there is currently on-street parking for this site. He said. that this. addition would not increase
to number of members to the. church. A parking lot plan will be included with the-site plan.
Chairman Massey closed the public hearing.
Commissioner Maloney moved to approve the use only request as .submitted. Commissioner Garner
seconded the motion which passed unopposed {S-0).
' AGENDA` ITEM NO. 3: Consideration of a .Preliminary Plat fore the Harley Subdivision
consisting of 14.57 acres .and. a public hearing and consideration of rezoning of approzimately
6.32 acres out of the total 14.57 acre tract, all located on the -east side of Highway 6
approzimately 4000 feet south of the Rock Prairie .Road.. and. Highway 6 intersection from A-O
Agricultural.Open to C-1 General Commercial. (98-112 & 98-319)

:: City Planner Kee presented the staff report and stated that the applicant submitted this request to allow
for the development of a Harley motorcycle dealership.. The preliminary .plat includes the proposed
dealership site and two adjacent tracts that formed part of the parent tract.. Staff reviewed this plat and
requested several revisions. The revised plat (included in the Commissioner's packets). shows
compliance with the City' Subdivision Regulations, with a few exceptions. Some revisions still need to
be made.

AGENDA ITEM NO. 1: The Consent Agenda consists of non-controversial or
"housekeeping" items required by law. Items may be removed from the. Consent Agenda
by any citizen, City staff member, or Commissioner by making such a request prior to a
.motion and vote on the Consent Agenda.

The'minutes from the meeting of October 20, 1994 were unanimously approved by consent.
AGENDA ITEM NO. 2: Public hearing to "'consider a conditional use permit request
for the expansion of,Pleasant Grove Baptist Church located at 1216 Detroit Street. (94-711)
..City Planner Kee presented the staff report and recommended approval of the .conditional use
permit. -The Project Review Committee reviewed this project on September 22,-1994. It was
determined that the addition would not impact the current parking situation because the parking
requirement for churches is based on seating capacity -only. Therefore, the church retains its legal
non conforming status. The property. has about .twenty-five head in ..parking spaces and may
continue to remain as a non. conforming parking area until significant site changes .are proposed
that effect the ite's parking requirements. If such changes. do occur, total' compliance with all of
the current zoning .ordinance parking lot requirements must be meta ` Thirty-two surrounding
property owners. were notified with no response.
Chairman Hawthorne opened the. public hearing.
Representative of the applicant Roy Hammons approached the Commission and offered to answer
any questions pertaining to the proposed conditional use permit.
Chairman'Hawthorne closed the public hearing.
